if delay notice is not given in time,as per fidic 99 it is to be rejected straightaway without any further deliberation.This not so when you review the local law which has a priority over contract provisions specially when you read law on 'good faith or relevant civil code provisions'.Can this be reffered to dab strict away or arbitration is the only way where law has still to recognised ADR formally

the reply given on 'no claim certificate' is still not very clear and need discussion on some real court cases
