    if the Court had accepted the California Supreme Court’s interpretation of the law. For instance, whenever the police stop a bus or a taxi, they could investigate its passengers with impunity. The passengers would have no recourse against the police, even if the police lacked justification in the initial traffic stop. The police could begin pulling over buses and taxis randomly in order to try to spot and arrest an occasional criminal who might happen to be in those vehicles. California Negative. No. There is a difference between a social passenger and a commercial passenger. Commercial passengers should be afforded more protections because they do not have a presumed close relationship with the driver. It is easy to see and investigate social passengers. It would be harder, and there would be less justification for doing so, in certain commercial contexts such as on a bus. Moreover, although mistaken, the police initiated this stop because they suspected that the driver had expired tags. There is no suggestion that totally random stops of any vehicles for the sole purpose of conducting a fishing expedition to find and arrest criminals would be constitutional.

    I was a Georgia State Patrol driving instructor at Forsyth Georgia...I was a Sgt" E-5 " in Iraq.... I was on the road for hours every day, i can tell you that most people that go into "law enforcement" are ego driven... they do get the big busts sometimes but between the busts they are putting boots on the neck of regular hardworking people

    I respect what these cops do but they don’t have the intelligence to recognize they’re on a wild goose chase. The biggest dealers are their bosses yet they pretend not to know this.     Do not answer any questions except providing id. Once the citation is handed to you, ask if you are free to go. A common cop tactic is continuing to ask questions making it a voluntary encounter. You must ask if you are free to go and leave immediately.

    So he said if someone slams on their breaks, that’s an indicator that they’re involved in criminal activity. But later on says, if someone’s going 75mph in a 50mph zone, of course they’re gonna slam on their breaks when they see a cop. No one wants a traffic citation that costs hundreds of dollars either. Just because we might try to correct our speed when we see you, or put our seatbelt on, hoping you don’t see it, doesn’t mean there’s gonna be 16 kilos of cocaine in the trunk.

    In the spirit of double jeopardy, amd in common decency. I could not convence someone of something(free to leave) that not true for the sole purpose of avoiding a roadblock created by someone smarter than me (Those who added yhe protection) or the job of government to Protect rights, to avoid an exclusion etc. That, even if legal. (Police allowed to lie)...hell, im speechless. What kind of a man am I? What kind of man or woman who sees this as a ok thing capable of in any other area of life. Im all for the police, academy trained myself, served as fire fighter. Have kids yall protect etc. But damn! If I had a hand in developing the protection you are willfilly disregarding by tricky endruns....i think i would be a little pissed. Probably immediately push legislation to punish those who put locking someone up as more important than respecting the ....im just going to hush. Job description is law enforce can not in any situation include finding ways around laws to accomplish that...be listed under that. Do something like that to court order written by a judge he ( or she) would instantly feel slapped in the face. Charge of contempt would hit hard and quick. I inderstand the urgency in protecting the public, but good people who where a badge. Dont ever protect me that way please. Dont need to be that close to that level of indecency. Draw a damn line somewhere. Might save your soul.

    Never speak to the police after you hand them your documents. They have absolutely no right to know your destination. Politely tell them “ I respect you officer and am not trying to be rude but I would prefer to invoke my right to remain silent without an attorney present and be on my way”. Do not start answering questions after invoking your rights.

    NEVER TALK TO THE POLICE. 1. GIVE THEM YOUR ID, ETC, 2. Say NO when they ask you why they pulled you over 3. Any other questions, no matter how benign TELL THEM “I RESPECT YOU OFFICER AND AM NOT TRYING TO BE RUDE BUT I WISH TO INVOKE MY RIGHT TO REMAIN SILENT WITHOUT MY ATTORNEY PRESENT”. 4. If the officer deviates from his stated reason for the traffic stop or delays say “ Excuse me Officer, am I free to go? He may ask you to exit the vehicle which is allowed. If he asks you to do anything else that seems outside the bounds of a traffic stop ask him “ is that a request officer or a legal command. If he asks you to search the vehicle, say “ With all due respect officer I do not consent to any search”😊 Be very polite but calm and deliberate. The officer is trained to escalate every situation into a potential arrest and will use psychological tricks to get you to waive your rights.

    All of the lawsuits I’ve won have been when I was forced to ID under treat of arrest as the passenger. I’ve been able to get past qualified immunity every time. I make sure to record my interaction and during the interaction state the case laws as to why I don’t have to give my ID. Once they ignore that and still demand my ID, I give it and sit back and smile as I know I’ve already won my lawsuit or still not give it to then they arrest me and then identify at the jail. That’s where the real money maker lawsuit comes in. Because I’m able to show it was a false arrest, excessive force, and also get them on other civil right charges. So shout out to the seven officers who have made my life very comfortable.
