In the 1974 case Lau v. Nichols, the U.S. Supreme Court ruled that schools must take steps to ensure that English language learners (ELL) can participate in their educational programs. The court's decision was based on the following:   Equal education The court ruled that providing students with the same facilities, textbooks, teachers, and curriculum was not enough to ensure equal treatment.  Legal discrimination The court ruled that failing to provide language support to ELL students was legal discrimination.  Civil Rights Act The court ruled that the school district's failure to ensure ELL students could overcome linguistic barriers was not in compliance with the Civil Rights Act. Language barriers The court ruled that students who don't understand English are effectively foreclosed from any meaningful education.  Additional instruction The court ruled that schools must take steps to ensure that ELL students can fully understand what is being taught in their classrooms, whether through additional instruction or bilingual education.
