Same way you would do as a Realtor - but we advise to go to a firm that does specialize in Locating if possible!

Hi if I got my license in NY and I work under a brokerage company if I want to also do locating in Georgia can I still do so if my license is under a NY brokerage how will I get the commission ?
@@brittneycarter7751 It is better to get your real estate license in both states regardless of any loopholes. It makes your operations easier on many levels.

I agree the brokerage i was with wanted me to sell and i was more interested in the rental side. Looking for a new brokerage that specializes in leasing now.
Disclaimer: IANAL. Don't get your legal advice from random people on the internet. That includes me. This is not a new law or regulation. It is a lawsuit settlement agreement that NAR (and a number of large brokerages) entered into. If you are not a member of NAR or one of those brokerages or a member of an MLS that is affiliated with NAR, none of this DIRECTLY affects you. If you work for a broker who has implemented policy changes due to this settlement, you have to abide by your broker's policies. If you don't like your broker's policies, you have a couple of choices. Talk with your broker and see if you can work something out more to your liking. Or seek out a different broker who is more compatible with your preferences. My takeaway from these lawsuits & settlement for locators is to seriously reconsider actively promoting your services as "free" to the client. You can quibble about who pays what & how until your blue in the face. But the bottom line is that specific complaint was one of the major wedge issues that drove these lawsuits forward. Whether you agree with that or not isn't going to matter to the plaintiff's attorneys out there looking to sue anybody with deep enough pockets to score a payday.
Okay this person is likely asking this because it ISSSS a requirement under their brokerage. My broker has requested this of me and I’m just getting into locating. How do you suggest we navigate if they are requesting this? Should we just switch brokerages? I can still buy and sell homes and still would like to.

@@6BlackWings It’s public information and a very basic lesson every license holder should know. NAR is not a government body it is a private, non-profit trade association. Most Locators do not abide by NAR rules because we dont need the Realtor trademark or access to the MLS tool. So nothing to worry about. A simple Google search or asking ChatGPT will result in the exact same truth im telling you
@@apartmentlocating I don't disagree with you at all, actually. I just hear a lot of conflicting information from various brokers. I have yet to see anything written anywhere though. Only people giving their interpretation. I don't understand by which mechanism the settlement could apply to a non NAR member not working in the MLS, but multiple brokers I've spoken to claim differently.

@@6BlackWings Nothing in the settlement is legally binding on non-members. What it is, is a "pseudo-precedent" for future lawsuits. There's blood in the water now, so there are going to no shortage of plaintiffs attorneys looking for excuses to sue anybody with deep enough pockets to score a payday. Your E&O policy is a "deep pocket" even if you personally are not.

How are you handling the changes taking effect on August 17th due to the NAR lawsuit? Many brokerages now require agents in the locating business to implement a buyer/tenant representation agreement. This means locators must disclose their compensation before setting up tours, and customers must sign a document agreeing to pay the commission if the complex doesn't cover it. Additionally, an addendum must be sent to the complex to secure agreement on the compensation before invoicing. This seems like a significant issue for both locators and customers. How do you think these new rules will affect the industry?
The new NAR ruling means absolutely nothing to the locating industry. NAR is a privately managed entity. Locators are not NAR members. They are real estate agents. What you outlined are not real requirements. They could potentially be requirements if the Locator is sponsored under a NAR brokerage and the broker is making the agent follow their specific rules. But even if that were the case, NAR isn't actually making Locators do anything, they don't know our niche exists. P.S. Disclosing Locator compensation isn't really doable because it varies greatly and is always paid for by the property not the principle in Locating. Also the part where you are referring to an addendum being sent to a complex to secure agreement on compensation before invoicing, flat out isn't true and is not the case at all. To keep things less confusing, just understand that NAR has no say in the real estate agent/Locator realm of things. Its targeted to agents and firms that want to be a part of NAR, and local boards (MLS) and call themselves a trademarked Realtor. So in other words, all is well and the same in our niche! Especially if you choose a non-NAR brokerage firm that specializes in Locating. How cool is that? Learn more on our website: nal.rent
@apartmentlocating That's what I suspect as well. The brokerage at the center of my remarks is Central Metro Realty. They require ALL their agents to join NAR even if all they do is apartment locating. It seems likely many will leave and connect with another broker in town who doesn't require agents to be a member. Presenting forms are one thing, making invoicing contingent upon apartment complex leasing office managers following through with an extra document is another. Getting them to return a phone call is hard enough sometimes lol
@@yeahaboutthatthough3656 oh thats a shame, I know the owner and manager personally. That is probably because their designated broker is a part of NAR. Which requires all agents to be. There are ways around that however.
@@apartmentlocating Now that's something I didn't realize. But it makes sense if a broker is a part of NAR, that they might require their agents to join. And in light of the lawsuit, to avoid liability, they will want everyone to just be on board with the new requirements. What kind of work arounds do you foresee?

Is it possible to get into apartment locating at the age of 16? I heard you need a license. Do you think they're are property owners that may work with unlicensed locators?
If there is a strong will there is a way. Yes its possible. Also in Denver Colorado you don't need a license, then just keep your age to yourself.

If you buying condominium, the association should have at 10% reserved or else the grant will be declined. I’m not sure if the bank really wants to help or just get you into their loan and make money out of it. Not sure, btw mostly this thing happens when you’re on closing.

I'm not in the apartment space but I am looking for auto CL posting...when we talk of CL flagging large quantities of posts...is that for each person or by the type of post? For example, if I wanted to post roofing, plumbing and pest control posts...could I do like 4/day each or would it be a total of 4 per day?
