Few males in certain industry consider women in social gatherings as eye candy , very common harassment or embarrassment I would say

This is sooo good I am a lawyer and recently started posh training and this questions always flummoxed me. General rule of law is intent is everything whereas in posh impact is more important.
Without actus reus and mens rea, there cannot be a crime. So we are awarding punishment without any mens rea? Doesn't sound ok. Legally not maintable at all, if there is no mens rea then the award can be challenged and will be struck down.

How can I reach you guys?
Hi, in one of the scenario, an outside client's minor girl was sexually harassed by an employee of my franchisee. The franchisee is an individual and has not more than 10 employees, so he doesn't have IC in place. Now, so should I proceed with the complaint or should I revert back to the complainant to reach out to LC? Or there shouldn't be any POSH proceed since POCSO is attracted? What do you suggest?
Furthermore, is IC is obligated to intimate local police since it involves sexual harassment of a minor???
A company which has only 10-15 employees basically a startup and most of them are male employees, how can we choose the presiding member? Can we then have an external person as presiding member?
The POSH act doesn’t serve any purpose to anyone ! Simple criminal process shud be initiated against any abuser . In office or outside . Why has an office place been made an extra judicial space ?

Also about an internal appeal. Being the Chairperson of an IC, the decision for a case was safe-guarded because there was no internal appeal body. The system wanted to control the decision of the IC.
is gender based harassment considered under sexual harassment? Is continuous harassment of a woman, from deduction of salary during peak covid times when she was 7 months pregnant (state govt/DoPT orders say that she cannot be called to work), not approving maternity leave on time to intimidate, not processing maternity bills, & many more... which go on for 3 years... can a case like this fall under sexual harassment, and can the IC take up this case?
2016 Ammendment applies to both ICC and LCC. Both are now IC and LC. Not LCC not LC
No clarity on harassment from 3rd party on how to go about it. Just broadly brushed out. Like organization's are learning from it.
Good clarification. IC has to support the women in filing the case with the LCC.

For women, the fear of retaliation is very real, besides the concern that the career of the Respondent might get impacted. So they want to stay anonymous. Thanks for this episode!
