    Trust and believe that making your probation officer's job as hassle free regarding your case is PARAMOUNT. Most have huge caseloads and are probably underpaid, so they are already skeptical that you will complete your terms. They deal in deception and headaches all day from their case load. Like any field of endeavor or place of employment. They are good, bad, or indifferent. Granted, there are some who could care less how respectful and diligent you are will still be cranky and oblivious to you and just need one slip up to violate you. Others may be to the letter and very obsessive compulsive in their duties. While others somewhere in between. AGAIN AT NAUSEUM. DO YOUR TASKS AND YOU WILL REMAIN OFF YOUR PROBATION OFFICER'S RADAR. THEY WEILD EMENSE POWER REGARDING YOUR FREEDOM. In the end, do your required probation checklist. If possible, be preemptive in payments or appointments. A million years ago, I was on unsupervised probation for a year. My only requirement was to pay $50 a month. I saved every payment receipt, and my probation officer honestly had no idea who i was because we only met once. She was a bit edgy, hostile, and guarded. On my last payment, she walked me into the courtroom and officially ended my case. She shook my hand and said , " Nice to have an easy case. Then, she walked into the hallway and yelled and threatened a guy with violations. The end.

    Not all clients should plead out. I'm a private criminal defense attorney and have done at least 10 jury trials this year, including in district, superior, and federal courts.

    I have a labor case at the EEOC I contacted and attorney who heard me and said he would change me a 1.000 retainer fee and 1/3 contigency. I agreed, sent the retainer, and then got a contact that says: 1. Scope of Representation: The attorneys will investigate, evaluate, and negotiate claims related to your employment case Excluded Services: Litigation (filing a lawsuit), unless further terms are agreed upon later. Workers’ compensation, criminal law, tax law, corporate law, or securities law. Defense against claims by your former employer unless a separate agreement. 2. Costs: Responsibility: You are responsible for all out-of-pocket expenses, reimbursable within 30 days of invoice receipt, regardless of case outcome. Examples of costs include photocopying, document processing, and investigator fees (with prior consent). Lien Clause: Any unpaid costs may be deducted from recovered amounts. 3. Investigation Fee: A one-time $1,000 fee has been paid for the attorneys’ initial investigation and evaluation of your claims. 4. Attorney Fees: Contingency Basis: Pre-litigation settlement: 33.33% of recovery. Post-litigation filing: 40% of recovery. Hourly Rate: Attorney charges $590/hour, subject to an annual 5% increase starting January 1, 2025. Fees apply to the gross value of all recoveries, including reinstatement, damages, fringe benefits, and attorneys’ fees. 5. Calculation of Fees: Reinstatement: Quantified as 33.33% of one year’s total compensation, discounted at 6% for present value. Fringe Benefits: Calculated as annual premiums discounted at 6%. Attorneys cannot claim both reinstatement and relocation fees; only the higher of the two applies. 6. Client Obligations: Provide truthful information, cooperate fully, respond to requests, and keep attorneys updated with your contact information. Participate in legal processes (e.g., depositions or trials) as required. 7. Lien: A lien is placed on all recoveries for payment of fees and costs. You also assign any claims for attorneys’ fees to the Law Office. 8. Termination: Attorneys may terminate the agreement if you fail to cooperate or pay costs, or if continued representation is deemed unethical or impractical. Any unpaid fees or costs remain a lien on future recoveries. 9. Consent and Power of Attorney: You grant Law Office power of attorney to execute claims, pleadings, and handle checks or drafts related to the case. My question is: Contingency Fees vs. Hourly Rates: While the agreement is largely contingency-based, hourly fees may also apply How these fees, interact in scenarios such as partial settlements ? Cost Reimbursement: Even if I win or lose the case, am I responsible for reimbursing all incurred costs? Lien Implications: Cn the lien can complicate future legal representation if I switch attorneys, is it binding to recoveries. From what I understand, it is a contigency fee but with billable hours and expenses CHARGED to me , plus 1/3 of the results ( probably a settlement) not billable to the otherpart or the end of the case? Is it 1/3 plus expenses and hourly fee? I am very confused!

    I live in Massachusetts and I was sued by a plaintiff who owns a law firm. The plaintiff is suing my startup company, even though I never had a contract with him through my business. Never received court notice and as a result, didn’t appear in court so a default judgment was entered against me. I file a motion to remove the default and went in to court on that day as well as the plaintiff. The magistrate judge originally stated that I had a good enough reason why I missed so therefore he’d grant me the motion. But then he told the plaintiff unless he oppose. At that time, plaintiff stated that it’s not his fault that I didn’t receive the notice and that he came in to court and I didn’t. And all like that, the magistrate judge then decides to deny my motion. I tried to appeal the judgement and filed a notice of appeal with the lower court. They told me that they’d submit the information to appellate court. I go to appellate court and they informed me that I have to start the appeal at the lower first before it gets taken up to them. So I go back to the lower court and told them the appellate court sent me here. The clerk then tells me that I cannot appeal the judgment and that I can only appeal the denied motion. So I filed another notice of appeal to do exactly that and called the appellate court while I was in the lower court’s clerk office. The clerk at the appellate court told me that it was fine. Two days later, I get a call from the appellate court clerk and she told me that I couldn’t appeal. I asked why. And she just said that I just can’t. I go back and filed a motion to set aside the judgment and attached affidavit. I have text message correspondence with the plaintiff where he stated that the carpet he paid me (personally) to move for him did not worth much and that it’s no more than $500 in value, but yet in his claim he stated that he bought it for $1,800 and is suing me for $2,000, which I don’t agree with. The explained to the judge that not only did the plaintiff never booked me through my company, he also never purchased insurance. And I explained that in Massachusetts, all movers are required to provide what’s called “released value,” which is basic cargo insurance set by the state at $0.60 per pounds. And that the plaintiff would only be entitled to $60 because the carpet doesn’t weigh no more than 100 pounds. The judge denied my motion and stated that I didn’t have meritorious defense. I asked why don’t I? He stated that I picked up the carpet and never delivered it. I asked the judge, how could I deliver something when I never got an address for? He got upset and treated to arrest me. I asked why would I get arrested and he stated that it’s because I was talking back to him. I believe that the judge is being bias and prejudice. The plaintiff owns a law firm in the jurisdiction and they’re all acquaintances of each other. I’m not getting a fair chance to defend myself. What do you suggest that I do next? File a motion for appellate review based on 27.1? File a motion to recuse the judge for bias and prejudice ruling? File a motion and request a change of venue? Or can I still appeal the denial of my motion and/default judgment? Any information would be greatly appreciated. Thank you

      Correction: two days later I got a call from the lower court clerk that told me that I couldn’t appeal, not the appellate court. The judge panel after I left the courtroom that day called the clerks office while I was making my way down there and told the clerk to instruct me as to what I need to do. And that was to file a notice of appeal for the denied motion. And two days later, the lower court’s clerk calls me to tell me that I couldn’t. After they were instructed by the judge and that they told me that I could

    This video is a bit misleading as it is making people in the comments feel as though they don’t need the book. The information in this video is coming from a bar certified lawyer someone who has used the book in their past and no longer needs it so in the comments, my message to you is unless you are a professional at your legal proceedings and filings, and all of the paperwork related to the courts this book is detrimental to your knowledge and career and this video was made by someone who passed the bar so take his disuse of the book with a grain of salt because he does have the book and it was a reference to him at some point in his learning. He simply stating that he personally has not had to revisit the book and mastered the submission of his motions and other styles in court proceedings and process. I am not in law school i’m simply studying the law to be more educated on it and one of the most fascinating things is the paperwork how to write and read in legalese.

    Deberry vs US. The court ruled that the mere presence of a legally carried firearm does not constitute PC or RAS. Simmons vs US. The court ruled that exercising a constitutional right cannot be converted into a crime. JL vs. Florida and Alabama vs White. The court ruled that police need reasonable articulable suspicion of a crime to detain, search, and demand ID.

      Question: if the person does have a firearm, can they legally ask you for a concealed carry license (assuming it's a firearm that can be hidden away vs strapping a rifle on the shoulder) without PC to verify if you are indeed carrying legally?

      @ryanbroos5143 Absent reasonable articulable suspicion of a crime they can approach and ask you, but you can decline exercising your Constitutional rights. That should be the end of the encounter, but unfortunately, they don't like being told no and will often escalate anyway. Then you have to decide how far you want to go before you end up arrested.

    In the land of the free, you should be able to carry drugs. Guns, or anything else provided you don’t use them on anyone. The other day I saw a woman who was begging for money for some gas. She filled up her can, walked inside, and threw it on the clerk. I don’t think the clerk made it. The video is on TH-cam Just about anything can be made into a deadly weapon. We shouldn’t lose our freedom because some people can’t handle their guns, alcohol, or drugs

    Oh look...another dumb ass lawyer. No, we hate you b/c you will suck a judge $^&% even violating Constitutional rights, and won't report them to JEC b/c your practice might get hurt. You will sit there and collect your fee even if judge says, "In my courtroom, 2+2=fish". Yea, we can take it to appeal....and that's another few thousand more in your pocket. Your profession has no integrity, no courage, and is the only profession where you have to pay kickbacks to a 3rd party PRIVATE company to work. My attorney if you loose your case in court then you have your other side attorneys fee. She told me, it would be around 500k. Is that true ? Please advice
