A. Surah 65:4 - Meaning and Context Contemporary interpretations of this verse are as follows: "As for menopausal women and those who are unsure [regarding menstruation cycle count]: their [separation] duration is 3 months. Those who have not menstruated yet [since the initiation of the divorce process] and those who are pregnant: their [separation] duration is until childbirth. Whoever heeds God, God will facilitate his/her affairs." (Qur'an 65:4). I. Women: The term "nisā" (نِسَآء) in the Qur'an clearly refers to adult women, not young girls. In classical Arabic, "nisā" denotes women who have reached maturity and are capable of experiencing menstrual cycles, signifying their full adulthood. II. Understanding the Different Categories of Women: Three categories of women are described: 1. Women with ABNORMAL cycles (including menopausal women or those with irregular periods). 2. Women with NORMAL cycles who have missed or delayed a period and have not menstruated since the initiation of the divorce process. This group refers to women who may be pregnant but have not yet menstruated since the divorce was initiated. Pregnancy is a significant concern here, and the verse suggests that the divorce should be postponed until the pregnancy is confirmed or until the woman gives birth. 3. Pregnant women (with confirmed pregnancies). III. Abnormal Cycle Women: This category is subdivided into two groups: i) Women with DECLINING hormones (menopause group/physiological changes). ii) Women with hormonal IMBALANCE (diseased/pathological). The phase leading up to menopause (peri-menopause) typically lasts 4 to 6 years, during which menstrual cycles become more irregular, and the time between periods may vary. It is also possible for women in this phase to become pregnant. (This is something the Prophet Muhammad [pbuh] could not have known.) Eventually, menstruation stops altogether, marking the onset of menopause. IV. Significance of the Three-Month Waiting Period: At around 12 weeks, a pregnancy can be confirmed, and it can be felt above the pubic bone. For a woman with a normal cycle who has missed three consecutive periods, the likelihood of pregnancy is about 58% by the end of the third month. For a woman with an irregular or abnormal cycle, and who has had no sexual intercourse during the separation, the chances of pregnancy at the end of the three months are zero. V.The Divorce Process and the Waiting Period. Before a divorce is finalized, the couple must separate, meaning they should not engage in intimate relations during the waiting period. Once the waiting period concludes, the couple can either proceed with the divorce or reconsider their decision. Surah 65:1 commands: "O Prophet, when you (or any of you) divorce women, divorce them in accordance with their waiting periods, and adhere to [these] periods..." (Qur'an 65:1) Summary: The verse focuses on ensuring clarity in matters of divorce and pregnancy. It has nothing to do with prepubescent girls, as they cannot become pregnant or experience menstruation. --- B. Surah 33:49 "O you who have believed, when you marry believing women and then divorce them before you have touched them [i.e., consummated the marriage], then there is no waiting period to count concerning them. So provide for them and give them a gracious release." (Qur'an 33:49) For this category of women, the waiting period is not applicable because the marriage has not been consummated, and the woman is not pregnant. Arranged marriages were common in the past, and if it happens that the couple does not get along or the man has a medical issue (e.g., impotence) and the marriage has not been consummated, there is no need to wait for confirmation of pregnancy. The Qur'an instructs that the woman should be given a gracious release without a waiting period.

It is as if the people’s deeds appeared in the form of their kings and leaders. If the people are upright, then their kings and rulers will be upright, and if they turn away (from uprightness), then their leaders will turn against them. And if they oppress and tyrannize, then their kings and rulers will tyrannize and oppress. And if deception and treachery becomes manifest amongst them, then the same will appear in their rulers. If the people refrain from fulfilling the rights of Allah upon them and become niggardly (regarding their execution), then their kings and rulers will refuse to give them their rights and will become niggardly (withhold their rights from them). And if they take away from those whom they oppress that which they deserve not to take, then the kings will take away from the people that which they deserve not to take and will levy taxes and impose tasks upon them. And whatever the people unjustly take from the oppressed, their kings take the same by force from them. So those in charge of the people appear in the forms of their (the ruled) deeds. And it befits not the Divine Wisdom that the evil and wicked be ruled except by those of the same kind. And since the early [Muslims] were the best and most righteous of generations, their rulers were of the same standing. But when the people turned weak, their rulers turned to be of their own rank. So it befits not the Hikmah (Wisdom) of Allah in these times that rulers the like of Mu’aawiyah and Umar bin Abdulaziz, be in charge over us, and even less the like of Abu Bakr and Umar. Rather, our rulers are in accordance with our own rank and standing, and the ones who ruled those before us were (also) in accordance with these people own rank and standing. And both matters (the status of the former rulers and those of this time) are as necessitated and entailed by [Allah’s] Hikmah" [📚 Miftaah Daarus-Sa’aadah, 1/177-178].
