Look, let's be real here! It's not as much ageism as it is "looksism." If you have enough money for cosmetic surgery and procedures and if you still dye your hair and don't have gray hair, you might be OK. This is just BS. Especially when it comes to older women with gray hair. It all boils down to the interviewer looking at your face and not liking what they see. We live in a very vanity focused world and it boils down to that one person doing the interviewing, not the company. And the absolutely crazy thing about it is you still have to work until at least 62, which is quite difficult in this highly vain and ignorant world. And of course I refer to termination as well as the hiring practice in my comments.

I severely suffered Corporate retaliation because I was reported as a Whistleblower of illegal conduct, Wage/Commission Fraud, etc. What is strange, my prior Atty Little never classified it as "illegal conduct;" but conspired and covered it up Conflict of Interest.
Atty Little tookbit upon himself intentionally omitted charges, Suppressed and Spoilated Evidence, Altered Consultation notes, dismissed multiple claims without my knowledge, oral/ written authorization, nor consent.

Daniel Nance and Affiliates also the False Accusations Defrauded Commission and Trump up charges, etc. Daniel Nance coerced me to comply with Blyth and Monica to resign since they had racial discriminated, retailiated and threatened me. Not to exclude Whistle Blower Evidence of fraud. What I had provided to Atty Kevin Little had already been viewed and rejected by EEOC'S Investigator Daniel Nance and Affiliates. This is information that Kevin Little learned from me, that is why in was confident in his Malfeasance Malpractices, Conflict of Interest-Self Gain and Solicited business with Polo Ralph Lauren.
My attorney , Kevin Little never allowed me to review, confirm, nor correct Perjury Statements False Claims in his drafting "See Attachment A", I was not aware of the charges ommitted or not amended😂, evidence 🧾 🧾 🧾 suppressed, and misconstrues narrative in the Title VII Charges Affidavit, Retaliations Hostile Work Environment, and Fraud Whistle Blower Charges file and fraudulent noterized and dated 04/10/2006 vs on or around 04/06/2006 for what I orally stated and provided during Consultation and oral Attorney-Client Engagement. In good faith I documented and provided with direct and relevant evidence 📄 📄 in 1st of 2 requested Chronological Timelines that Atty Little also suppressed and spoilated. But I believe he shared with Atty Amada Costello and Ben Aston before he filed his Perjury and Subordinate Perjuy False Claim Charge "Age Discriminated." Material Fact, Atty Little did not provide a copy of his false narrative "See Attachments A" until email of his release Client File. 🗃️ Even then, he did not explain it, when it was submitted to EEOC because it had no date nor signature. I can't understand why EEOC Daniel Nance permitted nor accepted it. Daniel Nance and intake Affiliates already had knowledge and personallly spoken to me, reviewed Blythe's Racial Slurs Discriminated, Disability Discriminated, Whistle Blower Wage and Commission Fraud Schemes. Both Daniel Nance and Intake Investigation igators interviewed me, analized my direct evidence, and rejected me and my Racial and Disability Direct Evidence on 3 different accounts and criminal Denied me the right to file Title VII Charges and Retaliation and Whistle Blower False Claims, etc.
Atty Kevin Little, EEOC Daniel Nance/Kimbro and PRL in-house EEO Amada Costello/Ben Aston and PRL CEO Andy Romeo, and HR Sarah Bolton colluded and conspiredalfeasance to pervert the course of Justice and flout due process, etc.

If issued a Right to Sue letter is tbe case only allowed to be based off of tbe investigation, or are you allowed to bring forth everything that has ever happened at the place of employment? An example is three people were hurt on the job at different times. They reported it and all was good; however I have a preexisting condition and due to weight of my backpack due to classes and overworking the core due to everyday tasks I had began hurting and they heard my preexisting condition from two doctors. I was released with zero restrictions the same day and terminated. The reason termination was I did not tell tbe my back popped. Now, would that be all I could use in court, or could I use everything at that point going against the employer?

I also earned a BFA in Graphic Design at the age of 54 and here it is over a year later, and not one interview granted. I will be fighting these school loans. My school knew I would not be hired in this field and yet they drew me in with promise of job after graduation.

This schedule slot showed no available time to book. In such a case, what is the recourse, and how will the time count for my case? The claim was lodged in the Dallas office, and they seem to have no time available from now until the end of the year. That's all the online calendar displays.

There may be state or local laws that apply but federal age discrimination laws only apply in the employment context and only protect employees who are over 40.

Can you ask for punitive damages during mediation
Mediations are more about negotiations for a set amount of $. The parties are trying to reach a compromise agreement rather than to "win" per se. Typically there is not discussion about punitive damages. Also there is no one to issue a decision or award (unlike in an arbitration), so the idea of punitive damages doesn't really fit within the process. Hope this helps.

Unfortunately, I was fired for being visually impaired and not receiving my accommodations, therefore making errors! I filed with the EEOC and received right to sue letter but the company that was helping me file, resubmitted a rebuttal after receiving the EEOC determination. Never telling me that the 90 days wouldn’t start over, I lost my right to sue!!! Are there any other ways to sue the company? Can I appeal and take it to a court?
You have recourse through a parallel state statute. These vary from state to state so I wound suggest you consult with an employment law specialist in your state.

The EEOC is a joke. My discrimination charge was closed without being investigated. The Investgator did not retrieve a respondent statement from the Employer. What a nightmare 😡
Atty Kevin withheld and neglected to disclose this Mediation document to me. He only read to me over the phone around or after May 8, 2006. Even though Atty Kevin had RECEIVED EEOC intake Mary Scott' s Letter that offered the option to Mediate. Also, this form was NOT uploaded in my Client's File. This Self- incriminatory that Atty Little willfully committed Malfeasance Manipulated Malpractices, Obstructed Federal Interference, and Conflict of Interest etc.
I’m going to have to do some research here because she’s declared psychological warfare in the last 2 years of my 4 years of my employment. Since she arrived, I’ve been a target because I cannot accept her micromanaging, nitpicking, lack of helpful feedback, and yelling in front of guests. Coercion is Illegal It is illegal to make anybody participate in an experimental program such as "YOU MUST TAKE THE COVID SHOT OR YOU'RE DISMISSED" using coercion.

Federal employee cases are often very specialized because the federal government has its own system separate and apart from the normal court system.

By the way, I am looking for an employment attorney. My charge of discrimination is against Keller Williams Realty and their lawyers should have sent in their position statement to the investigator. My charge is for Retaliation, Harassment, Age and Disability discrimination. Do you have any time to speak with me? The investigator said that they are going to investigate, but they might not have to when they see all of the proof I have.
My Charge status has been on " Charge file" since April 2022. I thought the employer has 30 days to respond. Its now over 2 two months since then. Is it normal for a charge in this phase to take this long and to expect respondent statement before investigation phase?
LONG delays are not uncommon. You should not count on the EEOC taking quick or decisive action on its own.
