What is a Guardian Ad Litem?

What is a guardian ad litem? Hi, I'm Zachary C. Ashby at Pacific Northwest Family Law. I get this question a lot from my clients. A guardian ad litem is a person that the court assigns to a case in two situations.
 One is under custody dispute between two parents. So, if the parents are either accusing each other, of misbehavior or otherwise can't see eye to eye on what a parenting plan should be. Often the court will assign a guardian ad litem, to interview both parents and report back to the court. In addition, give a recommendation on what the parenting plan should be.
 The other kind of guardian ad litem is for either a juvenile court or for guardianship. These guardian ad litems have a slightly different investigating prerogative. They're focused on fitness of the parents because if the parents are unfit, then a guardianship should be in place.
 They're also looking to see the potential home where the child will be to make sure that the home is a safe place for them, and that the potential guardians will follow the court's directions and maintain the safety of the kids in terms of any kind of visitation from the parents.
 Now, this term can get a little bit confusing because we hear often about guardians for estate plans. So, you have to be careful. This is not a guardian who is going to be there to take your kids or watch the kids. It has a similar name, but a very different function.
 Oftentimes they'll have credentials and that's something to look for in a guardian ad litem to see what their credentials are, what their history with the court is, how many they've investigated. But at the end of the day, you should really talk to your attorney about whether any one guardian item would be good for your case or not. Because not all guardian items are as qualified as any other ones. And so, you want to make sure that, given the facts in your case, that you're able to handle it okay.

      Many courts in Washington have facilitators to help people representing themselves make sure they have all the documents. They won't tell you what should be in the documents (or if the agreement is a good idea) but they will help make sure you have everything

      Probably not. If you hire someone, that usually means that you pay them. In Washington there isn't a separate category for a contested and uncontested divorce. In some other states there is. And if you come to an attorney with everything agreed to, that is usually what we mean in Washington by uncontested (because instead of contesting you are agreeing). When you hire an attorney, you are paying for their advice and time. Even if you come to an attorney with an agreement, it still takes time to review the agreement, advise you on the agreement, prepare the documents that will allow the agreement to go forward, and then present everything to the court.

    So what if we went to mediation once already? We couldn’t agree to a parenting plan. I want equal shared or close as possible to 50/50, and she wants to only share weekends. She won’t budge. Will the judge possibly make us go back to mediation, or trial at that point?

      This depends on whether it is possible to reach an agreement. Very few judges would require a second attempt at mediation if neither of you is willing to back off your positions. Talk to an attorney to work through options and what makes sense for you situation

      Suppose the wife was the higher earner and after birthing their child, the husband became the full time carer for the child. The wife was able to keep a high earning career for say, six years, while the husband raised the child at home and dropped out of school to do so. Now in the process of divorce, the SAH father still does not have a high paying job and no longer a roof over his head. If there is some kind of 50/50 split in custody, he is fully capable of going on his own to find the career to fill in the gaps of his expenses after child support.

But there may be other reasons you would want to stay in the house; who gets to use a house during the divorce is a question to discuss with an attorney at length

This is a 30 year old marriage. The house which is the base of business needs to be sold and divided.

      In Washington State spousal support (also call maintenance and known in other states as alimony), is based on the need of the party asking and the ability to pay of the party paying. If both parties are able to self support equally, there is likely not going to be spousal support. This is a rule create based on the idea that in a marriage one spouse typically earns a majority of the income and the other typically stays at home and manages household affairs (raising children, cooking, cleaning, maintenance, etc.). They both support the family in equal, but different ways. Alimony was designed to compensate the spouse who would have less of an income generating role for the family. When both spouses have the same income generating ability, alimony makes less sense.

    It would be nice if the court would take into consideration how people manage their money. I work with a guy who pays 1,600.00 a month child support. She claims the kids on her taxes and blows the money on tattoos. Then ask him for more money.kudos to him for telling her to grow up,stop wasting the money on tattoos and other stupid shit. Seems like the guy always gets screwed. I only know 2 men that came out on top in a divorce.

      Retirement accounts are often community property, but couples will give them up without knowing that because they are in one spouse's name. And even if they do think to divide it, retirement accounts are highly regulated and there are tax implications. If the right steps are not followed to divide the retirement accounts, taxes can hit immediately or the retirement account may not be divided and this won't be discovered until years and years have gone by.

      If you can agree and get along, you can avoid a lot of problems. You can even avoid divorce if you agree. Don't know what you mean by "absolute" divorce, but couldn't agree more. A big problem people have that we've seen is one spouse thinks there's an agreement, when in reality that spouse just bullied their way to get what they want yet again (fundamental cause of the divorce, too).

      No idea what you mean by "absolute" divorce. That's not a term I've ever come across. But if you have nothing to lose or gain either way, there isn't a lot that matters. So it really depends on how quickly you want thins to happen.

      @@pacificnorthwestfamilylaw9061 I have documents that say Absolute divorce. The court clerk also told me that you need Absolute divorce forms. It's voluntarily divorce. Uncontested. We're not wealth or rich couples to fight over materials. When i contacted the court clerk, she said there will be Zoom call no necessary to come to the court. (Maryland)

      maybe, i would go to the police, CPS and get a family law attorney. But be very careful, grandparents rights or even grandparents gaining custody is very difficult.

    Is there any advice that I can get because my mom’s mother in law wants me to switch places for chiropractor medicine and I do not want to. My physical therapist said I am of age and my mom’s mother in law has no legal rights to me.

    The state handed guardiansip over to a corporate guardian. Vs grandparents eho have had her for 7 months

      We fought hard for guardianship why would judge chose a corporate guardian he never explained why
