To determine if one structure was legal built (regardless it is conforming or non-conforming) is the "building permit". structrue built (with permit) before code or ordinance effective, it become non-conforming structure if this structure didn't comply to the new code or ordinance. structure built (without permit), no matter when it was built, it was illegal structure, it is not grandfather.

@@jimmywu4594 many local ordinance have been deemed unconstitutional. if I have 100 acre plot of land and there is an existing structure that was legally built, let's say in 1776 and I go get a permit to build another structure that doesn't make the existing structure illegal. there have been numerous cases decided at the State supreme Court level and the US supreme Court dealing specifically with limitations based on lot size. I believe your original example is correct if the person agreed to knock down the existing structure to get a permit for the new one.

@@andrewsmith9980 You are correct, there were a lot of structure may not got building permit. In fact, City only get building permit record back to ~1930s. All building prior to that would have no record in City. As long as owner can provide some document (from City or State) to proove that structure was built with permit, DPP would accept it. If there wasn't any record (from State or City) for that structure, owner still can submit Zoning Adjustment Request to ask if DPP can accept the existing structure as-is permitted.

DPP has revised their requirement. No mandatory topo survery requested for residential project. Only when the grade height differece is more than 5 feet, DPP will ask for topo survey

Depend. If he work in a large firm for 10 years, he may be always work in small portion of a large project and may not know how to draw a house. In fact, I have few of my old classmates, with architecture bachelor degree, working in large firm over 10 years and still don't know how to draw a complet set drawings for a house. Not even mention about building code, land use ordinace, etc. If you want to hire a draftsman for your project, better to see if he had previous project that you can visit and talk to the owner. If he can't provide you any one, pretty much beacuse he always had a bed ending with the client, you should know what to do. Also, asking contractors to refer in another way. If your region (town, city) is small like Honolulu, you may find several contractors to ask for referral. The scope of work is important to determine if you should hire a draftsman for your project. Actually, by Hawaii State Statute, an unlicensed draftsman cannot practice architecture alone. Draftsman is supposed worked under licensed architect/engineer supervision. However, our government knows there is difficult to enforce this. In my opinion, draftsmen shall aim to obtain their professional license while they are working under architect/engineer. For self practice, a draftsman cannot even buy E&O insurance without a license.

Agricultural land is different zoning (AG), not R-zone. So it is not affected by Bill 57 (Ord 20-43). You may build one farm house in one AG-2 lot with 2 acres size.

Thank you for letting me know how the practice in NY. In Hawaii, architect is allowed to sign off all drawings: A, S, C, M, E, as long as you have guts to do so. For residential project, the government doesn't require MEP drawings at all. That's why architect can draw the whole set drawings (A&S). In fact, a lot of old timer architects in this island can do their own structural drawings and calculation, surprise.
