According to the Hindu Succession Act 1956, if an unmarried Hindu male dies, Section 8 says Class 1 legal heir is mother. But in the legal heir certificate issued by the Tamil Nadu government, the siblings are also included. Isn't this against the Hindu Succession Act?

My father in law died without will of one property. He had one son and two daughters. All died. The elder daughter died after death of her husband and has no son/daughter. Son died without son/daughter. But his wife survives. The second daughter died leaving legal heirs of husband and three children. Now who had rights on the property in what share.

Hello Madam, Please can you help me with the case listed below. Christian Man (M) marries Christian woman (W1) and they get a kid (W1-Kid). Without divorcing W1, M unlawfully marry another Christian woman (W2) and get a kid (W2-Kid) out of this wedlock. M executes a sale deed (Deed-1) in favor of W2 & W2-Kid equally to transfer a portion of his self acquire and ancestral property. 20 years after executing the Deed-1, W2 dies intestate. 4 years after the demise of W2, W2-Kid dies intestate. W2-Kid was unmarried. 5 years after the demise of W2-Kid, M dies with a will transferring the property mentioned in Deed-1 to W1-Kid. However, mother of W2 creates a legal heirship document and transfer the property mentioned in Deed-1 to another party as a gift. Based on the explanation that you have given, I assume the below to be true. As per Deed-1, W2 and W2-Kid have equal ownership on the property scheduled in the deed. After the demise of W2, M-Gets nothing as he is not legally widower (due to unlawful marriage). W2-Kid, as the only surviving lineal descendant, gets the full ownership (50% of property mentioned in Deed-1). So, with his own 50% and the share of his mother's, W2-Kid becomes the 100% owner of the property mentioned in Deed-1. After the demise of W2-Kid, as he was unmarried, the father becomes the sole and only legal heir of the property scheduled in Deed-1. So, the will given by M come into force after the demise of M and so W1-Kid is the owner of the property. Please suggest if my understanding is correct. Thank you in advance!

Hello Ma'am. The case is to transfer equity shares of deceased husband from stock broker to successor. Successor has 2 children. One is adult,other is minor. Whether court issues order to retain 1/3 of shares with broker till minor legal heir turns 18. Please reply.

If so isn't it unfair and unjust ? 2) What is succession rule when deceased male survived by wife adopted daughter and mother as per ISA 1925 ? 3) Does a mother of deceased Indian Christian come under the criteria of lineal descendent or kindred? 4) Is the mother of Indian Christian a class 1 legal heir or class 2 legal heir or class 3 legal heir ? 5) the verdict in Pauline vs Agnes appeal suit in Chennai high court has verdictum that says mother is not a legal heir when deceased survived by wife and children substantiate your opinion?
