The reason why Kelly has not been arrested is because the law states clearly that a confession by one accused can not be used to arrest another accused. However, the confession can be used to INVESTIGATE another accused which is what Gininda did. He investigated to see if what the accused said in their confessions can be corroborated. the photo of the plastic money bag is one piece of corroborating evidence which lends weight to the confession but it still isn't enough. If the state arrested Kelly and charged her using only that evidence they would never get a conviction because the evidence is too thin. They need more. That's why the state can't charge Kelly yet. They would get destroyed in court. A seasoned prosecutor knows that you don't charge someone unless you know you can win in court, because if you charge and lose, you can't charge that person again later on...even with new evidence.
