My son took 2 videos of the mom being too too rough with their baby (8months) and a baby she was babysitting in his apartment and turned it over to the sheriffs department they automatically removed the baby they then did her mom and her two restraining orders for harassment against him and domestic violence..they went to court all were dismissed my son had filled out sole custody papers through cyfd and the judge said to file them my son also stated he didn't want to take baby away from mom until he knew she was safe....one week later sole custody papers still not signed buly judge but they had filed another false ex parte order to remove the child because she may be in harms way....the mom and grandma showed up at his apartment and he told them he couldn't let them take her till he knew this criminal investigation was done and she was safe .....I found out about that ex part order because I went to get a copy of the sole custody order which is in the same judges desk sole custody court papers files 10-18 not signed ....ex parte order files 10-24 signed ......we do not want her removed from her mother completely but they have to stop with all the false allegations against my son ......he has video of himself with her and her mother with big difference....I am bery impressed how gentle and loving and patient he is with his daughter...she had gotten a cold he took her to the doctor.....and then you watch the mother and she just yells stop it be quiet already and throws her down....he is asking for her to get help but now they filed this

Well…. It may be this way in your state but in florida it is the default. Frequently to the detriment of little babies. Example: a small toddler with an absentee father who wants his 50% at all costs no matter what it does emotionally to that little baby. As opposed to a visitation schedule that is emotionally appropriate for the situation of that baby.
Interesting to hear. In New Mexico, different counties within the state tend to vary widely. Moreover, the difference between NM and another state can be night and day. Best wishes to you and your family!
Compelling persuasion might work tho?
Compelling persuasion can always alter the facts within the law and procedure. But the most compelling argument on the planet can't change NM law and procedure. For instance, the law may prevent a party from opening a case (say a grandparent that lacks standing). Nevertheless, a grandparent that has standing to open a case can then present a compelling case about the facts and the best interest of the child. The same also applies to parents. In New Mexico, CYFD (Children Youth and Families Department) can become involved when there are allegations of abuse or neglect. The abuse and/or neglect can stem from many sources and underlying facts.

Do a video on divorcing wife who is a nurse! My soon to be ex-wife is a nurse. 12 hour schedule on random days each week. Also on call some nights and weekends. I work 8-4, coach my 12yr old son in football & basketball, drop off and pick up my 4 yr old daughter most days, and do majority of cooking and cleaning (I work 40 hrs a wk, she works 36). I sincerely just want consistency for my kids, and don’t think her schedule provides any. Final note, she was a travel nurse up until 4 months ago when we decided to divorce. Guess why we are getting a divorce…. Hint : travel nurses

I’m now trying to get full custody of my kids. Because im just so tired of my kids father not understanding where I be coming from. I make all the decisions when it comes to my kids. All he do is ok bet, that sounds good, he don’t spend time with his kids. He don’t take the time to help me the right way. But I’m scared that I won’t win Because of him taking the only car. I can’t get a job. An now even more I won’t be able to do anything for my kids since he wants to be f up with me. He says because I’m not working that I don’t need the car. He smoked weed in the car, some time the kids be in the car. He smoke cigarettes in the car with the kids all the time.. he doesn’t care if the kids need to be in a car seat. Every times he does to his family with the kids they smoke in the house.. He don’t shower the kids, he don’t do there hair. I pretty much do everything for them. Doctor appointment Therapy session I don’t do drugs, I don’t drink I don’t smoke

Awesome! I'd lean towards 50-50 if I was a judge. Also, from my experience, judges in small towns tend to be open to 50-50 at a young age. With that said, each case and county varies. The video is geared towards parents in Albuquerque/Bernalillo County/2nd Judicial District Court. Also, the court will almost always approve 50-50 by stipulation. I was wrongfully and unlawfully dragged through family for 2 years with unnecessary and prejudice adjournments. Trial scheduling judge Justice Martha Tweedie needs to be removed. She filled out the applicants TSEF which parties are to fill out, not a judge Rule 17(11) Then Trial Judge Justice Michael Gibson conducted the rigged trial. Applicant admits to paying $7900 on unsigned commissioned document, then asks the judge for $160,000 then is awarded $60,000 absolutely BS what I had to deal with. I want go public about my experience with this crooked family court

aside from the 2nd amendment discussion, i am not getting into that one. from a logistical position. what does someone to gets a restraining order agents them do with there guns? how do they get the guns bask when the order is lifted?
Here's the standard language in restraining orders about the restrictions on guns: As a result of this order, it is unlawful for you to possess or purchase ammunition or a firearm, including a rifle, pistol or revolver, under 18 U.S.C. Section 922(g)(8) and NMSA 1978, Section 30-7-16, and may be unlawful under 18 U.S.C. Section 921(a)(32). If you have any questions whether federal law makes it illegal for you to possess or purchase a firearm, you should consult an attorney. According to Black's Law Dictionary --> POSSESS means to have physical possession or otherwise to exercise dominion or control over tangible property.

So like, does it nean that if party A files a restraining order against party B then B cannot own a gun while it is in effect? If so that could be amazing for people escaping from domestic violence and that could partially relieve some stress which is nice. IK people will always commit crimes if they intend to but that's seriously monumental. I can see how people on both sides have their pros and cons but honestly in my opinion, this is huge and it makes me happy for those in really awful situations whi need that reassurance.
The gun restriction only applies to those that have a restraining order of protection entered against them. In other words, filing a restraining order does not impact gun rights. The law is to protect victims -- not to burden victims.

I know many people that would agree with your sentiment. Also, I've personally seen some cases where "victims" use the restraining order process to seek revenge and take away gun rights.
for anyone curious, this ban is for people who have DOMESTIC VIOLENCE RESTRAINING ORDERS PLACED ON THEM. MEANING THEY ARE THE GUILTY PARTY WHO MIGHT HURT THE PERSON WHO PLACED THE RESTRAINING ORDER. this is to PROTECT people whose lives are threatened by abusive people in their lives they need to escape from. This is a good thing that prevents innocent people, especially women in domestic violence situations, from losing their lives if they successfully get away from their abusers!

This is a great topic. And if you are in a situation where the other parent moves out-of-state without your permission, you need to take immediate action to stop that. You can't wait 6 months and then say it's wrong.

How about if you have a 5 year protection order where it lists my daughter as the protected party in addition to myself, my exbf isn't allowed custody nor visitation per DV140. Additionally, he violated that 5 year protection order, and the criminal court granted a 10 year protection order where he isn't allowed safe exchanges. Would he ever get visitation or custody if he completes a 52-week Batterer Intervention Program? He is on felony probation as well with a GPS monitor on his ankle.

From Deming new mexico mother takes boys to visit grandma, grandma 78 years old and on a pace maker gets literally beat up , by daughter, daughter pleads guilty to battery on a household member sentencing day comes mother gets kids and disappears to Texas with kids this happens in November 2023 till this day haven't seen or talked to my boys district court judge grants me sole custody of my boys local police sheriff's and state police tell me there not helping me recover my boys

NM Divorce courts people don't even get a judge - hearing officers and they don't really give a crap - divorce is the ending of a business arrangement treat it as such, deal between each other and move on.
Preach! With that said, most divorce cases are heard by a judge. The exception happens when both parties are pro se (not represented by an attorney). When both sides are unrepresented, a Hearing Officer generally handles the issues. But in either scenario, your case is basically on a conveyor belt with other cases. The Judge or Hearing Officer takes your order/issue -- issues an order -- and then moves along to the next case. So, in some respects divorce court is kinda like Taco Bell. The family court system in Alabama is a disgrace fathers should have just as much of a right to their children as the mother, it’s their children too. To rape a father financially to the point he can’t appeal his case is despicable. The mothers get everything free while fathers sometimes are forced to live in their cars to get more than every other weekend with their own kids.
