Can landlord file a suit for possession when tenant is dispossessed by third party?

TRIAL COURT: Decreed the suit by land owner u/s 6of SR act and held that land owner was in possession through tenant.
High Court upheld the decision of trial court.
Justice R.M. LODHA wrote the judgment and laid the law.
Eight points:
1. A landlord by letting out the property to a tenant does not lose possession as he continues to retain the legal possession although actual possession, user and control of that property is with the tenant.
2. By retaining legal possession or in any case constructive possession, the landlord also retains all his legal remedies.
3. Legally speaking , the dispossession of tenant by a third party is dispossession of the landlord.
4. The word "dispossessed" in Section 6(1) is not confined to the actual possession alone.
5. The expression "any person claiming through him" would bring within its fold the landlord.
6. It is clear that besides the person who has been dispossessed, any person claiming through him can also file a suit seeking recovery of possession.
7. Obviously, a landlord is competent to maintain suit under Section 6 and recover possession from a trespasser who has forcibly dispossessed his tenant.
8. There is nothing in Section 6 of the Act to bar a landlord from suing a trespasser in possession even when, at the date of dispossession, the property is in actual occupation of a tenant entitled to possession.
Whether tenant is a necessary party?
1. Section 6 of the Act provides that suit to recover possession under the said provision could be filed by the person who is dispossessed or any person claiming through him.
2. The tenant having lost the possession though without his consent to a third party, may not be interested in recovery of possession. He may not be available. He may not like to involve himself in litigation.
3. In such circumstances, it cannot be said that tenant must necessarily be impleaded as party to such suit. The non-impleadment of tenant is not fatal to the maintainability of
such suit.
The appeal filed by the dispossessor was dismissed. The decree in favor of landlord was upheld.

आदरणीय सर जी सादर नमस्कार कृपया बताए की प्राचीन रियासत कालीन संपत्ति के अविवाहित 89 वर्षीय वृद्ध श्रीमंत जो बहुत बीमार थे उन्हें जूनियर डॉक्टर के द्वारा फिट होने के प्रमाण द्वारा उनसे मिलने जुलने वाले रिश्तेदार और उनके मैनेजर द्वारा पेपर्स पर हस्ताक्षर प्राप्त कर वसीयत बना ली इसमें उस मैनेजर का भी ओल्ड पैलेस बेचने पर 10 प्रतिशत हिस्सा और नगदी में हिस्सा लिखा लिया गया वाला मामला हैं। इस मामले में स्टांप पेपर खरीदने और जारी करने में भी प्रामाणिक साज़िश स्टांप विक्रेता के विक्रय रजिस्टर तथा जारी स्टांप पेपर से भी सिद्ध है। अनेक फाल्ट है इस वसीयत में फिर भी इस तरह की सैकड़ों, हजारों करोड़ की संपत्ति की वसीयत बहुत सामान्य साजिश से संभव हैं, सैकड़ों, हजारों करोड़ की ये भूमि संपत्ति होती हैं। इस संबंध में सभी निर्णय, नियम कायदों को एकमत करने होने की ज़रूरत संभव हैं। आलीराजपुर एमपी में रियासत कालीन जन उपयोगी संपत्ति में ऐसी ही फर्जी संदिग्ध परिस्थितियों वाली नोटराइज्ड वसीयत तहसीलदार ने कई आपत्तियों के बावजूद कर दी है। क्या होगा ऐसे मामले में?

Hello sir really nice video thanks, we are also facing same type of issue for one of property we are purchasing seller is saying he has lost original sale deed and in ec also we can see only his name . But is it possible of he has mortgage that property using his sale deed as he is having partial home loan with hdfc sp he has not submitted his sale deed with hdfc as well and he is saying he is not getting the sale deed anywhere. When we went to registrar office for registration seller came with colored zerox of sale deed and he was saying this is the only original sale deed. But bank did not approved home loan on this property as original is lost. He has raised police complain and gave add in news paper. Still no banks are ready to give us loan as original is lost
Please guide us in this scenario is if possible to find out if property has been mortgaged using sale deed

लेकिन अभी भी बहुत कन्फ्यूजन है, release deed/ relinquishment deed/ gift deed में। कृपया मेरे सवाल का जवाब दें पिता की पांच बेटियां हैं, एक बेटी की मृत्यु हो चुकी है, उनके 2 बेटे हैं, जमीन 4 बहन और 2 नाती के नाम ट्रांसफर हो चुका है, इनमें से एक बहन और दोनो नाती, अपनी संपत्ति नहीं लेना चाहते हैं, वो बाकी 3 बहनों को देना चाहते हैं, क्या एक बहन और दोनो नाती, बाकी तीन बहनों के नाम रिलीज डीड रजिस्टर के ऑफिस में रजिस्टर करवा सकते हैं या रजिस्ट्रार इसे गिफ्ट का रूप देंगे ।
