Crazy you can spend several thousand taking care of a parent, have to pass all the rules...just to get a $500 deduction. If you pass the rules...should be able to deduct all that you spent...or at least 80-90%. There are rules on what you have to report in income and if you meet the rules...you have to report 100% and pay taxes on it. Well...the reverse should be the rule.
it’s pretty bad there has to be a law requiring children to take care of their parents. In most civilized countries family just automatically take care of their elders just because it’s the right thing to do but Americans need a law to tell them cause they don’t want to do the right thing. really sad.

I’ve been thinking about setting up a trust for my family, but I’m confused about which assets should stay out of it. I don’t want to make any costly mistakes
A common mistake is including retirement accounts like 401(k)s or IRAs in your trust. If you do, it can trigger a massive tax bill because those accounts have specific rules for beneficiaries. It’s better to designate beneficiaries directly through the account itself.
Yes, retirement accounts are tricky. Another thing to avoid is putting jointly owned property in a trust. If it’s already set to transfer automatically to the co-owner when you pass, adding it to a trust can create unnecessary legal issues.

Sorry, for the late response. To answer your question, yes an executor of the estate can still purchase homeowners insurance for the property after the homeowner has passed.

i am 71 single retired worth around 50 mil i retired around12 years ago i also bought myself a private jet and a small winery in italy,i have one daughter whom i have not spoken to or seen in over 30 years. however she found out i sold all my farms in calif almost 7500 acres. she got a hold of a attorney and said she wanted her inheritance asap i told her attorney she is not in the trust it says i am not providing for her or her husband whom i have never met her mother also got into the act lol who has been remarried for over35 years,she lost in court and she had to pay my attornies fees so i have moved for good to italy5 years ago just so they could not ever find me again, i have also changed my citizenship. so she got t a hold of my attorney a while back demanding to know where iw as, he said i think he moved to nigeria but he was not sure, my new problem is i have no one to leave things and money too, i have dated a few ladies over here but if they have kids im not interested in more problems, they have no clue what i am worth.i drive old 1935 fords but with modern engines and interiors and look nice. my new trust in italy is a revocable trust.and my daughter is not to be notified on my passing, after changing my citizenship i was informed that i can not comeback to the u.s. which is fine epically now i love it here. my question is what do i do with the estate and money? im not into religion so not interested in leaving it to any church, any i deas?

Exception: your only heir is qualified as a "special needs" person. Then create the trust as a 'special needs trust' and put the IRA or other retirement funds into it. The tax rate is then only applied to the earnings from those funds, not the full amount of the funds.

If holographic Wills are legal in Southern California, why are they so difficult to prove in court if it was signed by the deceased person ? Everybody thinks it's fraudulent when it's not .. Toward the end of the video, you stated that the name is changeable because it is a revocable trust. Would that also require us to have all of our assets retitled to the name change and maybe trigger a taxable event?

When I was in Alabama this was something conservative radio was always complaining about. Radio personalities kept talking about the unfairness if it all. And so many regular folks kept agreeing, not understanding that estate tax only applies to those who will leave a huge chunk of money. And it is only fair. Folks should not get a head start on the efforts of mom and dad. That's the conservative way.
The attorney who created my revocable living trust years ago is older than I am and his office is a long drive from my home. I will call him Andy. I am thinking of up-dating my trust & will. If I find a new trust attorney near me-what next? I have a copy of the trust which I last updated in 2014. Do I just give him that copy and tell him what changes I want made? Do I have to contact my present attorney-"Andy"? Or does the NEW attorney do that? Or is that even necessary?
Thanks for reaching out to us, ma'am! You have a few options to go with! You can either contact Andy (original attorney) or you can secure a new attorney to do a Trust Review. It's not necessary to include the original attorney since you have a copy of the Trust.

hi, thanks for your helpful video.If I only want to change the TRUST name, and I Have the word document from the lawyer who made our trust,can I just edit the TRUST name, print it out, sign them and change all the assets to that new revocation trust name?I don't see why I need to hire a lawyer to just get this simple step done. @LeilaniClaire The crazy part is that those advisors are probably outperforming the market and raising good returns but some are charging fees over fees that drain your portfolio. Is this the case with yours too?

My sister left me as beneficiary on her Vanguard traditional retirement account. But she owed Medical and care home expenses.....is it protected because she named me as the beneficiary or will they take that money?
If the deceased died in Florida with a Florida IRA account it should be protected. Although check with the IRA custodian. If the deceased died in another state check with an #EstatePlanningAttorney in that state.
For a jointly held bank account, it it better to add the trust as a beneficiary or add the children directly as beneficiaries? Or does it not matter if it is a straightforward trust that goes to the kids anyway?
