    Can you file a lawsuit on companies setting a trap for you to pay that bond when they did not deliver proper communications upon resignation? Let's say you sent a resignation stating your request for an "immediate resignation" due to health issue. Which means you have requested for an approval to not render the 30 days with your supervisor even stating that she will ask for an approval first, and then later get their exit letter stating to return all assets within a period of time without stating to render the 30 days. Then later you find yourself having to pay a bond.

    Sir panu pag ganito ang senaryo po. Sa regular hour namn is 10 hour. 7 to 5 ang pasok kasi ung sabado wala kaming pasok kaya naging 7 to 5 dahil nga sa sabado na walang pasok at pati linggo. Ngaun po ung sa 7 to 5 pag nag ot ka pa. Ng 2.5 hours . Babayaran kalang po ng 75 pesos. Pag naka pag 5 hours ka ang bayad namn po is 150 .     Atty pakilinaw lang po para maunawaan ng maigi na mga HR Managers na nanunuod po sa inyo. Sa aming Company, kapag hindi kami pinapasok ng Reg Holiday ay walang dagdag na 1 day pay dahil bayad na daw kami sa Basic as a Monthly Paid Employees. Now, kung pumasok kami ng Reg Holiday ay babayaran lang kami ng additional na 1 day dahil bayad na daw kami sa basic at andoon na ang 100% sa Basic namin kaya yon na daw 200% na nakasaad sa Labor Code. Kapag pumasok kami ng Special Holidays ay babayaran lang kami ng 50% dahil ang 100% ay nandoon na daw sa basic.

    Atty may follow-up question ako regarding OT. Doon sa Company na kung saan ako'y nagwo-work, kaming mga monthly paid employees sa Office ay minsan pinapa-overtime dahil need sa trabaho to meet the deadlines. Ang nangyayari kapag pumapasok kami ng whole day during holiday ay babayaran na lang kami ng 30% doon sa araw ng holiday na yon, dahil bayad na daw kami doon sa basic namin as a monthly paid employees. Karamihan sa amin ay hindi na lang pumasok sa panahon ng Holidays dahil 30% lang ang ibabayad sa amin at talo kami sa pamasahi kapag pumasok kami. Gugustuhin na lang namin na mamahinga sa araw ng Holidays kesa papasok, total bayad na kami sa basic namin kahit hindi pumasok. Kaya iniisip namin na there is something wrong with the interpretations doon sa provisions ng Labor Code regarding OT pay of a monthly paid employees that falls during holidays, na ini-interprete ng HR namin. Sana maliwanagan nyo kami at maraming Company na kagaya na rin ng Company namin na ganoon rin ang interpretaion nila sa Labor Code. Sana magawaan mo ng Content itong tanong ko para maliwanagan din ang mga HR Managers na manood nitong Channel mo. Maraming salamat po.

    Good evening po, Atty., ask ko lang po, sa resto po kasi ako nagwowork, may plano po kasi yung company namin na i-transfer ako ng ibang store, pero yung store hindi po sya stand-alone restaurant kundi foodhall po sya, meaning yung service charge po na makukuha ko ay less kesa sa natatanggap ko po ngayon. Sa dami ng expenses ko ngayon lalo po akong magigipit kung maasign ako dun sa foodhall. Di po ba ako makakasuhan ng insubordination kung tatanggi akong matransfer?

    3:46 atty. tanong k lng po nag kuha ako ng coe ng kapatid k sa company n pinag tatrabahuan nya kaso ibang address ang binigay at ibang company ang nka lagay samatala po n d nmn yn ang company n nag aasikaso sa kapatid k nung cya ay nadisgrasya at nawala po cya ano po b ang gagawin k po dto atty.

    Hello Atty. ! New here po sa channel nyo po, ask ko lang po 6 months na po pero until now wala parin pong update for regularization. yung kasama ko 5 days before 6 months nya may contract na po sya for regularization. Ask ko lang po, yung rate po kaya na for regular ganun din po kaya rate ko kahit po wala pa po akong napipirmahan na contract? sana masagot nyo po, thank you atty.

    Sa amin pong company attorney.. Nun 537 palang minimum at kami po ay above minimum na dahil sa merit increase. Noong nagbigay ng 33 peso increase ang gobyerno naungusan kami ng mga minimum wage na mga baguhan.. Ang ginawa ng company namen ipinantay lang kami sa bagong minimum wage. Nasayang po ung ilang taong pinaghirapan namen sa merit increase kasi kami po ay bumalik lang sa minimum wage.. Gang ngayun po. 6yrs sa company at newly hired ay pareho lang ang sahud.. Kaya nadedemoralized ang mga empleyado kung kailangan paba nila magsipag sa trabaho para sa annual merit increase kung yung pinaghirapan nila ay mauuwe lang sa wala at ipapantay uli sa minimum kung sakaling dagdagan ulit ang minimum ng NCR. 😢

    If the employer decided to get the resignaton effective immediately, wikl the employee still recieve thier last pay or seperation pay?

    Sir ask lang pano po ung sakn sa DOH po nag work as an encoder tapos nag end na po item ko sa kanila nang hihinge po coe mag 1week na po wala pa din coe na kukuhain ko sa kanila ano mga dapat ko gawin salamat po sa sagot

Tanong ko lang po kung ano Ang magandang Gawin po kasi nagtrabaho po kami sa PSA po 2 months contract lang po ,pero Hindi po maayos Ang pasahod nila at Ang pagbigay po sa travel expenses po Namin kaya hingi Ng hingi po kami Ng payslip po para malaman Namin kung Tama po ba talaga Ang pasahod nila pero di po nila kami pinapansin po .

    Bakit po Kaya ayaw akonbigyan Ng COE,,, truck driver po Kasi Ako,,at per trip basis Kaya wala akong benefits at mag voluntary resign po ako,,,ngayona yaw po ako bigyan mg COE...Anu maganda Gawin sir atty.?
