Dear Thomas, the penalty is indirect as government and corporate business will not be possible. Fronting, however carries criminal sanction.

The biological children will have to prove biological relation to the deceased. Then would have recourse against the estate. All children will have equal rights once biological relation or birth certificate indicates the parental connection with the deceased.

It would depend on the status of the adoption. Adopted children have the same status as biological children.

@@TheResoluteEntrepreneur we were foster not adopted only but we have lived with the deseased for 18 years, the problem is the property was not written to anyone.... My foster mother has no will just a pension fund. Does your statement above apply to us as foster kids? We don't know what to do with the house and other family members are vandalizing the property. please I need advice

You said when the value that z left by the testator is less than 250 000 rand, then only the spouse inherits and the rest of the descendants inherit nothing?? Is that fair? Is it consistent with the constitution?

@@prosperitytheprideofherpeo244 Unfortunately that is how the law currently stands. Heirs are able to challenge this though and should seek legal representation / assistance in order to do so.
