    Czy jak minelo 3.5 roku od wypadku i mam konsekwencje zdrowotne do tej pory (uszkodzony kręgosłup). Mam badania lekarskie porwierdajace uszkodzenie kregoskupa oraz mam protokół to moge dalej cos z tym zrobić ? Nie zglosilem tego ze strachu bo prwcowalem tam jeszcze okolo 1.5 roku. Do tej pory borykam sie z problemami i bolem związanymi z wypadkiem i chcialbym cos z tym zrobić. Czy nie jest juz za pozno ?:(

    Thanks for the information because when I was injured at work in 1997 I was working at a fast food restaurant called jucy Lucy's in ocqla the restaurant got robbed and I was hit in the head 14 times I did not know about workman comp so I went to the hospital and the doctor said I got a hard head and my employer at that time did not tell me about workman comp then thanks to your video I know now

    Funny how they can't understand 50/50 when a judge determines that. That means they pay 50 percent back to workman's comp afterwards but they're too cheap to acknowledge what the judge says.

    More evidence that Florida is a shjtty state for employees. There should only be one test for this scenario: Was attendance mandatory? That includes non-participation ‘opportunity penalties’ if the attendance is not mandatory.

    Why does California not that a penalty for medical mileage reimbursement. I sent my in via email, which got sent out October 9, and on October 29 I asked for a stop payment and got no reply and now it’s November 7th and I got an email saying “would you like us to make a stop payment and reissue? Like almost a month goes by? Thats insane.

    Hi, l am a FL resident. I was working when I fall from a ladder and I injured my dominant arm shoulder. I had a rotator cuff surgery and still receiving therapy, l still can’t fully lift my arm. l returned to light duty work with restrictions and only part time. Now , they scheduled a mediation meeting and possibly to offer a settlement though l don’t know the rating percentage of my disability. I do only manual work for living. How much do think they may offer? and is it possible to settle without evaluating my disability?

    Hi. If I been off work since December of last year. for this year at the end of the year do I get paid my personal days and vacation time or that gets paid once I settle the case or i loose those benefits?

      Thank you for reaching out. That’s really a question for a labor/employment attorney rather than a work comp attorney but I believe you’ll be paid any accrued PTO when your case settles and your employment ends. You can certainly demand that. Be well.

    I didn’t know of your law firm when I got injured and had work comp. I did get an attorney and it was far more beneficial than I thought. When it came to settling my case, turns out there were back wages that I didn’t even know about that the insurance company was withholding, almost $6000 over the course of April to August. THEN the actual settlement, we negotiated for almost double what my attorney thought they’d offer. The insurance company just wanted to pay back wages and call it a day but my attorney saw through that and now when that check comes, I’ll be far better off. Not only that but I don’t think I had to cut him any fees because the other party was somehow responsible for his lawyer fees and everything. Either way, they don’t take much for the work and compensation you win.

    Strange the worker's comp judge approved my surgery now the employer's insurance carrier filed an appeal to not have the surgery, and to my knowledge the judge's decision is 90% solid so I'm having surgery they say they will not pay but surgery is needed so I can on with my life. We will deal with the who is paying thing later.

      Had the surgery acdf 4 level anf pcdf 4 level, and on the road to healing, the insurance company is still saying they would not pay and their appeal is still there, and social security just gave a judgemnt that i'm permanently disabled, leaving everything up to the attorney and focused on getting healed.

    I see people jump on comments saying "i broke my arm two weeks ago,,whats it worth"... I think ...poor guy ,,he doesn't know that theres so many factors that its an impossible question to answer,,and he doesnt understand yet that they dont want to pay a penny ,,and sometimes it takes years !!!.. be prepared to lose everything you own,,get on welfare,,and have surveillance teams watch you !!.. especially if you have a career ending injury!!.. they will fight you to the bitter end !!!.. they are about making money ..not paying ....if your new to workmans compensation..GOOD LUCK !! if you have a complex case ,,its even worse !!.. im in it ..two years,,no income ,,still need surgery!!.. they really hope you just drop dead while they deny and stall tactic you to poverty !!

      This is happening to me too. The insurance has send gang stalkers to harass me. The doctors has put chips in my body. The attorney withdrew just because he asked me we close the case and I declined. Was paid temporary disability for only 6 months and that was it. The case is on trial stage don’t have an attorney and I seriously need one. My phone is hacked . I live in San Diego,CA. I pray to God one day I shall get the justice . Please advise

      In FL work comp cases, this is not something you are compensated for. The closest thing that exists is payment of permanent total disability if you cannot work even a sit down job within 50 miles of where you live once you’ve reached MMI.

    I keep hearing that 99% of cases settle. I’ve been dealing with an SI joint issue and found more problems with my X-rays last week that my chiro found and my work comp doctor wouldn’t even look at. He just wanted me to get the injection that took 5 months to approve. It’s been almost 9 months and I’m curious why they are not trying to get rid of me? The mental and emotional toll this had taken on me is crazy! What are the main reasons they don’t offer to settle? In general? Im not in FL. I talk to my attorney today, but I’m starting to feel like another number in such a broken system. Is it stupid to say you just sent to settle? I’m not settling with no medical, tho. I think I’m just ranting bc it’s so frustrating and I never had any idea what a nightmare this is. Thanks for the video! Appreciate it. 🙏🏼

      @@Tazz45 With mediation on the horizon, the question would be whether a court date is pending on any issues or if mediation is solely to explore settlement. Most likely, settlement will be explored and, if anything noteworthy came up in your deposition, I’d expect it to be discussed. Your attorney should be meeting with you prior to your mediation to let you know what to expect.

      Settlement would be a one time payment where your case is closed forever in exchange for that payment meaning you would have to pay for all future treatment out of your own pocket and would get nothing other than the settlement payment (no further medical treatment or lost wages through work comp).

    I had cervical spine fusion surgery C-5, C-6, C-7 plus Rotator Cuff surgery and re entry in same shoulde been off for 2 years now do to falling at work on to a palet was all seen on video was unconscious for about 10 to 12 seconds

      In FL workers’ comp cases, an attorney can be paid a fee that comes out of the settlement which is technically paid by the employee and/or a fee can be paid separately by the Employer if the attorney successfully litigates entitlement to benefits.

      I’m not sure I understand your question. If you mean what is the lien that work comp has from the car accident settlement, that’s negotiated by your PI attorney pursuant to a case called Manfredo. Basically, they calculate your percentage of net recovery from the full value of your PI case and then whatever your net recovery percentage is, that’s the amount of what work comp paid on that claim they are entitled to recover out of your PI settlement.

    I have a workers comp case in Fl. I was injured over 4 months ago and I am still waiting to be seen by a neurologist. The insurance company received the referral for me to see one but they have been giving me the run around for over 3 months. I probably have a life long impairment but the insurance company is taking their time in getting me treated. Anything I can do?

    Who ever agreed to the creation of this one way system in Workers Comp did a horrendous job negotiating on behalf of injured workers. It's as if the businesses and insurance companies paid off the legislators. First off in most states workers compensation is mandatory making this industry a major monopoly. The fact that pain and suffering especially for at least the most severe is not even considered is a tragedy. Same accident happens outside of work It's a definite, but working where your probably at the most risk and your not able to claim this 😮 Next is you can't sue the employer regardless of fault or not hence the workers comp insurance carrier. The Insurance carrier never has to settle your case either. Lawyers can't do much as they are handcuffed by the laws, so leverage is lost for the injured worker. The cap of benefits and loss of function is an insult to anyone severely hurt. As workers It's a blessing we are covered in the first place. The only portion that gets taken care of is medical treatment for life for the injuries sustained while working unless the state allows for the settlement of wages and future medical. So as you can see on just this generalization, the average worker is screwed if they ever are severely injured and can never work again, you'll get maybe 66% of your pay albeit non taxable but still a shitty deal when something not your fault happens and your permanently disabled. Unless you have a 3rd party case your not getting any significant money regardless of your injuries. Please become better educated and write to congress and get these erroneously and draconian workers compensation benefits updated and improved. Insurance companies have been making far too much money nickle and diming injured workers and businesses with their easily obtained monopoly ✌🏽🇺🇲

      If this is a FL case, you can submit the mileage you travel to/from doctors appointments for reimbursement, typically at 44.5 cents/mile. If you have no means of transportation, you can request transportation be provided. We only handle FL cases.

      If this is a Florida work comp case, usually, the Employer will require you to resign as part of settlement. Not always. But probably 90% of the time.

    50 percent of claims are denied in Massachusetts. That's a high chance of being denied. The question is why is it so high. Other states are 7 to 14 percent.

    I'm in New York state and my advice is to never settle if you doctor says you need surgery. After some serious research your private health insurance will not pay for any surgery or treatment after you settle your worker's comp case work related injury/worker's comp insurance my attorney said that my private health insurance will pay for future treatment, false. Seek a second opinion, get all the facts, a few dollars is no insurance you are going to get treatment in the future. Get all the facts.

      I would like to add also if they mess up you could be permitaly disabled as well. (That's why I won't get eye surgery because if they do make a mistake I could go blind forever)

    Once a workers comp case is settled is it normal to get paid out in monthly increments over a year or 2 instead of 1 payment

      I can only comment about Florida workers’ compensation settlements. That is definitely not the norm in Florida cases.

    I am not getting mileage nor any lost wages I am on light duty with restrictions and the employer seems to be leaning towards firing me while I’m having to deal with this work injury?

    For my lawyers said they offer 100 and that's it then they said 120 then they said 150k why so many different amounts in one phone call to me

    Can your employer not pay you while going through medical treatment and use retaliation because you filed a complaint because of nonpayment. This includes blocking unemployment benefits

      Any questions regarding unemployment should be directed to a labor and employment attorney. Whether you get paid while receiving medical treatment for a work related injury boils down to what your doctors say you are physically capable of doing. Happy to discuss if this is a FL claim.
