J.D. - A Lawyer Explains
United States
เข้าร่วมเมื่อ 25 ธ.ค. 2020
On this channel we explain legal topics and do analyses of current trials. My goal is to explain complex legal topics in ways that don't require you to have a Latin-to-English dictionary. Why?
The law can be an astoundingly complex thing. For any question there are multiple possible answers. My job is to explain things in plain language.
Importantly, this channel DOES NOT provide legal advice. It is a general description of the law based on 28 years of legal practice, hundreds of case, and lots of experiences. As a lawyer I have written a legal column for more than 25 years and am published in a wide variety of publications. I have several books published both in hardback and in Kindle format.

Big Law Firm Gets Sued in MD; Files Competing Suit in NY - Gets $1 Million Sanction!

It truly amazes me how dumb some lawyers can be when they sue other lawyers. It's hard to believe that somebody that handled class action law suits would make the kind of mistake that was made here. They essentially tried to avoid the jurisdiction of the Maryland court by asking the New York Court to order the defendants in that case (who were the plaintiffs in MD) to drop their lawsuit which h...
Will The Allen Charge Impact The Appeal in The Melody Farris Case?

Domestic Violence is Criminal. Here are Some Thoughts and Strategies About it.
มุมมอง 2359 ชั่วโมงที่ผ่านมา
Every day, men and women all over the United States suffer from domestic violence. It doesn't matter whether a man is beating a woman, or a woman is beating a man, domestic violence is wrong. If the police are called, someone is likely going to jail. In some cases, domestic violence can be a misdemeanor. In others, it can be a felony. In either instance, a conviction will wind up with a loss of...

YSL - A Monumental Fail For the Fulton County Prosecutor (and a win for due process)
มุมมอง 2.8K12 ชั่วโมงที่ผ่านมา
Jeffrey Williams stands convicted in his YSL case, but he walked out of jail, a free man principally because of the ineptitude and incompetence of the Fulton County prosecutors office. This postmortem examination of this part of the YSL case, is my opinion and my opinion only. I'd love to know if you agree or disagree.

Melody Farris Trial Closing Analysis: Both sides get high marks.
มุมมอง 97221 ชั่วโมงที่ผ่านมา
This is one of the better closing arguments I've covered. I thought both sides were equal to the task, and I think this is going to be a fairly lengthy deliberation, but, usually when I make predictions the jury comes back and proves me wrong, so I'm leaving this one to the jury.
Melody Farris Closing Arguments Today - Did The State Prove Its Case?
มุมมอง 1.1Kวันที่ผ่านมา
I would rate the chance of conviction here about 65% given the damaging character evidence that came in. But I do think there is a chance they will acquit based on the fact that the state can't prove he was shot or killed by Melody. We will just have to see if the jury thinks the case has been proved.

Sometimes going Pro Se is the only option. When you exhaust every possible avenue and there's not enough money involved to interest a lawyer... and you know you need to fight an issue... you go pro se.
It's scary to think that these women exist..very insidious.
Her voice is so fake..just like everything else.
Well Said Youre Exactly Right..love youre insight
Jorge; Permission to drink, ma'am? Sarah: Not until you clean up the mess, and do a 1000-piece puzzle.
She has zero insight into how others perceive her. None whatsoever. She thinks she is being really clever with this story that paints Jorge out to be badly behaved pet dog. However the jury knew straight away that this story was pure nonsense. I bet on the night of her testimony she was full of self praise and making plans about her big press interview when she is acquitted. Even when the jury came back after 1 hour 25 minutes Sarah would have been thinking "Here we go, Boone wins again"
The only question I have about Owen's capability as a lawyer is his ability to choose his clients. There wasn't much he could do legally, beyond not... actually take the case.
Threatened with a shot in the basement then forced at gun point to the backyard to be killed perhaps? Many possible scenarios. I’m same age and same height as Melody, with a life of sport injuries behind me and I recommend you don’t write her strength off.
My home insurance is OK with me running a business, provided that I don’t have people on the premises. With the rise of the gig economy, people have to be careful that their car insurance covers business use. Making money on the weekends might be great, but not if you rear end someone’s Mercedes and spend the next 20 years paying off the debt.
Short and sweet analysis. Thanks. Informative too
I think Jorge was dead before she went to bed. I think she called her ex husband immediately but he ignored her call so she went to bed and called him after she cleaned the house and set the scene in her house to support her bullshit story. IMHO it’s 1st degree murder but 2nd degree is easier to prosecute.
Thanks for your commentary. It’s so interesting to have your opinions based on your appellate experience. I too believe the judge was giving the defence the opportunity to tell it all knowing this would reduce grounds for an appeal. Thanks for your expertise.
Thank you for the excellent wisdom concerning the subject
Too damn much insurance going on👋🏻
I got rid of USAA because they wouldn’t give me my deductible from a not at fault accident. They couldn’t get a hold of the other party because she was dodging service, so they refused to pay out my deductible because they couldn’t recoup it from the at fault party. It was literally 2 month’s worth of insurance payments and they refused to budge on it, so they lost me as a customer and I took my friends and family with me.
Tony, excellent topic. My wife and I moved into a townhome for retirement, I got insurance and all was well but in fact it wasn’t. After some issues with HOA board members we elected a new HOA board. This board asked all of us to provide proof of homeowners insurance. I got a copy of my policy and found the agent had set up my policy like an apartment policy, only coverage on the inside vs. the full structure and we weren’t the only ones. I needed a full structure policy. I was underinsured by hundreds of thousands of dollars. I realized and later found out my old agent was barely phoning it in. Also choose the right agent who will ask the right questions.
She wasn't his girlfriend, She was his Mom !
I'm being sued in NC (a state I've never been to) for publishing an obnoxious and well known business owner's federal conviction records from PACER. He has sued another kid in the action too, and now has sued him in Federal court and me in another court with substantially the same complaint (they are over 200 pages at this point). His attorney was previously disbarred for impersonating another attorney online. The legal system is has few protections in it for bad actors, at least for the average person who must hire multiple attorneys in many different jurisdictions.
The post-verdict rewatch is chef’s kiss 😘
I thought that gary was shot in the basement because of the bullet with his dna on it. However..i was thinking the bullet only grazed him, maybe his arm or leg? but bullet did not stay in his body. Possible then she walked him to the burn pile..or drove him, at gunpoint.the tractor bucket(think it had a bucket) could have been used to push him in further. I believe the gun came from martha janes house and either rusty got it for her..or she helped herself. Martha jane testified that she had told melody about the gun.i believe rusty knew in advance she was going to do it..and had $$ flashing in his eyes
Tell me.. HOW in the WORLD is Richard Allen's judge allowed to tell the sequestered jury that they may discuss the trial when they're all together, AND the guard IS WITH THEM?? Now, I'm not there but a trusted reporter on here has said so, she's been there daily and she's a highly regarded lawyer. Along with so so much more this judge has done to bolster the states
Have you been watching lawyer Lee who is at the Delphi trial everyday, that judge refuse to even allow the defense to use many other suspects as a defense they didn't let him have a defense at all pretty much and that's just a tiny little drop in the bucket
I found this judge very loosey goosey. The jury doesn't need to know what the judge has on his schedule.
Imo he gave that charge when he sent them back the first time. I agree., he winged it the second time. I felt he was inappropriate throughout the trial, wanted his 15min. of fame.
This makes one wonder where Napoli received his law degree... Mordor?
Astonishing. Talk about a well deserved sanction.
Interesting thank you for sharing. Glad i wasn't on this jury, so many things just didn't add up. Regards Rosie O from England 🏴
I served as a juror for 3 trials in Georgia. I was the holdout on one of the trials resulting in a hung jury. When I heard Judge Cannon give the Allen charge I had a very strong reaction. It felt coercive, as if there was definitely not an option to remain hung. Yikes
Doesn’t matter where he was killed in the house. Killed on the property is all that matters and the jury got it right. A lazy jury member will hold out or not consider the evidence. It’s basically asking the jurors in the minority opinion to evaluate their positions carefully. The jurors are reminded that whatever they do they should not violate their own conscience. Sometimes it’s about understanding what the evidence is demonstrating and not siding with your peers just because you feel pressured. This judge was within his right to use it.
Hi JD Greetings from Ireland love your 😊
I don’t think technically/officially he gave “Allen charge”…at least that’s what defense attorneys said on court tv interview
I think he was shot in basement and tried to escape out basement door, finally succumbed to his wounds near burn pile
I think he was wounded in the house, was trying to get away from Melody, and ran outside where she finished him off. There was outside access from the basement.
Yes I noticed that about the Allen charge but I think it was tempered somewhat by him saying 'attempt to' or similar words within the charge.
What the juror surmissed might have happened was in comments under the court channel so did she read comments?
4:39 "We talk about jury service. Uh, the phrase that comes up is the best and brightest of our community!" Good late save, Judge! 😂😆😂😏
Just what I wanted to hear you say that the appeal would probably not make it
She's guilty on all 5 charges, CASE CLOSED !
Guilty without direct evidence Without answers to crucial questions And plenty of doubt Like Gary didn’t die of gunshot His son killed him thinking he’d pay off the mortgage and claim the ranch because he “worked” there Lazy looser bum!
Thanks for informing us what the Allen charge is.
why would it impact it when it's there for a purpose to use in trials?
This judge was just plan weird to me. I pray he didn't open a door where she can put her children through this again. Those poor kids have been through enough! The jury got it right!
I think he did and so did the lady prosecutor in her closing arguments.
I know damn well the jury got it 100 percent right 😮
You know nothing of the sort because there’s no evidence and plenty of doubt!
Ha ha. She was convicted. Its all common sense.@maluribeiro68
She guilty. That it. She about coldest heartless person.
I strongly believe Gary was physically and mentally affected by the 'additive' Melody put in his food. REMEMBER that Gary made a video on 7/3/2018 showing the plate she threw and broke, calling a "minor temper tantrum" and said....the food was prepared by Melody and it probably was 'tainted' (not sure his exact word). He ended it saying, 'We'll soon see". .IMO, Gary's mental and physical state WAS AFFECTED because of what was 'added' to the food. This, IMO, made it easier for Melody to manipulate Gary and do what needed to be done so he took his last breath. ***Remember AFTER Gary paid for Chris's hotel room, Melody said, in so many words that it was the last straw....and she was going to end it.
That Judge Cannon was a little bit... how can I say it... Quirky!
Why wasn’t Melody offered a plea deal?
Good question
Strange the jury was deadlocked and 2 hours later had unanimous decision. Loved to know what happened in those two hours.
Wanting to go home. They had no evidence and plenty of doubt They went with the gossipy unprofessional prosecution just to be “safe”
He was probably shot more than once
It dies NOT perfect sense!! The jury is NOT duppose to make up evidence or what really happened! Give me a break!! This is not justice! Unless you were there to witness what happened, there us doubt!! There was a lot of doubt in this case!!
