So, the obvious question is what to do if your vehicle, when made, never had a third taillight, but you were pulled over because the cop did;'t see one. Do you point it out on the roadside, or wait for court? Or Both. If a lack of twilight was the reason for the stop and you didn't have to have one, is the stop itself invalidated once this is pointed out to the cop? Lots of classic cars and trucks, pre-date the 3rd taillight law.

Are you talking about a refusal on the road side, or a refusal to take the better, more accurate BAC at the station house? It seems like you should be able to say no to all roadside tests, while saying yes you will take the more accurate test at the station.

You should talk more about when the statute of limitations runs or tolls and when it doesn't. For example: If a person steals some money from their employer but the theft is not discovered by the business for three years, in most states those years don't count toward the statute. It is only when the crime is discovered or known, that the statute begins to run. And, in sex crimes, particularly against children, many states have a whole other set of rules. You might also talk about WHY society has statute of limitations to begin with. Shouldn't a person who committed a crime be punished no matter how long it had been? In Ohio, in general, it is (a) For a felony, six years;. (b) For a misdemeanor other than a minor misdemeanor, two years;. (c) For a minor misdemeanor, six months. BUT, there are a whole slew of exceptions for homicide, sex offenses, and other select crimes.

How does it work if you have a dwls 3 but was unaware of it being suspended because you had a out of state license. Like I reside in wa but had an az license.

I received a DUI in 2013 in Illinois when I was 22 years old. I had previously had two underage drinking tickets as well and I was honest with my evaluator getting the median amount of hours needed for classes. I completed my community service but due to how messy my life was at the time I was unable to complete the classes I continued going to court over this for years and in 2018 ended up moving to another state resulting in my court supervision being revoked and being charged with the DUI and license revoked. 11 years later I'm trying to resolve this case and have a new evaluation coming up via tele-heath going thru an approved Illinois treatment center online. I lost my mother in 2014 to a drunk driver and have not had a drink since then. I'm nervous for the upcoming evaluation and worried i might say the wrong thing. Any advice?

I would think a pda is a way out for the DA. They have no case but dont want to lose and in most cases theyre willing to drop it before the trial...am i wrong?

So if a police officer tries to pull over a driver for reckless driving and the driver drives off at a high rate of speed and gets away but the cop gets the license plate will he just try to charge the registered owner of the car ? Or will no charges be filed due to no arrest

The Driver license law is unconstitutional - Any RIGHT that the Constitution gives to the people can not be taxed, fees attached or any law concerning that right.. Laws are made ONLY by Congress not Highway Departments. The same with tags on a vehicle - unconstitutional - If the people stand up for their Constitutional rights, we'd put a stop to these corrupt laws and CORRUPT property tax laws as well.. 5th Amendment gives a God given right to own land.. Anything that is a right CAN NOT be taxed or fees attached etc. When the people were duped into trusting these tyrants as honest people to help fund "public schools and highways" etc., this is what we get when Marxists gain control.. In our state up until 1979-81 we had assessors and any tax increase the people voted on - Yes or No to allow or not.. When the Marxists gained control they used our tax dollars to hire outside of state people to come in to reevaluate, (to protect the assessors) and then set up a land management which is unconstitutional. Then the state installed NON-Elected officials in the court houses all across the state along with the assessor.. NOW in 1991 when the Marxists were in control again, they passed a bill where the assessor can just pull numbers out of the air to increase the tax.. I'm wondering why some millionaires across the state doesn't start pushing a petition to BAN all property and land tax.. We the people have ALL the Inherent Power in the US and my state's Constitutions; not the public slaves, that includes these dirty judges and prosecutors.. Article VI - "The Constitution is the supreme law of the land" - ".... .. any legislation contrary to the Constitution is NOT Valid" .. Public slaves are bound by the Constitution to uphold same.

one of the most important things about an alcohol evaluation is you have the constitutional right to privacy. and no one can violate the 4th 6th or 1st. so when they ask you your name you say? nothing when they ask you if you like to drink you ask them yah i love water dont you? when they ask you how much did you blow? lol this one is simple as a man i jsut say i never give blow jobs do you? in all cases you never have to answer any question. EVER

if they you ask you what you blew? say i dont do blow jobs do you? again never answer any question
