    Hi I’ve agreed a no win no fee for a data breach against a company . My solicitor is now telling me to opt into Litigation management agreement but says it could now cost if it goes to a trial . What would you advise me to do ?

      Hi there. LMAs are typically used when there are several claimants bringing a claim against an employer. It is unusual to bring a data breach claim in the employment tribunal too as they don't have jurisdiction to hear a data breach claim (unless you are linking an act or omission as factual background for another claim). It is difficult to advise you without further information and a consultation. You are welcome to call 01869325883 to discuss further.

    Direct, indirect, bullying and unfair dismissal based on disability discrimination all these have been done and I believe negotiations doesn't make sense, because post that there a lot after maths that happens in one who goes through.

    I've used Magara Law and had a very bad experience. The firm has more positive reviews on Google than Thomson Snell & Passmore which has been in existence since 1570 and employs over 160 qualified solicitors. I wish I had checked verified facts before using Magara Law.

    As a Agency worker for Pertems working for Sainsburys over nine months. I was dismissed for a small accident in the yard as a lorry driver. They dismissed me permanently from work. If I was one of the employees, I would add a warning and a small training course to attend. I feel unfairly dismissed, and I feel I haven’t treated the same way as one of their drivers. There is no way a driver would’ve lost his job if he was on the books. Do I have any rights?

      Thanks for your comment. Until the rules on unfair dismissal change (see here th-cam.com/video/RTsQ6X9LHgc/w-d-xo.htmlsi=2zBUkkfFtEPTQnnB), not havign 2 years of continuous employment with a company puts you at a disadvantage when trying to bring an unfair dismissal claim.       Your agreement will have terms relating to cancelling the damages based agreement. Most Solicitors who have a sense common sense will allow you to cancel it if you change your mind before any work has been carried out. If it is some way into the agreement/case, there will no doubt be some cancellation charges to pay.

    My Dad died under NHS care last year. YES solicitors said they are willing to pursue the case, and have sent me an agreement. They said that they will need to see the medical report from the NHS and will then decide if its a viable case or not. If they decide not to go ahead with it, am i going to get a bill for the cost of medical reports and whatever else they look at? They said there will be no fees if they decide not to go ahead with the case, but the agreement mentions that im responsible for disbursements if they (YES) back out of the agreement. Is that something i should be careful of? I haven't signed anything yet but i dont want a big bill if they decide its not worth pursuing the lawsuit against the health board after getting the medical records. Thanks!

      Sorry to note your loss and difficult circumstances @rcary. I can only discuss matters from an Employment Law perspective (yours seem to be a medical negligence issue). I would in your case suggest you have a frank and direct conversation with the prospective solicitors so you are clear on what your financial risks are. I hope it all works out for you as you need it to.

    Hi, my name is Terence George Bridgewater and I have been suspended from work under a false allegation of sexual harassment at work by a colleague Hollywood. I feel that this is unfair. I've only been back to work for 2 days and been suspended andded I am absolutely devastated. I have 2 daughters, 4 grandchildren, and a wife to take care of air of hero I suffer from depression and mental health problems with my health hell and I to NOT think that this is right. What they are doing? I am going to wait for the end of. Guarantee to bozov oh, but also that I have a witness that I was with most of the morning. What said I did not say these things things things, this company which is Arkansas facility services, are absolutely disgusting asking, is it common law to say that I have the right if someone definitely it's my character as I am a manager manager and I've been employed for a number of years is that they are allowed to get away you are disabled this. Can you please tell me if I got the right then to Sue this individual who makes this claim for damage?

    I really need help. I have been bullied at work. I'm Asian and all of them who bullied me are European. They are nice to each other but not on me. She throws bread at me, belittling me and shouting at me. I raised the case to the management but got no luck instead they ganged up on me and hired new Waitress on my weekend shifts. These made me sick and self medicated at home over stress and depressions. But they still didn't do anything. I could feel that they are waiting for me to resign as end of. I'm really struggling to fight back my rights and get justice.

      I been working with company 19yrs, I been dealing with coworker and he been bully and harassment me for 3yrs. I had brought up Manager and HR and nothing been take care. My boss he is discrimination whenever I complained about a coworker he is white nothing got taken care. whenever a white person complained about minority my manger all over and give that person written warning. Please Helping me understand I live in freedom country but got treated like not like people because only thing I didn’t have same color skin.

    iv just watched ALL your videos. My data was shared by my employer in November 2021 without my permission wich resulted in another colleague also getting my full address then progressing to sexually harass me inside and outside of work (I had previously reported this colleague for sexual harassment at work but was told by manager to ignore his behavior as there is a generational age gap so thats just the way he is). I reported this colleague to the police. Made an official complaint about the sexual harrasment and breach of GDPR. My employer concluded their investigations in May 2022 and on the same day suspended me for gross misconduct which was proven not to be true as i did nothing wrong. The same week i was suspended the assistant manager of the store directly belittled my disability in-front of another member of staff. I put in a grievance against him which was upheld april 2022. Since my initial complaint in november 2021 the way i have been treated by senior member's of staff has gradually got worse. finally hitting its peak in may 2022. I have had to move house because of the sexual harrasment off the colleague who has now left the company. But management knew about his behavior and did nothing, then by sharing my address have him all he needed to control my life for the past 8 months. I have tried to get advice as to what to do next but keep getting told that the fees to take these issues to tribunal will out-way the compensation so no solicitors are willing to help on a no win no fee basis. I work in retail on minimun wage... i DO NOT have the money to pay a solicitor £180 an hour for advice to then loose at tribunal. I cant even afford to leave my job. PLEASE do you have any advice????

    Hi, I've been subjected to an investigation and suspended. I was told a disciplinary would follow but still waiting on letter/email. I fear that there's a good chance they will terminate the contract. I now want to hand in my notice before they issue any disciplinary invitation, just to give myself some peace of mind. Would that be a good thing for me to do? Thanks.

      Hi John, a number of factors are important to consider including how long you have been suspended for and what the issues are. Your employer can still continue the investigation against you and may even tell future employers that you left pending notification of a disciplinary investigation in your reference.       @@magaralaw4318 Thanks for your quick response!!! I've only been suspended for 3 days now and told last week that today was supposed to receive the disciplinary letter, which did not happen. But it could be tomorrow. This is a remote call centre position and the allegation is call avoidance. I fear they would terminate me so that's why I'd like to hand in my notice for some peace of mind. I feel really stressed out because of it which is impacting my health also..

As I say, there are a number of factors and scenarios to consider before you do so. 3 days up to week to receive further information is reasonable, although I appreciate each day passing makes things worse.
