If you're dealing with lingering impairments or work restrictions, this video offers a comprehensive breakdown of your rights, the process, and the benefits you may be entitled to.
California's workers' compensation system recognizes "permanent disability" for individuals who suffer residual functional impairments. However, as Bilal explains, permanent disability doesn’t necessarily mean you receive lifetime benefits. Instead, a percentage is assigned to your level of functional impairment, and that percentage has a monetary value set by California law. Bilal outlines how you can find this information online by searching for terms like "permanent disability money chart" to understand the weeks and monetary benefits tied to your disability rating.
The discussion also covers the employer's obligation when it comes to work restrictions. If you're unable to return to your previous occupation due to permanent work restrictions, your employer must engage in the good faith interactive process to see if they can accommodate your needs. Unfortunately, if they can't accommodate your restrictions, they have the right to let you go. But don't worry-there are still benefits available to you. One such benefit is the Supplemental Job Displacement Voucher, valued at $6,000, which can be used for job retraining and education. In addition, California offers the Return to Work Supplement, a $5,000 check that you can use however you see fit, whether it's for retraining, starting a college fund, or even a vacation.
Bilal also delves into another essential aspect of permanent disability benefits: ongoing medical care. If your injuries require long-term treatment, you can still receive care paid for by workers' compensation as long as your doctor certifies the need and ties it to your original work injury. This open medical care award ensures that even if you can't go back to your old job, your medical needs are covered for as long as necessary.
If you're unsure about what the future holds after your work injury, this video provides a clear roadmap to help you understand your rights and the options available to you under California's workers' compensation system. From the intricacies of permanent disability ratings to navigating job retraining and securing lifelong medical care, Bilal Kassem offers expert advice to empower injured workers and ensure they get the support they deserve.

Chapter 4: Returning to Work and Modified Job Opportunities
First lawyer had high reputation but super jerky and non communicative. Super rude even the main lawyer went on vacation and didn’t give me case statuses. Second lawyer was advocating for my employer and didn’t do ANYTHING to help not even dispute medical treatment denials. Plus I had to complain to State Bar to get my case file transferred to my current lawyer. Current lawyer is a good man but now just trying to catch up. I feel like I’m the victim of the WC system bc now it’s going on 2 years in May.
We're sorry that you're having that situation. If you'd like our help with your case you can reach us at 510-444-2512 and we can talk about it
Great video. 🎉❤ I am waiting for my percentage. It takes forever to get to this phase I believe. I am praying 🤲 for this and it seems like my employer couldn’t give me accommodations. I want my RTW money 💰 🎉🎉🎉 when will this be provided? The system is lagging.
California is easily the worst state to write workers comp. It's often more profitable to just not do business there.
That's why it is good to have a good legal team to advise you at all times. If you or someone you know has a Workers Comp situation that we can help with, we encourage you to give us a call at 510-444-2512

Hello Bilal! Thank you for your content and explaining things so thoroughly in your TH-cam videos. I wanted to see if you have any input on a particular scenario. I'm in California and I ended up settling my workers comp case by C&R. I now have Medi-Cal. Can I present to my new doctor my previous medical imaging and mention the therapy I've gone through so I don't lose any progress? My concern is going back to square one in my path to healing from my injury. From what I understand, preexisting conditions are no longer a roadblock. I'm always honest, I just don't want to complicate things either if I was treated under another entity beforehand. Friends have advised me not to mention getting treated through workers comp prior for the ongoing injury, but I think it shouldn't matter since the case is closed and behind me, right? Any advice would be appreciated as I don't have any guidance but this point. Thanks in advance. Best regards.

Lets assume a claim settled after 7 years after filing for WC. The injured worker then reached MMI past the 5 statue of limitation. His condition worsen and additional injuries appeared, which are 100% related to the original work injury. How can an injured worker be responsible for additional injuries clearly related to the og work injury so happens that it did was not discovered within 5 yrs but 6years instead??
Hi! Thank you for your comment! Yes, that is how that law is set out to be. We work within the system to give our clients the best possible success for their cases.
Okay, but it does not make any sense to me that a statue of limitations can bar you from filing a second claim specially if an original injury does not worsen in 5 years or less but does so 6+years later.
If a claim is settled by stipulation, you may be able to reopen your case within 5 years of settlement if your condition has worsened or your need fo medical treatment has changed. Thank you for reaching out, if you have any other questions, you can give us a call at (510) 444-2512.

What do you think would be the purpose for the TPA illegally changing the work status and on top of that also falsely claiming that the injured employee has returned to their employment and is "currently working with restrictions"?. All this shortly after settling the WC claim through a Finding & Award court order. Thank you in advance.
Hi! Thank you for your comment! 🤗 We would need more info, feel free to call our main line at 510-444-2512 😊
Okay, I wil.

Not cool.
We know, it's not cool 😥 but this is how the system is set out, we just try to work with it to get the best out come for our clients.
What? 3rd party like social security disability?
Hey Victor! No, what Bilal is referring to here is if you have a workers comps case and you have a 3rd party case like a personal injury case. An example is: you're a delivery driver and another driver crashes into you. In this situation, you would have a work injury case and a Personal injury case (as long as you were not at fault).
What kind of attorney do I need for negligence?
Hi! We would need a bit more info 😅 but you could try getting a consultation with a Personal Injury law firm. If your case is work injury related, we'd be happy to speak to you! Our main # is 510-444-2512
Hi LoriStewart-Is4ki, that depends on the situation. Some cases are a combination of both workers' comp and personal injury. If you'd like, we can help you determine which choice is better. Feel free to call us 800-606-6999.
Do you have to pay that back with your settlement?
Hi Victor! Once your claim gets accepted by the worker's comps insurance, the insurance will have to pay back state disability for whatever they paid you. Thanks for your comment! 🤗
Is the California specific? My law firm didnt take the 20% for the first 3 months, while recovering from surgery. Then started to collect it after i was healed.
No lawyer should be taking 20% on a work comp case. It's generally 15% and only if the court approves it!
@Pacificworkers I believe that is average for my state. At least that what found while looking for an attorney.
Would a TBI qualify to reopen my case. My doctor my memory will get worse over time? Do To Gliosis area on my head. Thank you
Hi @victorvalenzuela6949! We are sorry to hear about your injury 😥. It is something you can call us for! It's hard to say over a comment since we need more information. Our main phone number is 510-444-2512. 😊
What if the case has been going for years with no payment
Hi! Thank you for your comment! The type of fee a workers comps attorney charges is called a contingency fee. The attorney only gets paid if they can recover something for you. Hope this helps! 🫶😊
2028 Connelly Center
😅🤔
Cost of living in Santa Cruz county is SO MUCH higher than in the cheapest to live in county in California. Income limit should therefore NOT be the same. If they wanna say 1,732 a month is the limit in the LOWEST cost of living county it should probably be 3,464 in Santa Cruz county. BS!
I have an attorney he been telling them to update my address they haven’t done it can I send the adjuster an email asking to update my address or better let the attorney keep contacting them?
Hi! Thank you for your comment! For simple things like that, yes. It's best to go through your attorney for anything more serious, like a legal issue or a medical issue. Hope this helps! 😄
@@Pacificworkersthank you since April and they don’t change the address 🤦♂️ 😅
Hi there. I’m socal. I was just informed by workers comp that I have permanent neck disability that was determined to 13% disability. They offered settlement. Is it okay to seek consultation? I’m just not sure if I’m getting the full benefits 😢. It’s been so stressful. I’m still able to work 100%
Hi! Thank you for your comment! 🤗 Yes! at any point you can seek a consultation. If you have any doubts or worries the best route would be to call us at 510-444-2512
We'd be happy to check if it's something we can assist you with! 🥰
Keep working as long as you can.
Thank you. My TDD ended back in May and I wish someone helped advise me about this sooner but the problem is nobody informed me that to get certified was a difficult process! My WC primary dr never wants to certify!
We are happy this was helpful to you! Hopefully, you were able to get the help you needed and if you are still in need of help with your worker's comps case, feel free to give us a call at 510-444-2512! 🤗
I'm here currently in Riverside County, CA. Do you work with Southern Cali too?
Hi! 🤗 Thank you for your comment! We mostly work in northern California with a few exceptions. It'd be best to give us a call at 510-444-2512
Yes! I knew nothing about workman’s comp. Was advised to use my sick and vacation pay to rest not knowing the severity of my injury. When it did finally get reported, I had no sick and vacation pay to use!
You shouldn't have to use your sick time or vacation time for a work injury and we are sorry that your employer did not guide you well😥 It is important to report any work injury to your employer asap 👍 If you need help with your workers comps case feel free to contact us at 510-444-2512 🤗
Probably get more likes if you gave an answer
Thanks for your input and comment! 🤗
Good info!
Glad it helped!
If I settled a workers comp case.can I do a civil lawsuit
It depends, most cases you can't double dip meaning you can't get money from a civil lawsuit and wokers' comp. You might want to schedule a free consultation, since there are times where injuries are better handled through a personal injury claim. We're happy to speak further. 800 606 6999. :)
You take so many losses while out on worker’s compensation. Some lose their homes, families, vehicles, friends, jobs, health, contacts, hobbies, social interaction with others and the list goes on. Some may get an attorney that doesn’t explain the court case etc. Some feel like they should have worked through their injuries to keep a livable wage and not report their injuries. WC injury victims suffer so much overall and many don’t truly understand that and most really don’t care.
My attorney is dropping me in the middle of my case
I'm so sorry to hear this! 😥 You can always get a new attorney. Give us a call to check if we can assist you, our number is 510-444-2512.
Thank you.
🤗❤️
What about nyc
Hi! 🤗 We are talking about cases in California.
I tried to call the adjuster when my case started and both my attorney and adjuster scolded me for doing so. And they said it was illegal.
Yea, that's not true. You can contact your adjuster for simple things, like for milage, for authorization for medicine stuff like that. Anything serious, you should go through your attorney first.
