I'm a forager and there are some trees like pine and willow I would like to forage from. So do you know if I snap a branch off a tree on open access land?
Not really good practise and in the U.K it would be frowned upon. Also impossible for you to know if the tree is protected or not without a desktop study.
@@roavrenvironmental6880 But if it doesn't have a preservation order it is legal then right? because quite frankly i'm fed up with this country because most the laws of the land are not clear cut anyway. For instance I went on Gov.uk, and it said to Fell trees a licence is not required on "churchyards and public open space" ok we all know what a church yard is, but how can one define a public open space? it's absolutely ridiculous there even stating such a thing without clear definition on our so called great goverment website. Hence I don't care what is frowned upon by people as people frown upon me anyway. I only care exactly what the law is, and the trees well being: ie harm is not caused

what about a big oak tree in my garden with a TPO - its massive, blocks light and the branches fall every summer so it is dangerous - any advice
Hiya, impossible to say without a tree safety survey. Blocking light is not a sufficient reason to remove a TPO protected tree but there maybe some pruning that can be carried out that would improve things and not harm the tree like crown lifting and light thinning. With regard to branch drop, what sort of size branches? It’s normal for small pieces of deadwood to be shed.

@@revp5004 Amenity trees are any that are not grown or managed for their value as a timber or other crop and that provide other benefits or values (Cullen, Citation2007). Examples include trees found in parks and other open spaces, or lining the sides of streets, railways, rivers and canals and in gardens.

Never thought I would have to research this subject, as I have just been told they are plans afoot to remove a tree outside my window, needless to say I am livid and upset so now I'm going to have to research the legal ramifications as I wholeheartedly believe this removal to be unnecessary and profit morivated
Hi, I've just been slapped with a TPO for 6 of my trees after applying for conservation area consent for trimming. This is after 25 years of getting work consent under conservation area protection. It includes a leaning Scots pine 25m high which I had consent to remove 6 years ago. Only 1 tree is visible from the public highway. All the others are on a party boundary with just one other owner. Seems to me there has been a big change in policy.
Hi Dave, essentially it comes down to the perceived ‘amenity value’. There are quite stringent Government guidelines on how and when a Tree Preservation Order can be made. It should not stop you applying for and carrying out reasonable and certainly safety related pruning works.

What about TPO's on Fruit/Apple Trees are they valid?
You'll only really know through contact with your local planning authority. Not all publish their TPO schedules online.
Hi mate very helpful vid. Can I just ask, if a tree is in a conservation area but doesn't specifically show on the map that it has a tpo, do I still treat that tree as if it has a tpo and apply as if it has a tpo? Cheers Terry
Hi Terry, it depends what you are looking to do. If you are looking to get work done on the tree then your local tree surgeon should manage the process for you. If it is in relation to a planning application then your chosen arboricultural consultant would normally check directly with the local planning authority for you. These online mapping systems are great but not totally infallible. If you turn off the ‘Conservation Area’ layer then you should see any TPO trees or areas below. Feel free to get in touch and we can check for you. - Paul.
What about the value to wildlife habitat? Does that get considered by the LPA in deciding on a TPO?
It can be a contributing factor in area TPOs. An individual TPO is more about landscape and amenity value.
