SA Allegations in the UCMJ - Cody Harnish Explains
Here's what they don't tell you about sexual assault allegations in the military.
Facing this type of allegation is life changing.
The process is stacked against you.
CID, NCIS, OSI, they are all trained to believe the alleged victim and to obtain evidence against
you, not obtain evidence to seek the truth, but to prove the allegations.
When you tell them your side of the story, they're not going to believe you. They're going to confront you, and then they're going to ask you to take a polygraph test.
But guess what?
They did not ask the alleged victim to take a polygraph test, and they never will.
Second, even if you're cleared of the charges, the damage is not done yet.
Sexual assault allegations can lead to administrative separation actions like boards and reprimands.
This means your career is still at risk.
Even if CID and the JAGs are like. Well, there's not enough evidence to prosecute.
And when they realize that it's a crock, they still take it to an administrative separation board because instead of a reasonable doubt.
Now they're going to try to kick you out with a preponderance of the evidence standard.
It's easier for them.
It's going to be a long process.
Might even be a year - year and a half - until you have a resolution.
So remember, it's a marathon, not a sprint.
Take care of yourself.
Take care of your mental health and protect your legal rights.
Don't lose faith.
Remember, you didn't do it.
And even if your military career is over as a result of an allegation, your life will not be.
And you will absolutely be okay.

Mililtary Protective Orders - UCMJ Lawyer Cody Harnish Shares Insights
มุมมอง 113หลายเดือนก่อน
Think a military protective order is just like a civilian restraining order. Wrong. It can last indefinitely and keep you away from your family. I'm Cody Harnish, UCMJ attorney. You see, unlike civilian restraining orders, which require a court hearing, military protective orders or MPOs are issued at the discretion of your commander, and they can last indefinitely. Meaning like forever. No tri...

มุมมอง 1942 หลายเดือนก่อน
Can you refuse an order in the military? Yes, you can. Wait, wait. Don't go do it yet. Let me break it down. I'm Cody Harnish, UCMJ attorney. Let's talk about what makes an order lawful, what makes it unlawful, and what happens if you get it wrong? Day in My Office Life - Cody Harnish - Criminal Defense Attorney
มุมมอง 352 หลายเดือนก่อน
Another day in the life of a criminal defense attorney. Today I'm advocating for my client who's been accused of sexual harassment and what do you know? According to the regulations and even the facts, he didn't commit it. But that didn't stop the army from giving him a Gomar and an administrative separation board. And what was interesting is in my legal review of the facts and their legal anal...

Lol you think Gina wanted to frame Bobby for something ?
Bro you need to make more videos like this you are saving lives for real
I'm shockingly surprised that these videos don't have millions of views. This would be an excellent campaign talking point.
What if it is looking in places they shouldn’t? For me our gym teacher makes us do exercises and looks at us in inappropriate ways. Also boys in my class look at girls when they wear things. Does that count?
Terry Forge
Can you help me get an upgrade ?
Thank you! Lot of crazy ex's put there
I just enlisted and my biggest fear now is being dishonorably discharged even though I am not guilty of any crime
Does general under honorable conditions qualify for gi bill?
❤
My attorney was like: attorney who? You do all the leg work for me, then I’ll stand in the court room with you and represent you on the day of court 🤣 idek what he looks like; I think he looks like this but not sure: 👻”
Update: it was over 14 hours. 💀
Who is fighting for the victims of America’s Defenders?
I'd love to see someone try to pull that constitutional audit crap on a first sergeant.
Hahahahaha! Not quite. 100% search of everything in the barracks, with everything unlocked. Yes, you can say, "no, you can't search my locked wardrobe, which the government owns." Then, they'll come cut the lock, and you'll get in trouble for disobeying a lawful order.
All constitutional rights apply to service members.
Yea not going to say no to a first sgt
Hey boss does this include if a drill sergeant asks for a personal belonging such as say a shaker cup? I just got ucmj because a drill sergeant asked me to open and sip my “water” and it was alcohol. Would like some help with this situation I blew a 0.0 in a breathalyzer btw if that helps
CID is not going to like this 😳
anyone have information about trying to upgrade a RE code 4 into a code 3
What’s the total cost for a discharge upgrade
Like many rights, using it doesn't mean you're free from all consequences, just legal consequences. For example, I know an Army Major who was soft denied promotion due to invoking his rights (refused a breathalyzer when there wasn't cause)
Lmao you cannot expect people believe in something while other breaks rules. Even animals know this. Of law doesn’t apply to all it doesn’t apply non. EA639
Military doesn’t give a fuck about privacies or laws. You become property, you lose all your rights
LTC Tulsi Gabbard called President Joe Biden insane in a video in her channel. She criticizes Biden as not fit for duty every week. How is she getting away with it? I want to make a TH-cam channel about social, cultural and political commentary but I feel i would be charged under article 88. Can you explain to me how is she allowed?
just dont do drugs ... that works to my man .
Uniform Code of Marsupial Justice = UCMJ. nuff said.
What if I ETS before my Admin Board?
What a joke. The US military deserves lots of criticism, enrolling to defend a Constitutional right by giving it up seems incredibly dumb
Ok I got my DD214 from the VA archive department. In line 24 Character of Service it says “UNCHARACTIZED” ?????? But I also got a Fomat500 from my reserve that says Honorable Discharge. Do I have the Ability to get VA benefits???
hey man, just stumbled on this. I’m wanting to go the same route, however I’m in my final year of undergrad and want to join w/o my JD and become a JAG. any advice?
How do you expect to be a lawyer without going to law school
Just make her sign an NDA prior
I'm confused on this video and two others that seem conflicting. On one video you said that a service member may be njp by just a probable cause (20% or less), this video you state that the burden of proof at an article 15, "51% more than likely that you did it", on the other video you state that a commander can't punish on an article 15 / njp unless evidence prove beyond reasonable doubt (95% and up) which states on block 2 of DA 2627. I'm a bit confused on the burden of proof on an article 15 / njp with these 3 video. You can get NJP for just probable cause or proponderance of evidence? But punish only by beyond reasonable doubt? But if choose to proceed with njp you will most likely be found guilty, so this tells me that a commander during the njp will just deliberately categorize the evidence from probable cause to beyond reasonable doubt somehow in order for him to be able to sign that 2627 form and punish the service member and call it a win for the commander. Can this abuse of the commander's authority play out this way?
In July of 2023, the President signed an executive order that changed the burden of proof for Article 15, and those changes went into effect in Dec 2023. Block 2 used to state "Beyond a Reasonable Doubt." But now it states "preponderance." My video discussing Beyond a Reasonable Doubt at NJP (Article 15) was before the change in the law. Lastly, yes, Probable Cause might initiate the Article 15 process, but it is not supposed to be the standard to be found guilty at an Article 15 . . . sadly, the commanders at an Art 15 do not understand the law or the burden of proof anyways. That is why if you elect to go through with the Article 15 process, you should expect to be found guilty at the Article 15/NJP.
He's awesome. I'm definitely interested for him to represent me.
What about MP investigation?
What if charges on the titling page don’t match of what Soldier was charged with? Or at least UCMJ article doesn’t match with accusation
Were you ever arrested, charged or probable cause hearing. What's your branch
Thank you. Where can I find the information that needs to be included in a character letter?
My other site, GOMOR.com, has free templates, including character letters.
Its business law. Military is enacts as a Business in the Feds, so due to Business Law, the nature of Service Members are like Employees to commit to a Employment Contract. That also revokes Civilian Rights to receive a Jury. Contextualization is important
I could see myself doing this
Being 28 and finding out you have MS
My name is Jodie and i just found out about this. Like wtf man why my name gotta be tied to cheaters
What if the military wife has an adulterous affair with a civilian Jody? Can the civilian Jody be held accountable somehow?
Do you represent Illinois? I'm in the Army.
I represent all over the nation and world, as long as it’s a military matter.
Ive heard attorney's using cellbite and cellhawk. Can you not use them in your defense?
Promo*SM
Have you heard of the sommers v. California case? Could they reopen the case and find his killer? "Supposedly is wasn't his wife who murdered him"
… so you’re an attorney
Can you handle the truth?
Hi could you create a video explaining what steps you took to reach the position you have today?? Currently working on my BA with plans to go to law school
That sounds awful
