Hi there, on the Smith V Hughes, if the word ‘street’ was the point that to be fixed, why didn't they interprete this word for a boarder meaning (golden rule) rather than using mischief rule for the original intension? How to determine which one is more suitable? Thanks
The Purposeful Approach pertains to the intention, and intention is in the jurisdiction of Equity. Lord Denning was a Chancellor. The Golden Rule likewise has an equitable base.
This lecturer has made mistakes and errors on her lecture. Firstly in regards to solicitors. They are NOT I repeat are NOT given the title of soclitors until they finish 2 year training contract . This is in marked difference to those who pass the bar in which they are given the title barrister. However they cannot practise untill they have completed the pupuilage stage. Good grief they should only have academics or professional lawyers teach A level. Who is this women she a terrible lecturer full of half truths. What would I know; I'm a student barrister x
You have helped me so much..I was hoping to see Purpose Approach as it is quite big here in New Zealand but thats ok..please keep your videos cominggggg 😘😘😘
