Hulk is like a force of nature. The consideration is that if he kills innocent people it has to be by intent and malice. In the hulks fight and collateral damages there’s been deaths. But not by intent or pure evil.

Penance stare isn't necessarily the deciding factor, it's more the factor of Zarathos wanting to take down the hulk and using his full power. Zarathos didn't want to fight the Hulk, because he had no reason to. Zarathos was basically keeping Johnny Blaze on a bit of a leash here.

That's also a big maybe, because the penentstare won't kill anyone and if the victim of the stare has the mental capacity to overlook all the pain and harm that they cast to others then it's useless. Thanous once destroyed everything in the univers and kept Ghost rider as his hench man and daily force him to use penent stare on him to enjoy the suffering he had cost.

GR's penance stare was nerfed some time ago. I think it used to work by sin if I'm not mistaken. TBH GR could kill the Hulk if he wanted to, he just didn't have any reason to do it.

This isn't really completely accurate. The key to understanding the power of the Penance Stare is that it is fueled entirely by guilt, whether surfaced or suppressed.

Ghost rider cannot kill hulk under no circumstance. The one below all wouldn't allow it and his split psyche the one above all wouldn't allow it. Once the green door is open hulk wins all day regardless of who he fights.
