    Really need to be careful of so called "elders" or "seniors" who are very healthy able bodied people that will abuse the system. A Senior can claim elder abuse as a way to scam money into their own pockets.

    First off great videos very helpful. What happens when you transfer money from joint account to a spouses solo brokerage account and they pass with TOD/beneficiaries receiving the funds? Now the living spouse needs Medicaid a year later. How the the 5 year look back be effected? I checked all your vids and couldn't find.

    The other thing is in order to keep someone in a nursing home, which is the highest level of care after they plateau on rehab. If they don’t qualify, the federal and state government will not pay for their stay. If even if they have Medicaid, there is so much more that is not being covered in this video, and I don’t think it’s very fair.

    Another thing is if they are no longer progressing and Medicare is not going to pay for it they do not have a payer source. So the cost of a long-term care bed is approximately $11,000 a day. We would need to know what the persons assets are, and a bunch of other stuff. If somebody is discharging to the hospital, it is because number one there are not covered under Medicare any longer because they are not progressing and we don’t have the financial part of it. So if you’re a lawyer, you are going to take every single client just because oh wow they really need our help but we’re not gonna get paid. There is a lot of more reasons than you are stating to. And to tell people to go and file a complaint Without telling them the other plethora of reasons that we might not be able to take that resident back. There are horrible, horrible care facilities in my industry, but there’s also a very good one, and you are not telling the whole story.

    Hello I just came across your video and I would love to speak to you further about some things families can actually do to avoid granny dumping and I have been in the long-term care geriatric industry for almost 28 years. I have my degree in geriatrics and healthcare management, along with my specialty and Alzheimer’s dementia care. I have worked as Director of social services, and an omission in a long-term care facility for more than 20 years of my life, and some of the things that you were saying is correct but not in many instances. I would love to sit down and talk to you so much because being in the industry, I can absolutely explain to you the resources and even know Medicare pays for up to 100 days they are not guaranteed and Medicare only kicks in when they are doing rehab. The first one through day 21 Medicare covers completely. 21 through up to 100 which again is not guaranteed. They have to show that they are making improvement in the therapy or Medicare will make us take them off of therapy. So if you do have a loved one in a facility that can absolutely use the whole hundred days and it would be very beneficial. Medicare pays for 80% of 21. through 100 is paid by the secondary insurance if they have one. We do not get paid a higher rate for any days from one to 100 if they don’t have a secondary insurance and they are not safe to go home and they qualify that’s when we would admit them into a long-term care bed. And then The facility will make them Medicaid pending, which now we are not getting paid right away but as soon as the Medicaid kicks in, we get that money back for the patients. The other thing is Medicaid has they’re open criteria for someone who will qualify for Medicaid. I am not saying that some horrible nursing homes in the Times may do that, but if they can no longer take any Medicaid pending patient, or they are still under Medicaid at whatever rate they are and they don’t have a A Medicare Bed available we cannot put them into a long-term care bed. I’ll just hope this helps from someone who has been in social services in a nursing home for many years. Also is on the billing and helped families qualify and get their parents or grandparents or whoever their loved one is through the Medicaid process. So I don’t doubt that there are some facilities that are unable to take the patient back because we would never get paid for them. I understand that that is a horrible thing to say but also every part of the industry is a money making industry as much as everyone else’s is. If we were to do And I’m safe discharge. We could get very much sued. The other thing is I was the admissions Director for a very long time as well and no matter if it was Monday through Friday or the weekend I was the one on call so I was the regular admissions person. I would love to be able to sit down and to explain to your viewers why sometimes it may happen, but also looking at what a facility is dealing with. I don’t necessarily think that it is a higher rate of Medicare because we don’t get paid a higher percent of Medicare or a lower rate Medicare will pay 80% and the secondary insurance. If they don’t have one we will go after Medicaid pending. So there is a lot more to that than what meets the eye, so I would love to sit down and do a video and maybe help the family I understand the requirements and everything that we have to look at.

    I have questions. I've had a suspicion that there's a fake guardianship of me . I applied for ssi years ago. I lived with a friend who wanted to date me and bc I wouldn't he provoked me constantly. He even told my Dr's he was my guardian. This was false yet they allowed hippa violations over and over again. He even knew my attorneys and they deliberately misrepresented me as being disability attorneys what they really were were guardian ad litem and divorce attorney. This is extremely corrupt. I suspect my mom was involved. I'm 51, and my son and I have been trafficked through 3 states , we were forced to live in poverty and abuse and my Healthcare was chosen for me and my treatment aa well , I was denied care for my neck pain for over 3 years and when I finally got to see a neurosurgeon within a month had multilevel cervical spine replacement surgery. I've been harmed not helped . There's been no advocacy til now and we are in safe housing. I'm still on a quest to find every corruptor involved it's very hard when it's the justice system that fails you . I was never told or even asked or ever appeared or ever relinquished my rights . As I'd never give a jealous roommate power over me or my child and I'd never allow my mom to control me from another state making poor choices for us. It's a clear abuse of power as she is a retired court reporter and we ate estranged. I really don't care about a court reporters or exes opinion of my disability that a neurosurgeon gave me. Yet , I'm being needlessly harassed and stalked as these ppl refuse to give up these abuses , yet they were not legally given a right to control us. I mean I haven't been able to get testing proving my disability still exists , I did finally ger ssi , and my mom kept saying you don't qualify, I didn't speak to her for months bc she hadn't seen me and had no idea if I qualified or not she was just bent on me not having any form of independence. I believe she stole my inheritance or settlement or something. I finally told her to stop interfering that I Def qualified and she laughed and blocked me , she didn't even tell me my stepfather of 40 years passed last month. I found out by researching fake court cases involving us and finding his obituary. How would this cruelty be acceptable , on any level ever? How do I prove the corruption when they seal the documents in civil Court in order to hide the truth from me ? How can I stop this malice against me as well aa false investigation. Aa I've begged my Dr for 4 months now fot referrals , and I haven't been able to get them. So after 5 months I'm being reviewed and it's going to make me seem noncompliant, which males me look bad and is also a bold faced lie. I've always been into my Healthcare im.in severe pain. I can't fight all these corruptions as it takes me a bit to catch on before researching yet another conflict of interest ot someone who Is profiting off of us. I want to fight back. We are not the only victims

    I appreciate this explanation of the law. It can become difficult if a patient has additional needs for Subacute rehabs as there must be a 60-day break between rehab admissions to reset the 100-day clock, thus to run the time to the max may be a barrier for a subsequent need for rehab. It is depends on the situation.

      We appealed twice and were denied for my mom's continued stay in a skilled nursing facility. We are scheduled for an ALJ hearing this coming week. Thankfully, we were able to private pay for the remainder of the month her coverage was terminated. We were able to get my mom back on Original Medicare the first of the following month after disenrolling from her advantage plan. We learned our lesson to never enroll in an advantage plan ever again. They deny care not based on Medicare coverage rules, but on algorithms and internal coverage criteria. Also, a skilled nursing facility resident qualifies for a special enrollment period where they can switch back to Original Medicare while they are a resident and for 2 months after leaving a skilled nursing facility.

      It is an exempt asset for Medicaid qualification so as long as you are only taking minimum distributions, it would not have to be liquidated in order to qualify for Medicaid long-term care.

    Hello! My mother is in skilled nursing right now. We just got her discharge notice she is supposed to be discharged Saturday August 18, 2023. The 20th day was yesterday. I called the number on the discharge notice and started the first appeal just now. I tried calling your office to see if you could help us, but they said you don’t handle these. we are in California is it necessary to have a California bar attorney or is it possible that you or someone else can help us with this in any state?

    How about they wanna accuse family members of taking savanna just where they can put them in the guardianship where they can take over the assets how about in that case where they don’t let the family members take care of the loved ones or what if they have power of attorney, and the court wants to take over the rasins, so they suspend the power of attorney specially, when that person’s done nothing wrong, seems, not write any legal. How did they get away with? It seems corrupt me.

    I am hearing the transfer is "upon death" of the parent. What if parent has exceeded the five year Medicaid look back period and is then in a nursing home for the next many years? Both remaindermen live in other states. Does the property just remain empty until death necessitating utility bills needing to be paid, upkeep on the lawn/snow shoveling in winter? This could present an awful problem.

    #1👍🤔My 91 year old mom bought a nursing home policy. I won't let her use it as long as she can be home with me. Don't dump your senior on medicaid!! It is lazy!!
