    Kia ora Ehoa. I'm just wondering, regarding succession of whanau WHENUA. When a parent has passed away, and we as a collective siblings have agreed, can we establish a Papakainga / family estate & utilize the whenua under a Ahu trust?

    MLC has information on who is preferred as a Trustee, which is a good thing, & if you are that person their is a lot of mahi to be done where it specifically starts where you live, your foundation, your waka, well being, & old school generations need to get into the facts that physical well being is a must for whanau that indulge in too much kai, & long term medication intake, from my experience the Kaupapa in the caring of Kuia should be the responsibility of the female side of the whanau, not the male side. The raru research starts with the Colonisers & all that trouble they carried on their backs to dump it & program our Indigenous Tupuna who were originally educated beyond belief that the corruption of the Colonial Matrix System had attacked the entire Indigenous Communities all at the same time Worldwide during the 1800s. 👁️🕳️⚫️🌍🌎🌏👽☠️✨☮️

    We live in the dual jurisdiction of newzealand.com; usually trusts are legal entities subject to subordinate statutory regulation, scrutiny, interference and compulsory reporting, as opposed to the anonymity afforded by common law and customary prerogative; We only need lawyers if We are too lazy, ignorant , or incompetent to set up a trust, association, building society, or even a church and religious entity in a private venue; so some quality research and diligent study would go a long way to attaining the necessary knowledge power required to set up and operate a private common law trust over property; How would one distinguish the difference between the two jurisdictions?; Firstly, We need to overcome the conundrum of what and who are; natives are anyone born here on the land and from whatever extraction; tangatawhenua are the land (estates and interests therein) and have manawhenua; however Maori are persons, with the same diminished status as citizens, residents, immigrants, tourists and subject to Rule of Law; ‘Maori Land’ is property that has fallen under the foreign Land Information New Zealand Titles system; We don’t have to make the “identification” per their legal doctrine; We can have a “unique identity” with which We can interact; [Cf. Crimes Act 1961, s.9; Administration Act 1969, s.18; New Zealand Birth Certificate, BDM107, WARNING and Caution; Treaty of Waitangi Act 1975, s.2; Electoral Act 1993, s.215; Privacy Act 2020, principle 7, 13; Imperial Law Applications Act 1988, Schedule 1];

    Kiaora. All land is Maori customary land TTWMMLA 1993. Being independent aside from the government of whom created all ahu whenua portfolios operating under part 12, of ahu whenua portfolios, administrated by government created iwi. Adopting due process under part 13 of Maori incorporations is a correct direction towards the true owners within native hapu districts, completely independent from foreign jurisdiction., overseen by native territorial authority's. The six status of land change the status of land to Maori freehold by re vesting from general land title, this takes it out of government conveyancing and acquisition under the land transfer act 1952, which is the most powerful instrument in there armament. Next step in the right direction, establishing papa kaianga under Maori tikanga, opens the door to activate customary title to adopt preserve and protect these native hapu customs. Warning to the weary, once papa kaianga under customary land is established do not operate any form of conveyancing over this land to generate money for business or you will lose customary right to title., by crown acquisition to forfeit once native title back to general land for government conveyancing, on a footnote the next best thing to Maori customary land title, which is similar in nature is allodial title, instead banks offer every one general title, good luck whanau.

      That is the nature between customary land and general land.title as Papa kaianga is established then customary title applys to practice preserve and protect native papa kaianga, the whenua and the people under the LAW, and the Lore, I believe we are close to this application as I have been shown in the TTWMMLA the process briefly in its order and decoding the TeTure whenua from its codification as the book is written out for the native but it is designed to speak for crown pecuniary advantages, codification being used in the book to do with encumbrances licenses leases permits does not exist and never did under Tikanga, crown agents put it there as a trap knowing the native will use it and won't know the major implications associated with this, designed so the native can't find their way home in Lore, and Law, so close yet so far.

    I am one of the 98% of New Zealanders who don't understand the Maori language So when I hear that inconsideration I instantly switch off all sorts of media nowadays.

      When in Germany and asked what the official language of New Zealand is, my answer is English is no longer spoken in New zealand. It is Gibberish. Yesterday morning I left my whare to go to mahi. On the way there I dropped my tamariki off at school. Just after lunch the boss gathered all employees together for a korero. On the way home I stopped at the supermarket to buy some kai. The whanau were waiting for me when I got home and I could feel the aroha.

    its been 5 years since my partner passed away, i was his partner for 10 years and helped rise his two children. When he passed away we went to the lawyer to find out about his estate and was adviced at that time that all entitlements were mine upon my death or got married. after talking with his two older children i told them that we would make decision of what to do with any money and i left it up to them to talk with the lawyer. I understand that there was a big dividend paid out and i wasnt included. I am no longer on the death cerificate

      The government gave the Tuhoe people 25 million dollars. Within a short time the tribe was divided and they were bitterly fighting over it. Among other things, the critics among them said that the way the money was been managed was "too Pakeha". So again we see maori people who were continually bitching, the government gave them a shit load of money, they began fighting amongst themselves over it.......and put the blame on the Pakeha for the way the money was being managed.

    What if there is a will and the wife and deceased were separated for three years before his death and the deceased name has been removed from his estranged wife and she has signed the death certificate as the greaving ex, under a alias name and not the deceased name

      Good question @MissyB-M; we wonder, have the brethren been able to succeed to Mums shares at all?; these issues can be resolved by an affidavit authored by any authority (block trustees) that confirms and certifies that Mum is identified as that legal person; however, if the whanau know for sure that these 11 ‘also known as’ are Mum, then they can hold a Senior (Land) Court session and make witnessed voluntary declarations to that effect and issue their own orders to correct the official record, because common law courts are superior to subordinate statutory authorities when following conventional Rules [Cf. Senior Courts Act 2016; High Court Rules 2016; Imperial Law Applications Act 1988, Schedule 1; Reciprocal Enforcement of Judgments Act 1934];

    Trustees will become the new legal owners of the land, not the original owners who become the beneficiaries of the trust.

      The Ahu Whenua Trust is a Toxic entity, you have to give up the ownership of your shares to some trustees who only has 00.02 shares, they are the owners …of your shares now and they can do whatever they want with the income your shares generated … that sucks!!

    Why do you need lawyers to set up a trust? when the beneficiaries could nominate someone in their whanau who has Mana (Executor) an then workout who is smart and transparent with finance (trustees) so that way the beneficiaries know their money is going to work for them. The down side is if the Maori Land Trust becomes the Executor, they can put a stop on the trustees to pay (benefit) to the beneficiaries. Unenstinguish Native Title, the land can never be sold again.

    The Maori land courts is the same as a colonial system created to strip us from full control of our whenua (Maori oppresses) , this should be taught to rangatira in schools as a compulsory subject, so they don't have to seek when they get older, and have a focus in what they need to study which is of in importance for the future purpose

    My nana past and my mother and her brother have assumed charge over her estate in regards to land. Some of us kids and I are concerned about them being in charge as we feel they not only have spent most our life incarcerated but that there is maneuvering by other family that live similar lives to my mum and uncle. Can I or other cousins take steps to safe guard our own part of our nanas legacy. Or are we at my mother and uncles mercy?

      Was there a Will? If not, you're probably not gonna be able to do much. But somewhere down the road, someone will need to go to Court. That means you can/should attend and tell the judge ur concerns
