Not if your on probation...it can and often is a condition of probation especially as they mention for Narcotics that they can search you whenever they want. This is fiction though and NOBODY should take probation as it's just content to tyranny
He’s on probation, they can search his stuff based on that. Probable cause isn’t needed nor is consent. Being on probation is essentially like being in jail but you don’t have to be in a jail cell. So in this case, he’s obviously in public and not in jail, one usual requirement of probation is no police contact is allowed. Since it’s a traffic stop, likely a misdemeanor violation, not something he will be forced to go to jail over because of his police contact. It’s because of those stipulations his vehicle can be searched. Even if there isn’t probable cause or consent, they can simply search his stuff to make sure he’s not violating his probation requirements. One last point, the female Officer said he was on probation for an 1130… I’m not sure what that is, but if it’s a drug related offense, coupled with the fact that he’s on probation and is currently in the middle of a traffic stop, they can search his vehicle. If I’m not mistaken, if you’ve ever been convicted of a drug charge or offense, that gives them the right to search your vehicle.
