Is it fee-simple? Who was the architect? Who was the general contractor? When was construction completed? Interested potential purchasers want to know.
Thanks for your questions! The property is fee simple. There was an architect at the beginning and Sutton Construction Group assisted the owner with completion of the design. Construction was completed on the main house in 2022 and the other structures were remodeled in 2020.
not only rent$ issues but factor in strata fees how many locals can pull that off. Most of these properties have S.F.A for storage, closet space etc. Thses people are b f stupid. Vote them out is the answer.

May want to see???? Really? This is lousy advice. It doesn’t get passed without an inspection of the work! Especially electrical, Doug! Plumbing too! I was teaching my agents about this stuff in 1993 at CBPacific Properties Kailua office. The lenders won’t fund a buyers mtg. if the sq footage doesn’t match what the tax office shows when it was originally built. Agents are obligated to confirm that the sq ftg matches even if they aren’t a builder or contractor, it’s what you get paid to know. You just use a General Contractor to get the permits because it cannot be owner builder on the permits! Get only licensed people to do the work. It all needs to be done before you list the property because you may end up selling it before you find out it is missing half the house… then the Sellers are required to perform on the property as it was when they wrote the contract and the seller is STUCK with the costs to fix it and it can run into tens of thousands of dollars or more depending on how much is missing.

Hi Doug, Thank you for the video. Not sure if you'll see this, but I have a question on ethics for you. I'm a buyer's agent in NYC and have come to realize that the listing agent didn't disclosure that a condo had a significant assessment until the bidding war started. It's a long story, but I have pretty concrete proof that he knew about the building assessment but choose not to disclosure it , until he had multiple offers. I honestly am concerned if there were multiple offers at this point. I discussed this with my buyer and he is choosing to move forward but I feel so DUPED and I'll be seeking advice from my MLS and broker but I thought you could share some of your wisdom about this.. How would you handle this problem?

Yeah I finished my basement completely, even added another electrical panel, did all the plumbing 20 years ago without a permit. I have a big basement with 4 rooms and a full bath now, without a permit. Following finishing the basement I had a big detached garage built which has a basement. I did get a permit for that but it was never final inspected. Now with all the building permit happening in my county I am afraid to sell my house. I am thinking they may ask me to rip off all the drywall to the studs. Everything is to code and has worked fine for 20 years. Now I am retired and wife wants to move to a smaller house. I am afraid to put the house on the market. The inspector for the detached was very nonchalant. I worked as an Aircraft Maintenance Technician for 50 years and was not worried about permits until now as I had a lot of experience with electrical, avionics, engines, plumbing, hydraulics, anything on any aircraft I have worked on several times. What is your opinion of what will happen when I ask for a permit?

Why is everything so stark glaring white on white on white? I mean, a few things I didn't notice at first because it was something white in front of something white with white stuff all around. Stuff becomes invisible. And it isn't just this place. Most of the videos I look at, it's this same white on white on white on white. This isn't even the worst offender: some kitchens even the cabinets are painted stark white. Don't set down an egg; you'll never find it again. There's a lot to like here, but WOW is it white.

I assume if the landlord is on the mainland, the court would not allow a zoom hearing between the mainland and the tenant in Hawai'i. Is that correct?
Thanks for your question! Here is Doug's response: I really don’t know the answer to that - that would be an attorney question but it doesn’t seem like you couldn’t be elsewhere since both sides don’t even have to come into the court room anymore and can be “present” in the court via zoom. The judge and staff and the only ones that have to be in the courtroom. There are three hearings/meetings, all of which can be accomplished via zoom. I do think that being face to face with the judge is best however - maybe old school!

Hawaii’s building department needs to be sued for incompetence Most homes that are built are typically within the building code They should just issue the permit and catch problems in inspections And do away with plans must be stamped All there causing is price gouging from architects/ drafters/engineers it’s a joke I’ve been trying to get plan’s drawn up for a simple 800 sqft 2 bed one bath all ready fired one For using trusses when I wanted conventional roof framing No engineer will stamp plans that they didn’t draw or know the architect that did draw up It’s a joke I’ve got 1000 plus homes and a few multi story buildings under my belt in the 40 years I’ve been doing this Good luck

I live in NC, there’s an adition built 400 square foot or about simple no windows storage made into rooms but it’s attached to the house . So what now, ? Will I get in trouble for that ? Here is Doug's response: Every state will be different but bottom line you shouldn’t tear is down since you spent the money. Get an architect to do an as built blueprint and get advice and get it permitted. It’s worth it. The architect can help you navigate out of this problem. It shouldn’t be hard.
You’ll be worrying about it until you sell so get it done now because the building codes change frequently and what us on today may not be ok 10 years from now when you want to sell. Besides in many states Owner builder additions (where you get the permit and do the work) cannot be sold for 1-5 years after it is signed off to make sure everything works. Don’t wait until you have to do it, you won’t be sorry.

Thanks Doug. Huge help understanding a complex economic and political topic. I expect substantial unintended consequences from this heavy-handed law. Do you think previously short-term-renting owners will now gravitate heavily towards long term leases, thus bloating supply of properties in the long term rental market? Will that depress sales prices for places that are mainly well suited to short term rentals?
I’ve never seen an en mass exodus in real estate, even with equally game changing changes. Real estate reacts slowly. The long term rental market is tight so it should absorb long term rentals just fine. If one has a lodging unit, that is a unit with no kitchen, that may be a big problem. They are not conducive to long term because they are really hotel units. A building like Ala Moana hotel, that is predominantly lodging units, will have a big problem with this. The government wants to close the hotel down because it is on inappropriate zoning per the new law. Buildings like the Waikiki marina, palms, Hawaiian monarch, royal gardens, island colony, Waikiki banyan and Waikiki sunset are on inappropriate zoning. I understand that the government’s next step will be to raise the real property tax assessment rate on the condotels to try to eliminate them. This will help rid most of the commercial businesses mauka of kuhio avenue, leaving it as a more pure residential section. That was the goal of the change of zoning back in the 1980’s with the Waikiki special design districts. Interestingly, no en mass exodus back then ! Next they can enforce ridding all the illegal second kitchens in residential homes. That would fill the hotels.
