In our state, in the US, there’s a period of time where an estate must go through probate. A notice must be put in the local newspaper three different times in a four to six month period. The notice is to give creditors time to collect a debt if the deceased owed it. The person/company owed must submit a demand to the court. The court will send the demand to the estate attorney who then passes it to the executor/s who pay it out of the estate account. An estate account must be set up. All monies go into this account. If there’s an estates sale, the money from the sale goes into the account. If the house/property sells the money is deposited into this. All bank accounts held by the deceased as well as any IRAs, CDs, Money Market accounts etc are funneled to the estate account. Any bills for the estate can be paid from the estate account IE: utilities to keep the house in running condition. Any demands from creditors that have been sent through the court system are also paid from the estate account. We had one bill that was sent directly to mom’s address. We took it to the lawyer who said they had to go through the court. This company was notified the week she died. The attorney let them know what needed done. They sent a second bill a week after probate closed. We took the bill to the attorney who told us the company was too late. & they didn’t follow the procedure. Once the time period notice is over for the creditors to collect, the remaining funds can be dispersed.
