      Two years articles are a requirement. You should finish your articles. You are able to attend law school for six months and do articles for a year.

    what is the fit and proper test all about and is it important ? do they check the candidates criminal background? sorry for asking so many questions we have a debate about that topic and i am trying to gather information and understand

      When you start your articles the LPC will elect an attorney in the city where you are doing your articles. The attorney will be from a firm other than your law firm. It was an easy interview for me because the questions were based on attorney’s ethics and the Legal Practice Act. Basically, you will be asked questions regarding attorney’s ethics and to see whether you understand how you must conduct yourself as a candidate attorney. And no, the attorney didn’t check my criminal record. His duty was to test my knowledge. But I think when you initiate your admission application the LPC does check your criminal record so that they can establish whether they need to oppose your application.

      Interesting enough, currently there is a huge debate regarding this topic. Section 24(2)(b)(i) of the Legal Practice Act 28 of 2014 states that in order to be admitted as an attorney in SA, you must be a South African Citizen or permanent resident of the republic. A lot of people who studied in SA are unable to practice because of this section. So this matter was taken to the Constitutional Court on the basis that the section discriminates against foreign nationals. The ministers argued that the section was in line with government’s obligations to ensure that foreign nationals did not circumvent immigration and labour laws. Then the Constitutional Court, in Rafoneke and Others v Minister of Justice and Correctional Services and Others, ruled that the section is constitutional. This judgement is very fresh. The matter was heard on the 24th of February 2022 and the unanimous judgement was handed down on the 2nd of August 2022. Therefore, currently as I’m writing this reply, you can’t be admitted as an attorney in SA if you are not a citizen or permanent resident in the republic.

      I don’t wanna be sued for defamation or anything, but I’ve heard people mentioning that ALLEGEDLY law firms don’t prefer candidates who obtained their degrees from a college. So it’s really hard to get articles. Some students were even advised to do their LLM before searching for articles.

      No. To be admitted as an attorney in SA, you need to have an LLB degree

      I studied at UJ so idk about other Universities. But I know that University of Johannesburg’s first year modules are 1. English for law (year module) OR English 1A (first semester) and English 1B (second semester) 2. Indigenous law 3. Introduction to legal studies 4. Law of persons and the family 5. plus as elective module, I chose psychology. Other ppl chose history and others chose politics etc.

    Say for instance my office has offices within 15 km of High Court. Can one of attorneys at the office sign, instead of using a corresponding attorney?

    Hi my articles are registered with the Nelspruit (Mpumalanga) branch of the lpc but I will do my admission application in Johannesburg. Can I serve the lpc in Johannesburg or must I serve lpc Nelspruit? Are there any other things I'll need to do in order for this to be accepted without opposition

    Hi! I asked around alot on other law chanels, I want peoples opinions who are currently in the profession or studying law...what was your personal experiece with where you studied? I want to study at Unisa , but not if its going to affect my employability in any way...do you think employers care where you studied? Or do you think they just look for marks and degrees? Can you get into big law even as a unisa graduate?...I know Unisa is a great uni w some of the most hardworking people in the law field

      I know a person who studied at UNISA and got articles at a small firm. So focus on your marks and retaining the information/knowledge given to u at Uni.

      Focus on your marks and ensure that you are an "all rounder" , take up other activities ,such as participating in moots etc. Law firms don't just want a legal robot.

    Hi, thanks for the information. Do you have any information regarding, a situation where a candidate has served for more than 12 months of articles and resigned and went to start 6 months plt?

      I have never came around the said facts. But yes it is possible. Remember when you cede you are not cancelling the contract of articles but you are only replacing the other party, ie the principal. However, if you wanna enter into a different type of PVT you may cancel or abandon the current PVT (articles) and then enter into another one (law school). However, you must inform the LPC when you do that. **According to Rule 22.1.7 of the The South African Legal Practice Council Rules (as amended) [08 July 2018] If a practical vocational training course has been cancelled or abandoned before it has been completed, the court may in its discretion, on the application of the person who served under such contract, and subject to such conditions as the court may impose, order than for the purpose of the Act and these rules the whole or such part of the period served under such contract as the court deems fit, be added to any period served by that person under a practical vocational training contract or contract of service entered into after the first mentioned contract was cancelled or abandoned, and any period so added shall for purpose of the Act and these rules be deemed to have been served under the last mentioned contract and continuously with any period served there under.**

      Law School is also known as PLT according to the LPA. So I’m not sure which PLT are you referring to. If you are referring to Law School: According to the Legal Practice Act, you should serve articles for two years. Six months law school is proportional to one year articles. Therefore, if you do articles for a year and you thereafter do your law school for six months, you have met the requirement. The aim of this requirement is to ensure that you are in an undisturbed and uninterrupted training for two years (articles) or one and a half year (law school). Therefore, when you switch between articles and law school, ensure that you are not absent from law school or a law firm for period exceeding 30 working days. If you are referring to the PLT attended by candidates for four weeks: Kindly go through the Legal Practice Act. It states that people who attended law school don’t have to do the PLT short-course for candidates. But if you served articles for two years straight and didn’t attend law school, you will need to register and attend the PLT short-course for candidates during or after serving articles. It’s okay to do the course after the expiration of your two years articles. However, please note that the LPC will need an explanation if you only do your Attorney Admission Application a year after the expiration of your articles. Did I answer you?

      Yes, thanks, but my question was in relation to the 6 months plt and one year articles. But in this instance it's one year and resign to start 6 months plt. Visa versa to the normal order relating one year articles and 6 months PLT

      Okay. It's important that you are under supervision at all times during your training. Make sure you are not unsupervised, at a law firm or law school, for a period exceeding 30 working days. Kindly contact the LPC to confirm.
