    Intersting case if you can solve this mystery ! Can you please help me and let me know about this case as mentioned below? Buying property threw bank auction, now when going to pay TDS to original owner PAN Number at 1% it shows inoperative. When check we found that buyer is out of India from last 10 years and his Adhar-Pan not linked (most of the chances that he may not have adhar card). When tell to bank about this inoperative PAN they replied me after consulting their taxation team that, pay TDS 1% in favor of Bank PAN Number. So is it legally allowed that auction winner buyer paid TDS to bank PAN instead of Owner PAN ? If i do so, than is there any consequences arise in future on me ? Here bank is not the owner on paper although they sign the Dastavage and tranfer property in favor of auction buyer. So what to understand and what to do? Can you please short out this mystery?

      @@tarangshah678 since you are buying the property through bank auction, the conveyance deed will be executed by bank. Hence PAN Number of bank would be required.

      In general terms, only the municipal taxes, if seperately paid by the lessee are to be added to the rent amount for calculation of stamp duty.

      As far the repairing expenses and maintenace charges are concerned the amount, if it is clearly quantified and mentioned in the deed then the same shall also be considered as rent ONLY IF IT IS RECURRING IN NATURE AND IS BY LAW RECOVERABLE FROM THE LESSOR. But most of the lease deeds do not quantify such terms of repairing expenses and maintenance charges and have a general clause of "day to day general repairs to be incurred by the lessee". These charges are IN GENERAL TERMS SOMETIMES NON RECURRING IN NATURE AND ARE PURELY NOT AN OBLIGATION ON THE PART OF. LESSOR EXCEPT FOR THE MAJOR EXPENDITURES. Hence, in most of the cases the clause regarding stamp duty on maintenance and general repairs remains an uncertain criteria and sometimes gets ignored if not quantified.

    Updates :- On 9th September, the Gujarat Industries Power Company board of directors approved the award of the EPC contract to KEC International at the cost of Rs 244 crore. The contract is for pooling substation 400/33 KV, 1200 MW (PSS-1, phase-1 & phase-II of 600 MW each) of solar / wind / hybrid RE of Park 2375 MW capacity at Great Rann of Kutch area, Gujarat.
