In this episode, Leap Frog Divorce welcomes April Phillips and her amazing teammate, Bentley Alexander.
Bentley is a therapy dog who aids April in her role as a guardian ad litem. In this video, April discusses the responsibilities of a guardian ad litem which include representing the best interests of children in court, conducting investigations, and interviewing those closest to the child(ren).
April highlights her extensive 22-year experience in the field which began with guardianship for elderly Alzheimer’s patients and then transferred into family law. Her journey began as personal motivation because her mother was adopted. This personal connection to being a voice for children is rooted in her mother’s experience as a child.
Bentley’s role as a therapy dog is vital to helping children open up and talk to April so that she can gather all of the relevant information she needs to present to the court. Child support should be caculated on your take home , not on your before deductions. So i pay in 25 to 30 thousand a year. Money i never see but yet the government bases the child support on before deductions , money i never see. Why is it when women cry right away you claim that child support is not an income its child support. Well i will have you know that 90% of women out there still use it like an income. Second as soon as you made it law that we cannot claim child support any more at tax time, then you should of made it so our child support is based on our take home ,not on money that doesnt exist. Josh law at law legal group in Tampa just showed me fathers rights are not worth much as our care and concerns are not viewed as valid nor credible. Mother left me with an infant and toddler girls with multiple police reports from her son who molested the 3 year old every chance he could get to her. Mother would come in and out take them to whatever room she happened to rent, sleep in the same beds as her boyfriends, left the state, had another baby, came back to Florida demanding her time and i was advised she have it. It out them i felt in situations they shouldnt be in that had safety concerns at least. They'd come back with really ill stories. 5 years of this. Over 2 years crisis counseling every week. Got them in school. Mother has not heloed getvthem to any appointments never taken or picked them up from school. All the emails ive sent with concerns, not knowing where mom would take them as shes been constantly homeless etc ive sent have raised a concern. I reached out for help setting appointments and chexking in with us, the school set us up with a social worker that asked some questions ive been asking and finally was able to speak to our attorney about mom changing addresses 3 times the first 2 months of her time with us which was pretty normal after 5 years. At that point he called the concerns valid and credible and needed to be addressed. What a kick in the teeth. So, what are our rights really worth when our word isnt worth anything? Especially when the mothers only attribute is her assumed validity... I'm having a suoer hard time here in Tampa

My daughter is 16 months old her father abandoned us three months ago has not even called us once nothing if he decides to file for a parenting plan will it automatically be 50/50 time sharing or will the current circumstances play a part and her age she is only one years old we are not married
Florida custody law stinks. It allows mentally ill or drug addicted or alcoholic parents to have equal shared custody. As long as the parent is receiving treatment the judge will allow 50 percent parenting rights.

Are you joking?? Florida doesnt show favoritism to mothers? You HAVE GOT be kidding. Do you know anything about family law?? Clearly not. You have NO idea. My husband was falsely arrested because his ex-girlfriend's made a false call to 911 and lied! it took my husband a full year to be exonerated for that charge. When it was brought to trial and it turned out the mother made the ENTIRE thing up she was never held responsible for that. After my husband was falsely arrested a no contact order was put in place by the judge and he granted the mother permission to relocate almost 5 hours away because she had a great "job offer" she filed this petition and the job offer was not even included in the petition! The mother staged the arrest and had a whole plan because she wanted to move away so she was trying every possible tactic to be allowed to relocate even if it involves making false police reports I'm falsely calling 911 trying to ruin my husband's life. Fast forward 5 years later she has not worked even ONE day since relocating and is living in her divorced parents apartment while her and my 8 year old stepdaughter share a room! It is a much worse situation than what was going on when she lived near us. We own our home and my husband has a very good full time job. There have been so many false accusations the mother has made against us... and we've proved her a LIAR at EVERY Single accusation. She refuses to follow court orders and we have to keep going back to court and the judge holds her in contempt but never issues any jail time and only makes her repay 50% of our attorney fees which her dad just writes a check for. this has been going on for several years and she has never held accountable, she has not been forced to move back to the child's birth city so that we can have 50/50 custody. In fact just to see my stepdaughter we have to drive 2 hours and meet the mother halfway?! we pay over $600 a month in child support and have spent a total of 31K on attorneys in 8 years. It's unreal how these courts operate. if my husband were ever to lose his job or get behind on child support they would have no problem throwing him in jail or suspending his license so that he was not even able to provide for me and his other four children but the mothers lazy ass can lie constantly, not follow our consent order, not show up when she supposed to do for time sharing, try to turn my step daughter against us.(which is majorly backfiring) make up false accusations and nothing happens it is UNREAL how much these courts favor the mother. Even when the mother dips out or is a drug addict and abandons her kids the courts do not even hold her responsible for child support the way they hold the father's responsible. I shouldn't even bother writing this comment but your ignorance is just stunning. And I have been talking with many many different people and helping fathers that are going through situations like this getting screwed over by the courts because we are going through it currently and it is a horrible thing when a vindictive b**** tries to use the only thing that they can against a man...his children. I've seen men have restraining orders and all sorts of b******* without any evidence the judge will just order it and they can end up going months without even seeing their child! I've seen this happen over and over and over again. Gosh not only is your voice extremely hard to listen to but you are so uninformed. I hope to God you are not an attorney because if this is your mentality you are probably like 80% of the attorneys out there just ripping their clients off and dragging things out and giving false information and false promises.

She filed for a bogus order of protection and then divorce. She also hired a lawyer right off the bat. I think it's worked out for me better that she filed first. I hired a lawyer for the OP and lost, and then fired him. Since then, I have not had to pay any attorney's fees. But since I had paid for an attorney, the courts have waived the fees for all of my subsequent motions, petitions, etc. I learned how to make my own motions using Microsoft Word and how to eFile them. I am not sure if this will play out well, but I have only spent $4,000 so far, although I have had to get an apartment. I may even successfully sue for half of my apartment costs, since it's a marital property. Neither of us wishes to sell the house. What's weird is that I think we'll just get divorced but still live under the same roof, albeit with no sex, hugging, or kissing anymore. I can live with that. She's now fat and smells. My scottish croft sex doll and refined coconut oil is all I need.

She filed for an order of protection first, got me out of the house for two weeks, and filed for divorce. Quite possibly the biggest mistake I made was hiring an attorney. I had everything I planned to say at the OP. Then, I chickened out and hired an attorney. He did NOTHING to help. Then, he said it would cost me another $25,000 to get the divorce. I fired him. I saved $25,000. My wife has spent over $50,000 on her attorney, and here we are almost 1.5 years later and the divorce is nowhere in sight. This divorce will probably cost around $100,000, or 10 times what we spent on our wedding.
Another scenario: 1. She hit me with an ambush divorce, where she first filed for an OP because I blocked her mother's phone number, and so the police ejected me into a hotel, and then she filed for divorce. 2. The judge heard her sob and ejected me for 1 year. 3. The year expired, and the judge did not renew the OP, but the judge heard her sob again and ordered me out during the pendency of the divorce proceedings because "it would be too stressful" (which is weird, but any way...) 4. Neither of us wishes to sell. 5. When the divorce is finalized, and so #3 above no longer applies, I can move back home, correct?
I almost wish I never got married. What I REALLY believe is that before anyone is allowed to get married, they should be required to read through the typical 10 page divorce documents describing division of assets, child support, alimony, division of debts, and how long each support payments last. And every person needs to know what "no fault" means. It means she can divorce you if she is sad one day, let alone you argue and raise your voice. And every person needs to know what felonies and the penalties are. And every person needs to know that whatever your marriage day costs, you will spend 10x that amount in divorce court. Indeed, almost ALL of your savings will go to lawyers. If I had read that, I would never have gotten married.
What if neither party wishes to sell or move out, the parties do not get along, and the husband lives in the basement and the wife lives on the second floor, with the kitchen, family room on the ground floor? There is also a 15 year old child who is established in his high school. Will the judge still order the sale of the home?
AI needs to replace attorneys and judges. There should be software where each party inputs what happened and what they want, and include all details in a spreadsheet, then a panel of judges would use a computer print out to determine the best and fairest recommended outcome
Question: If my wife has committed several felonies including eavesdropping in Illinois which is a two party consent state, conspiracy, lying on the witness stand, etc. and the judge sides with me and charges her, will I do better in the divorce court?
There is nothing in my life that caused me as much trauma as my divorce. She refused to work during our marriage even when the kids were teenagers, yet she could show a drunken sailor how to spend money. She was 43 when I filed for divorce and she looked like she was at least 65. She was obese, had grey hair, and wore sweatpants. When she walked into the courtroom my lawyer looked at me and said, "YOUR FUCKED." I agreed to pay her alimony for five years, it was written as three years funded and 2 years unfunded. That meant that after the three years were up she could petition the court for two more years. My lawyer never told me that didn't mean shit. Without a waiver from her, she could come back for more alimony after five years. Well, she did, the judge then extended the alimony until there was a significant change in either of our incomes. I ended up paying her for 12 years until I retired. One thing it did do was cause me to swear I would never get married again. and I never did. I am 81 and she has been dead for about 2 years. My lawyer became a judge and he had a massive MI and died when he was about 47. So all and all the story does have a happy ending. See, there is a God.
I am so sorry to hear about your bad divorce experience. It sounds terrible. We often say that divorce involves good people in one of the most stressful life situations anyone will ever experience. Happy endings are out there for many people. Be well and thank you for your comment.
Just give her everything she wants and then give her more, and you will avoid conflict.
For some people, this may be the best strategy. Many people are, in fact, conflict avoidant and will do just about anything to avoid the conflict. I wish more people knew about the wide variety of tools and strategies to help resolve conflict instead of running from it. Not that running from it is bad. It might very well be the best strategy depending upon the circumstances.

Absolutely correct. I just don't understand men who get married 2,3,4 or more times. Some guy must love to take it up the ass.
It sounds like you had a bad experience with an attorney or maybe many bad experiences with one or more attorneys. That must have been terrible. Like so many other professions, we have some good attorneys, some mediocre attorneys, and some bad attorneys. Choosing an attorney is so important and should be done after careful consideration. And, if you mistakenly hired one you regret hiring, fire them and choose someone else.

This is a joke. We have been in court almost three years fighting this. On the third attorney. The Ex. has 4X the assets that we have, all paid for. Lives with her "business partner", has untold amounts of $. My husband is a disabled vet, has a growth in his skull, had to retire and they asked him to keep working to keep alimony payments going! He is past retirement age. If you are going against a millionaire I would not bother to fight it.
It sounds like an awful experience. I am so sorry you had to go through this. Our legal system is nowhere near perfect, and it is the best we have so far. Going to court always involves some risk, which is why I always try to settle out of court when possible. Judges are people too. They do the best they can. Sometimes they get it wrong.
In the state of Florida can you change 50/50 once you get get it
Thanks for your comment. It is not easy to change and there are no guarantees. A parent will have to meet certain conditions and prove specific things to get a change, which we call a modification in Florida. I have helped many people change custody and visitation after their divorce was final.

I disagree...there are still honest gals like me who lived out their original marriage vows til death we do part. We experienced everything the marriage vow spoke of....but we loved each other....not lusted....

Marriage works for some people and not for others. We're not all the same. In fact, each one of us is unique. Some say that if you can find a partner who you can accept as they are, warts and all, and they accept you as you are, your chance of long-term success is greater. It seems like those couples who enter marriage expecting the other person to change to fit their idea of their perfect mate end up consulting with a divorce lawyer. Not always, but often.
What about permanent alimony or when alimony can’t be canceled?😊
Florida has a new alimony law effective July 1, 2023 which eliminated permanent alimony.
In short, don’t marry at all and if you do marry don’t marry a woman that doesn’t work and or doesn’t earn a decent salary/wage. This new law is a start but still leaves a man financially vulnerable. Now that women can earn as much as a man or more, alimony shouldn’t be granted. If so, it should be capped at 5 years which is plenty of time for her to attain a degree or occupational certificate to begin supporting herself. They wanted equality and equality means carrying your own weight as like men are expected to do. 😒

This is great but not enough. There are some changes in legislation that are URGENTLY needed: 1. Upgrade adultery laws to punish the woman who cheats on her husband because she "felt lonely" or similar idiocies, specially if her husband is out working to provide for her. 2. Change the DIVORCE laws that only favor women who seek to dissolve their marriage without a real cause. 3. Severely punish SLANDER, LIBEL and DEFAMATION so that wives stop destroying a man's life and reputation without consequences.
