    I'm assuming the person is using a translator because they don't understand English. So if they're marrying a United States citizens, how do they communicate?😂😂😂 It took months for me and my husband to understand each other fully. And we still don't, I'm afraid the in the interview. He really won't understand what the person is saying. And I have to ask him the question did he understand that's how it is every day in our life when meeting new people are talking to people he doesn't know.😅

      Often the US Citizen is from the same country or same background so they already speak the language. Other times, the non-US citizen can speak/understand English, just not as comfortable so they opt for a translator. But one time, I will never forget, I did have a couple where the immigrant spoke another language and almost no English and the spouse only spoke English. The USCIS officer specifically asked how they communicate! The wife said she was teaching him English and learning his language and spoke a few words of his language. Love can be communicated through many different ways! (they were approved 😉)

    I have a question , when I’m filling the form I-134 for my Daughter , they Ask you information about employment, and birth information about the individual who is agreeing to financially support the beneficiary. So if I’m unemployed, and I can’t support my daughter, and I have a co-supporter who is eligible to support my daughter , should I put his informations about his employment and his birth date , his social security number , or should I put my personal informations in this section who is the petitioner ?

    Hi! Would really appreciate if you could explain what do you mean by “derivative asylee should apply for green card after the grant”. By grant do you mean the i-797 Notice of Approval, or when the embassy approves the visa or after being physically present for 1 year in the US. Would really help!! Thansk

      Derivative asylees can apply after being physically present in the US for at least 1 year. If you are in the US when the principal was granted asylum, then the year is calculated for principal and derivative from the day of the grant. If you are follow-to-join and come into the US after the asylum is granted, then the 1 year will be calculated from the date of your entry into the US as an asylee. I hope that helps clarify!

    My asylum case got transferred to court and my master hearing was sent in writing then they set individual hearing date to April 8th 2024, now they have postponed it to August 2025 😭… I don’t know if this is bad news or no, I don’t even think I qualify for a travel document so can’t see my family☹️ Can we do Individual hearing by writing like the Master Hearing?

      Pictures are not required. But you can submit pictures from your wedding, pictures you take when you visit your spouse or you and your spouse go on vacations. You can also submit you with your spouse's family and vice versa.

    My question is how do you marry someone in the United States who is here illegally and been deported twice he only has a Mexico Passport? According to the courts you need I.D social security number and proof of residency to get a marriage license how are people marrying in the USA if they are illegal and have no documentation ??

      Getting married in the US is unrelated to immigration status. I have clients get married all of the time in the US who have no legal documentation. Each state is different. You may be looking at a state that has more strict requirements. For example, I got married in Connecticut 3 years ago and we just had to show a valid photo ID. So the Mexican passport will work if it is currently valid. I believe it is just as easy in NY to get married. Hope that helps.

      You are basically correct, but being a high priority means that the government is more likely to TRY to remove you. You still get to present your case before the Immigration Judge as to what avenues to relief you have to stay in the US. However, if you are an enforcement priority, then you likely have some criminal history or a national security concerns, etc., that may render you ineligible for many forms of relief, making it harder to avoid being removed. I hope that makes sense!

    Does this process apply to petitioners who have an I-130 approved but the beneficiary is in the US without documentation since 2007?

      No it does not. It only applies if the Beneficiary is outside the US since the purpose is to bring the individual to the US quicker. The Beneficiary in that scenario would need to file an I-601A waiver for the illegal entry, wait for that to get approved, then leave the US for the interview abroad. The good news is with that process, the Beneficiary is usually only outside the US for about a month and reenters as a permanent resident.

      Good question! If the I-130 is approved, there is nothing that says a pending I-601 makes you ineligible. The petitioner needs to receive an invite letter regardless and USCIS may not issue them to anyone who needs a 601 until the 601 is approved. They have not really said how they will handle it. But the actual regulation does not prohibit it and if the 601 claim is strong, I can definitely see some people benefiting from this process.

Now, my stepfather is 80 years old and I'm working and a financial supporter for him. Can I request and support his daughter to come to the United States under this program?       Unfortunately you cannot petition for your sister-in-law since she is married, thus no longer a dependent of your stepfather. Once your stepfather gets his green card, he can then petition for his daughter and her husband.

      Please do not get me wrong, I am not confused. We know general reasons why court dates change, but the court often just changes a date without telling us. The court tends to be more confused with us, as the internal communication needs improvement.

    Mam, did she got her 601 approved? I received RFE for I601, misrepresentation after my VAWA approved. I dont have qualifying relative in US apart from my US born daughter.

      Yes, her I-601 was approved. As a VAWA Beneficiary, your extreme hardship can be based on you. You do not need a qualifying relative like you would if you were applying for a green card based on an approved marriage petition. That is exactly what happened in this case.

      It will not go away on its' own. It is easier to get a closed cased dismissed, if policy changes or you have a good reason to dismiss. A closed case can be recalendared by either party at any time (although the government generally does not unless you get arrested or commit immigration fraud. With a dismissed case, the government has to start over to put you back in removal proceedings, which means they have to serve you with a new notice to appear (the charging document).

      @@TheShapiroLawyers OMG thank you so much for your reply!!! It's been 4 years sence the crime and there is a statue of limitations of 7 years in my state for it. Will that matter?

      @@CTOSHLL Unfortunately no. The statute of limitations applies to the criminal law and not immigration law. If it is a crime that makes you inadmissible, you will still need a waiver, if one is available. Even if 20 years pass, the same is true.
