What is a Gebser Letter?
What is a Gebser letter? If bullying is serious enough that it creates “a hostile environment” - in other words, it is repeated, intentional, and impedes the child’s ability to access their education or affects their health (for example, by making them want to skip school or preventing them from using the bathroom) - and the school is aware of the bullying and doesn’t respond appropriately to stop it, this is considered a harassment violation. In this case, a parent may need to write a Gebser letter. Named after a 1998 Supreme Court ruling, a Gebser letter is a signal to the school that the child is being discriminated against by the school’s inattention to the issue. It is also the first step toward making a formal disability discrimination complaint with the OCR.

Hi, when you mention incentive #1 can be submitted twice, does it have to be all different classes both times under the same pathway?
If I have 37 hours for a recipient and 10 hrs of training time.. does that count as a 40+ hr week? Or is it different?
Do we have to take these classes ?
I have 2 kids that qualify for protective supervision (283hrs) per month. I’m I able to receive those hours as well? Is there an exemption for that?
I work 100 hours for 4 recipient, no one more than 40 hour, do i qualify for this program
I have a question. I have completed 14hrs, there is one more training in the pathway which is an hour long, which will complete my 15th hour. But I’ve been on the “waitlist” for days now. I’m doing self paced btw. Any suggestion how I can get the last 15th hour or should I just continue to wait for the training to become available?

I am super late to this. I think i missed out😢 is it over after September? I worked 40 hours for the last 6 months but i am barely about to register and do my 15 hours. Should i apply for the tier 1 incentive or can i skip straight to tier 3?

Amen! I would love a video on how we can advocate to change policies and remove these societal barriers. So much trauma is caused by these barriers creating lack of access to supports and services which leads to even worse outcomes than what the person with disabilities has to already overcome with their disability/s. Hi I need some assistance on a course I took through the 360 Learning app. Towards the last few steps it’s stating that I have completed the course but then there’s a tab that states the minimum time of 30 mins has not been reached. Please help. Thanks!
You have to go back and login and when you login you will be able to see the hours you spent on the course and once you complete the 30 mins you can submit the course
Hello, you'll need to go back into the course and spend more time watching the videos and engaging with the materials. You have to be in the course for a minimum amount of time for each course in order to get credit. This is because people were taking 10 minutes to zip through a course. So now it times you. I know a family with two special needs children. One with autism and the other with down syndrome. Both parents have only been able to work part time providing cleaning services and odds and ends work. Can both parents be providers for both children, one for each child perhaps? They are struggling with rent payment and costs of daily living. TIA

Hi. My father had an IHSS reassessment on 6/17/2024. His hours were increased and his notice of action was received on 7/24/2024 with a notice date of 7/19/2024. It shows on the Notice of Action an effective date for the increase of services is 8/01/2024. My question is, shouldn't his increase in services be effective back to the date of the reassessment which is 06/17/2024?

Thank you for sharing your knowledge! I became a provider and started working in July 2023; I received the Career Pathway Program email on July 8, 2024. However, I have 2 questions I am wondering if you could take the time to answer them for me. Q1: Is the 15 hours of training mandatory or I do it as needed? Q2: In the email, it says "Providers will need to complete their 15th hour under a specialized pathway on or before April 30, 2024, and work a minimum of 40 hours a month for their recipient from May to November in order to meet the eligibility requirements to submit the six (6) month incentive claim". I plan on moving in with my mother from another state. She already gets IHSS for my disabled adult brother. However, when I move in with her, I would like to have IHSS help me with my son who is severe with autism. My question is, would I be able to qualify with IHSS living with my mother while she receives IHSS for my disabled adult brother?
Hello, Yes, you can still qualify for IHSS for your son even if you move in with your mother, who already receives IHSS for your adult brother. Each individual in the household who qualifies for IHSS is assessed separately based on their own needs, so your son's eligibility for IHSS would be determined independently of your brother's situation. What about each parent for each child so if my oldest is 7 nonverbal autistic, severe, and has seizures so he gets protective supervision and has been getting since he’s been 4 I’m his provider (mom) but now my youngest who also has the same diagnosis as well as abnormal MRI and has PDA I want to apply for IHSS but have my bf who’s the father apply for the youngest and for protective supervision which his DR already fill out paper work approve he needs 24 supervision how does that affect my oldest hrs and my bfs full time job ?

Hi Anne, it's best to enter them one at a time because they won’t pay out the incentive payment until the training time is processed. The incentive must be entered separately. Hope this helps!

Hi Robert, training time is for the individual hours you spend in a class. Training incentives are the bonuses you get for hitting certain milestones. FYI you can earn incentive 1 with adult education classes but not incentives 2 or 3. Hope this helps!

Hi, I can’t entirely answer this without more details, but they should be doing assessments for the various services to determine what he needs. Hope this helps!
A provider being in-network for both private insurance and managed care-plan (aka Medi-Cal in California) is usually impossible. Providers in private insurance are not the same providers as in Medi-Cal or providers do not accept both private insurance and Medi-Cal insurance. That's usually the problem. What do you do if you have a co-pay fees or an unpaid balance from your private insurance? Can Medi-Cal pay for those fees if you're a low-income single parent? The service is psychiatry/psychological services covered by both private and managed care plans HOWEVER, almost always by different centers/providers. I haven't had any providers/center for psychiatry/psychological care that accept my private insurance and Medi-Cal. I have an old balance from when I had private insurance as a college student (co-pay or missed appointment fee) that I was billed for the week before graduating that I keep getting notices to pay. I've had Medi-Cal before being a college student and immediately after (my current state employment's insurance is no different than Medi-Cal). I cannot afford the three digit $$$ balance. What do I do before it goes to collections and it affects my credit score?

My son's school is now saying he is not eligible for special Ed and I get ihss and he gets SSI can I get protective supervision and do homeschool?
Hello, if you already have protective supervision then homeschooling shouldn’t impact whether or not it continues. Getting it in order to homeschool him is based on the specific PS eligibility criteria (undivided.io/resources/4).

Do These Incentives Count Against SSI? Or Are They Exempt From SSI?
Hello, I don’t know with certainty. The paychecks arrive from the same payor and are subject to the same tax and overtime rules as regular IHSS hours for live in providers (for example, the hours are pooled for the purpose of determining overtime), but SSI may have their own take on this, especially for the incentive bonuses as opposed to the training time.
