on the paper im reading for texas merp it says as long as spouse is alive they wont ask for money back like from provider care services? is this true?
MERP waives their claim if there is a surviving spouse - it is an exemption you can apply for.
We do not have family that could even maybe do this….whew!!

What is the process if a named executor refuses to speak with an attorney to get the probate process started? Can one of the alternate named executors begin the process if it's been more than a year since the death of the loved one?

Hey Billy! A Qualified Annuity would be! A non-qualified annuity would be a countable asset. So just depends if the annuity is before tax (retirement) or after tax.

Great video! I have learned so much from all your videos. Thank you for putting together our living trust so quickly. Almost married 50 years and never planned our estate till last month. We talked altogether with our 4 grown children about our trust at Thanksgiving. It went great. We'll update at Christmas what we have placed in the trust so far. Keep up this good service.

Hi! Single Houston Texas mom to a 12 year old child interested in buying a new house on my own (without a spouse) and putting my house in a trust and name my child as beneficiary. Looking to create premarital agreement and get married to new spouse after purchase of the house. Question: 1. If I die first, would my spouse have right to live in the house under the surviving spouse homestead rights? Considering that the house is under ownership of a trust? 2. Is there a provision eg. In prenup, to sign an agreement to waive survival spouse Homestead rights, given that it’s a constitutional right for the surviving spouse? 3. What must I do to ensure that my son will have 100% ownership of the house and free to sell or put it out for rental incase I die before my spouse?
Thanks for the comment! A Trust may be a good idea but a surviving spouse would still have the right to stay in the home. A marital agreement with spouse waiving that right is the solution and may be paired with other estate plans efficiently (like a trust).
@@EstatePlanningTexasthank you! I have received conflicting information from different attorneys. My partner is happy to waive this right himself anytime as long as he gets to marry me. He is capable of working in renting an apartment or even buying a home. But I just like my home because it’s better and worth half a million dollars. Some lawyers say the homestead right is never waivable even with premarital agreement. Another said all that’s needed is a will. Another said since a trust has different ownership, it will not be considered my property, and in fact, will help to execute a lease to live in after a trust has been established in the house has been put in the trust . I have found about three documents stating that it is waivable. I read a case where a trial court upheld the premarital, the widow appealed, and won in court of appeal, but Texas Supreme Court reversed the court of appeal decision, and ruled that the homestead right had been waived. Sometimes at a time of stress, it may be better to have someone able and trustworthy name in roles, who isn't a close family member (nor beneficiary). It is a good idea to review your documents yearly to every five years. Things change. People die. People move. Phone numbers change. Children are born. I would suggest getting a fire resistant safe to store your will within. Please don't store your will in a safety deposit box.
