I don't know about this one. He still might be on railroad property depending on the width of the right of way. It's not the roadbed you need to stand away from. You can be a safe distance but still be on railroad property. If you do not have autism and are filming this, a police officer could ask why you aren't looking out for the guy by the tracks and allowing him to be there.

I forget about how much foreign power was running around back then but this video does a good job of capturing it. Great video.
