I have had my grandson since two weeks of age. He was placed in my care from CPS and released from the hospital straight to me because of drugs in his system. Both parents during drugs and homeless. Now, the mother wants him back. OCOK is working with the mother. The mother release from jail in Sept and now living with her mother. My grandson is 9 month and I have a final court in Jan 2025. The judge will determine if my grandson will stay with me or not. The judge requested for me to take F.P Training. I have CPR class left to complete. Whats my rights? We have a bond and I want the best for him. Im want him to be safe and protected. OCOK is rushing to closed case. The mother has a pattern of using drugs. This is her second child born with drugs(2022 & 2024) . OCOK told me the first cases she didnt handle and basically dont care about it. They will request for my grandson to live with his mother and other grandmother. Do I have any rights ? Is there's a chance for me to have once a month weekend visit, birthday and rotate holiday's?? I would like for him to grow up living with me but I understand I dont have rights. My son is still out on the streets. Please respond 🙏🏽

I'm in indiana this doesn't help me
My lawyer told me that parental alienation was a joke and laughed. After I lost all my parental rights I asked about my why my hit civil rights have just been ignored and forgotten and how I was unable to even have one word of defense in my side not a minute.
I am so appreciative of your information. I could never afford your firm but I benefitted from your information. Thank u so much. My son is on the spectrum.
Thanks so much for your feedback. Our firm strives to provide free legal resources and support to the Texas community whenever possible. We wish you and your son the best.

Hi there, thank you for your message. Sorry to hear you are going through this. We can help you. Can you email us at marketing@waltersgilbreath.com or text/call us at 713-804-8071?
It’s been two years and sadly my husband is starting to go deeper into depression (he already has PTSD from war). His ex wife has swayed their children into hating us, and our gut feeling is that we feel she has persuaded them to block our numbers. The ex broke up the family by cheating on him while at war… used the kids as leverage and even gotten remarried & divorced. There has to be a way to fix this but I’m just the new wife who wants to help him fight this. I feel my hands are tied behind my back and I hate seeing him go thru this… FYI she is LAPD (still new) and to put the children thru this (twin girls) to be without their dad (who did nothing wrong) is heartbreaking 💔 what do I do?

Thanks for the video. From what I’ve read here this should teach a lot of women not to move in with Men who don’t even see them as a wife just see them as a second mother.Who do everything for them and then some. My biggest mistake was not to marry my husband when he asked me to marry him the so-called Legal way.We did go down and sign papers back in the early 80s but now they said they can’t find the papers. He passed away in 2020 doing Covid. I live in Texas I have been denied by the Social Security Administration the lady was very rude from the beginning. She told me before we even did the application over the phone that I would be denied the lady at the SSA, the supervisor she said she was. I went to Legal Aid they haven’t helped at all. I like to know what my options are I will give you a call because I did a lot of years as a wife. if anything ever happened to my husband they would call me his wife. I hear some men say all a woman have to say is she was married.I asked you men this question what did you think people did before they came up with this Law with papers. When men and women moved into the same house they was husband and wife and they didn’t need papers.because they were real men back then.
I’m Prob Se In my court case, the petitioner has a lawyer. I have a custody order that the mother is trying to modify. During the pre trial hearing the judge said that only the dates after the custody will be discussed. After the pre trial hearing, I received a notice of oral Deposition. 2 questions. 1. If I live 3 hours away from the attorneys office, who pays for my travel to and from the office, to participate with the deposition? 2. For the Attorneys Deposition, do I have to answer questions asked that pertain to dates prior to the custody order?
We do everything for my granddaughter buy everything she needs we don't want to involve the court I don't want anything from the parents just my granddaughter
You shouldn't involve court. When the kids are older they will know what you put their mother through.
@@TCMMedicine So true I am mom, a widow at that with 2 kids, my late spouse's mom started harassing my younger son's babysitter, because the babysitter reported abuse from my late spouse mom when I was at work. This in turn caused me to lose my job because I have nobody to watch him while I work. She caused my household financial hardship. Then on top of that she had the audacity to put a summons on me for visitation rights after causing such a mess. I had to explain to my oldest son because it affected him as well. I am fighting this case, because she should not be around after what she caused, and she never even apologized for what she did. What she doesn't know is that because her actions I have had to negotiate with my job to get it back, I am doing this to care for my children and as a result we are relocating in the Midwest. I agree with your statement. When parents are doing their best and making sacrifices to love and care for their kids grandparents need to respect the boundaries and the household that is built on the foundation of the parents.
My granddaughter is 14 months old me and her grandpa has been keeping her since she was born my daughter works so we keep her and her dad's girlfriend picks her up on Fridays and keep her until Sunday everything was great and now they are arguing and they decided they are going to alternate weeks so that takes away my time this is devastating to me
I am sorry to hear you are going through that. We would be happy to get you set up for a consultation with an attorney to discuss your matter further. You can reach us at 713-804-8071.
How have we allowed Family "law" to grow to this outrageous extent. No where else in law can you "fall" into a contractual agreement. Legally there are required elements, that ALL must be present for a contract to exist.... 1. Capacity 2. Legality 3. Offer 4. Acceptance 5. Awareness 6. Consideration... 3-6 ARE NOT present as it pertains to so-called common law.
If my child turns 18 and has to repeat senior year do I still have to pay child support.
The parents are not always acting in the best interest of the child.
And I can’t afford an attorney. My ex committed fraud upon the court. He recently fled the state of Chicago and I had no clue where he and my son was! I tried to get an ex parte emergency custody but the TCC came and whispered something into the judges ear and I was denied being heard!
I’ve still never been heard. I’ll never have a fair hearing in this county!
I just had it happen to me. I’m in NC and have had sole legal and physical custody of my son for 14 months. Had to have an emergency procedure done and requested a continuance but found out that was denied. My ex who strangled me at 3/4 months pregnant, has charges and moved back to Chicago is a stranger to our son because of DV, among other things. He has autism, is 100 percent dependent on his parents they pay 100 percent of his bills and has no responsibilities. My son had medical issues and a feeding team here at UNC Chapel Hill. The judge allowed a hearing without me there. My ex lives in a 600 shaft ZERO BEDROOM One Bath condo! My ex lied of course, the judge issued a warrant to take a child stating that I didn’t comply with a previous court order which is not true. And then stated and she probably won’t comply with this order!!!! My son had been non verbal since November 7th the day he was taken from me and taken by a stranger and taken to Chicago. I still have never been heard! I think this judge had his mind made up about me it had nothing to do about my son. His father had never once supported his son in 14 months either! His mom even buys his groceries. My son is completely traumatized
Ex's husband got a promotion and shes trying to move to florida. I have geo restrictions to tarrant county only. Seems pretty simple that it would be shut down. But ny daughter really wants to move bc she likes beaches. But obviously the courts take more into consideration but im afraid the mom is grooming her in what to say to make it seem like she does not like living with me. What are her chances of getting the geo restrictions lifted

I’m currently going through court. The other side claiming it unconscionable when (he wrote it.) Then 7 years later, HE hires an attorney to write the postnup based off what he wrote. Crazy how one can claim now it’s unconscionable! Ever of hear of anything this crazy??
You’re a great guy. Thank you for helping me with my case
Thank you for your feedback! We will be sure to share your kind words with Ryan.
My aunt has primary custody with geographic restrictions I have extreme case of parent alienation she tells my daughter she car call me mom I that recorded well she has money for a attorney I don’t she just left to Colorado literally 2 states bc she flew to California then Colorado canceled my future visits to skip to another state I have proof all the flight information and it’s like I wonder what the judge will do it’s like she never gets in trouble for anything but we go to court next week for a modification he doesn’t know she left state could she lose rights for that

How much?
Diversity………..
This is a prime example of a LOW budget low IQ advice……..
18:00 ish: Why would a party in this circumstance get the burden to prove by “clear and convincing evidence,” when everything else in family court (including allegations of child sexual abuse) has a preponderance of evidence?
This is absolutely disingenuous. TROs can last years, when judges refuse to follow the law. Harris county is notorious for this (Judge Stadler comes to mind).
This is a very informative discussion, thank you for hosting and sharing with the public!
Yes depends on state.
Depends on state. Colorado, spouse due 50% of any increase in value of all assets.
ok so don't let your spouse invest in any property investments.
First
I understand that parents have rights, but the main responsibility is protecting them, but when they suddenly CUT OFF ALL communication from Grandmom who has been in her life since the day she was born and has formed a very loving close Bond with the now eight year old grandchild Violet) but is being emotionally neglected emotionally abused and is being forced to lie and being brainwashed and her father says the f word to her I think it's time grandma gets back in the picture who they cut out of her life in an instant! My granddaughter violet has been over here so many times, and she was able to sleep over on weekend's and we enjoyed every minute of it😢 and now out-of-the-blue in an instant her mother decided to just cut off all contact with Violet and it has been traumatic it is as if they are hiding something but putting all this blame on me that I have no idea where it's coming from❤. Her parents are destroying her and she is completely isolated from homeschooling and through the day being locked up in her house and even it nighttime in her bedroom her door is locked and she is full of anxiety and has to suffer every night by herself crying herself to sleep.
I am sorry to hear what they did to your granddaughter, I very feel you, because I have same case with my 4 yrs old grandson, he begged me to help him stay here with me, he didn't want to go with his mom and his mom's family 😢
I am so sorry to hear what you are going through. We are here to help. You can visit us at www.waltersgilbreath.com to learn more about our firm and schedule a consultation with one of our attorneys.
My daughter and Alanna dad was co-parenting for 14 months now and I get her Wednesday through Friday every week now they are arguing now I'm going to be losing my time with my granddaughter they are going to alternate weeks and we are her only grandparents his parents are deceased
I don't want to take this to court my daughter and grandkids is all I got left
I am going through this right now. 😢😢😢 I am so lost on what to do- I am in Florida- laws have changed. I have a consultation tomorrow. I hate to go through the Courts but my concern is my Grand babies well being.
What about a situation where the child's father is not around at all, and she wants to lift the GR so the mother can get family help by moving back to her home state of Ny and not struggle? Child was born in 2018. Father has not seen the child since 2019 by his own choice. No calls or attempts to see the child. Mother is single trying to make ends meet. Child is Autistic and in school. Mother doesn't know where the father is. Mother does not have family support in Texas at all.
We are going to assume there is an underlying order that forbids her to move. In that case, she will need to go back to court and get it modified to allow her to move.
Wish I could have a lawyer like you!! Someone who seems to care about their client and their family matters. 🤍
If you would like to schedule a consultation to speak with one of our attorneys about your Texas family law matter, you can contact us at 713-804-8071 or podcast@waltersgilbreath.com.
So just don’t get married in 2023 lol
Oh shit
Are you all in Texas?
Yes. We are a Texas state wide family law firm that specializes in divorce and custody matters.
Let’s say that she moves in my house that I bought before we got married. We had a ceremony and we have rings but we never got a marriage license. Can I still be divorced and lose half my belongings or does she just move out?
Did she take you to divorce court?
That includes a few layers of legal questions, including is there an informal marriage (common law), if so what is the character of your home and how will your property be divided. We are happy to talk to you about the facts specific to your case, just contact us at 713-804-8071 or podcast@waltersgilbreath.com if you want to set up some time to chat more.

Love this page. Wish i could afford to hire you lol
That's wild so all a woman needs is one piece of evidence to say yes we were informally married. But the man has to be on his Ps n Qs to prevent his assets being split to somebody he never proposed to let alone married. The laws have to change.
Its complete fraud and corrupt. A man has to produce TONS of evidence, while a woman has to nothing (blantant double standard)...
Great video it came at the right time. Thank you ❤
Maria, we are glad to hear that. Thank you for the feedback.
😝 Promo>SM.
People don't no that the federal government pays the states 66% of what the state receives in child support. The fathers usually make more money than the mothers. That is why dads don't get the kids in a divorce 8o% of the time. It's all about the money.
Keep the knowledge coming.
