LECRETIA SEALES MEMORIAL LECTURE IN LAW REFORM— 'Reforming New Zealand's Legal Infrastructure'
The Lecretia Seales Memorial Lecture is given in honour of lawyer and law reform advocate Lecretia Seales.
The 2024 lecture was recently delivered by the Hon Christopher Finlayson who drew on his extensive experience as a lawyer and Cabinet Minister to argue that New Zealand needs to invest not only in its physical infrastructure, but in its legal infrastructure as well.

    I think that this series needs to be followed up with a post-script because the legal fallout from the lock-down has not concluded for those caught up in it. You noted the failure to consider Maori and the Treaty of Waitangi. One element of this consideration was the ban on hunting and the gathering of food resources. Although if is often pointed out that Maori are predominantly living in urban areas today, this overlooks the fact that Maori are significantly over-represented in minor urban areas and in many cases still call rural areas home. The issue of hunting also applied to the wider rural sector, with Federated Farmers advising members they could engage in pest control on their property when the Prime Minister was saying hunting was banned. This confusion has led to real-world consequences with people losing their firearms licences and having a permanent stain on their record as a result. There will also be the issue of losses incurred during the lock-down and also issues around liquidation and recovery of debts. As you point out the picture away from Lampton Quay is very different, the legal fallout for some sections of our community will continue for much longer than some other sections.

    When the media is told to 'disregard' any other truth & media is censored what choice is there? They told us stay home save lives - but it seems the virus wasn't as bad as what they claimed. Only eldery are severly effected (as per usual) Now they have $200b of our money & tell us to stand in a line - even though we all use the same doorhandle & pinpad...

      We were lucky, overseas people of all ages havr been affected. Doctors and nurses have died - they are not all elderly. If more of us had died would you complain not enough had been done? Be happy you are alive to bitch, overreaction turned out better than the prevarication and delayed response in the UK and USA.

    I guess I had a different expectation going into this mock arbitration. I thought that the arbitrator was going to hear the conflict, and arbitrate. Instead this sounded like an argument over the arbitration itself. This just doesn't sound right. I think the arbitration itself is adversarial--but the agreement to use arbitration has to be consensual. So that part of the process was (I expected, naive me) "negotiation", not argumentation.

    I don't get it--why does someone have to go into arbitration when one does not like the arbitrators? Isn't there some process for that? Can't the party just walk out of the arbitration at the beginning, since it has not really even started yet?

      The parties agree to arbitrate on disputes beforehand, therefore, the arbitration agreement is a enforceable contract in itself, if a party were to "walk out" it would constitute a breach of contract, and it would be liable to pay damages.

    Gee...I would hate to go into arbitration, and immediately find myself in a conflict about the arbitration itself. If I were the other party, I would say "shall we just forget this, and try again later in some other venue?"

    WAIT! So the parties agreed to binding arbitration--and THEN they decided that the arbitrators are not partial? Then why are they doing arbitration?

      Andy Christie well as far as I know there are different methods of choosing the arbitrators. Each party may choose one and then between these two , the president of the tribunal is chosen; or they all maybe chosen by consensual agreement. Regardless of this , the arbitrators have to meet the requirements laid out on the IBA guidelines for conflicts of interest which you can find online. Therefore, if for any reason they don't meet the criteria of independence and impartiality they may be recused. However, this doesn't affect the arbitration process as another arbitrator will substitute the one who has been deemed dependent of a party or partial to a party or to the subject matter at hand.
