30 days is still not enough time. 18 months probation is not enough. I like this judge, but i think he needed to humanize the victim more. The deceased is not just a dead body. This was a human being who had a life, loved ones, and friends. So, 30 days with18 months probation just doesn't cut it. If your county leads in the number of deaths by DUIs, then dont tolerate it on any level. Show the public you mean business. 30 days is nothing and just shows other drunks that you can get away with it.

I think she should have visits with CPS weekly to make sure the child is safe. Obviously, she doesn't care about the child. I understand accidents happen, but the damage done to the unborn child is unforgivable.

You can tell how unhappy he is that they couldn't prove the higher charge. I really hope she does stay off drugs, alcohol not just for her but for her child. She has already done enough damage to that child.

I had a single dwi and its the only thing ive ever been charged with.... i got six month jail, 3 years misdemeanor probation, around 12 grand in fines, and 13 hundred for a lawyer plus i lost my license for three years.... and i deserved every single bit of it.... i could have taken the lives of so many people.... it was also the very thing that started me on the road to recovery now i fight to help addicts get the help they need and to better themselves and i have 8 years clean!!! Ive gotten to meet the officers that arrested me and judge sears that gave me that sentence and personally thank them for saving my life..... not every addict you see will stay an active addict.... not all who wander are lost forever...

Am I an Idiot here or is 0.025% BAC less than one third the legal driving limit of 0.08% in Texas? Lady is so FAT I'm not surprised she can handle a few twisted teas. Also I hear them saying she had beer in the car but was it an open container or not? I could't quite make that out but if it was an UN-opened container of beer and her BAC was well under the legal limit to drive, and if they were unable to perform half of the field sobriety tests because of her injuries from the accident.... If those things are true, then all they have is the drugs that showed up on the blood test. Of course taking drugs is bad and illegal but is there any way for the blood test to determine if the driver was actually high at the time of the crash? This is where it would have helped so much if they were able to conduct a full field sobriety test, again, her injuries prevented that. What if she hadn't used any drugs for a day or two and the drugs still shows up in the blood test as they do? Now I understand why the charges are so low in this one, not to mention the inevitability of the crash based on the crash scene investigation. You can all agree to disagree with me but even though I HATE people who drive impaired, I'm not sure they have enough solid probable cause to give her the long sentence that she probably deserves. That being said, she is a total scumbag because she's about to crap out a crack baby which makes her a horrible human being. If it was up to me, I would lock her up for 20 years for taking cocaine while pregnant!
