    How are a majority of contracts being written - as far as commission. I am selling my home and already paying both B/S fee in another state. I am not looking in just one county, so if I have a broker who is not very well versed/knowledgeable in another area can I have that area excluded in the Broker agreement?

      Hi Kris, on the buyer broker agreement, you can specify a geographic area such as a town, county etc. Also, there is a single property buyer broker agreement that is also an option if you wanted to limit the agreement with the buyers agent. Hope this helps!

    You came across as very untrustworthy when you contradicted yourself on multiple occasions regarding the buyer's liability to pay your fee. Thank you for alerting us to what and whom to avoid.

      Hi Eric, thank you for your comment. It's unfortunate that it came across that way to you. Long story short, I don't think much is going to change. The seller will still pay the buyer agent commission as usual. If the commission is not there, then as I described on the form, there are two ways to request the commission, at closing as a concession as part of the negotiations (credit at closing) at which the buyer pays their agent through this) or the seller pays direct to broker (as usual). If the seller flat out refuses to pay a concession to be used as commission or commission period, then having my buyers pay me any sort of compensation will be addressed on a case to case basis. I won't refuse to work with buyers (for instance 1st home buyers) who do not have the extra funds. But again, I don't think we will run into this. Regardless of who you work with you will have to sign this form if you work with an agent to represent you on the purchase of a home. I'm not sure how I came across as untrustworthy as this is straightforward but I only want to work with people that want to work with me. Best of luck to you.

      @@livinginstjohnscountyfl I don't think you came across that way at all. I thought you sounded very sincere and knowledgeable. As a Realtor here of 20 years we all have a lot to learn with this and have to take things step by step. I really don't like how buyers agents are getting shafted and turned on by hateful people. They have no idea the work we do to help buyers. We do not work for free.

      @@MiamiMase I agree this is a learning process for all of us and things continue to change. I've spent HOURS in training classes to stay up to date on how to follow the new guidelines etc. It's also a challenge because all the brokerages are handling these changes differently.

    It seems this new law is put in place to stop home buying, and it is working, because we decided not to sell and just stay put for now due to this new law. We have never (and never will) sign a contract with a buyer's agent, nor pay them any fees or commission...ever! The market is upside down now and overpriced due to the greed of agents, and now the system wants to scam buyers some more. We are seasoned buyers and sellers, and for the last 20-some years my husband and I have done most of the work ourselves in finding a house and ensuring we were financially secure and the house was in shape. As well, we can write a book on the many times agents have lied and tried to cheat and scam us. We will sell and buy only FSBO from here on out. There is no oversight on the real estate market...no protection for buyers or sellers...and this law only makes us want to run from the entire real estate market nonsense.

      Me too i am not willing to deal with no realtor no agent no buyer agent i am posting my house for sale myself S FSBO on zillow doing my own oppening house i iknow it hard to find a buyer that way but i wont give up its a very nice single family house in great condition and great location near winter park village and 15 min away fro downtown orlando if somebody interested they can reach out to us but no willing to deal with realtor or agent np MLS no commission 😅 Zillow FSBO Hamlet dr ,maitland, Fl 32751

    For YEARS, I have used Buyer’s agreement registration so that I don’t lose a commission from a buyer that wanted to look at a property, and then tries to slide another realtor into the deal.. to protect myself. Just can’t figure out how it’s going to go down that we put our commission/income into the agreement. Buyers will still try to go see a property without the agent they are secretly working with. Just not sure how putting our income into the mix is going to fly….. you know buyers aren’t going to want to pay our income, when they never had to, before….. this is so ridiculous.

      I agree, it's a pain. A lot of states have required the form already so this won't be something new for those agents to navigate. And you're right, buyers are not going to want to pay if the sellers do not so it will be a tough conversation beforehand to figure out what to do. However, I'm optimistic as a default and while I think that commission amounts may decrease, I don't think they are going away. And even though they won't be published on the MLS we can still see them on broker websites, emails, social media.

      Thank you for your question. Each community has varying fees. Shearwater for example from this video has CDD (community district development) fee of around $2300 a year - this is paid through your property taxes. And the HOA fee is about $240 per year. The CDD is typically on a bond of 20-30 years. Once paid off you have just the operations and maintenance portion to pay. The CDD fees of each of these master planned communities pay for the financing, building and maintenance of amenities. The CDD bond portion can also be paid off in advance. Sometimes you’ll find a resale or even new construction where the builder has paid off the bond portion. Silverleaf, one of our newer master planned communities does not have CDD fees but they have a higher HOA - around $1400 a year. Hope this helps!

    I am only half way through watching but the one thing that stands out to me is the very small size of the yards. I am guessing that would be different for the different sub communities in the development?

      Hello! Yes, they all vary in size. On average about they are .25 acres and up. There is one on the market today in Murabella that is on close to half an acre. Ashley Oaks in WGV has huge lots some an acre and they allow RV and boat storage.

    Thank you very much for making this video. Question - do the CDD fees go up typically over the years? Or do they stay at what you get in at? HOA can go up right? Thank you.

      You are very welcome! Thank you for watching. They should stay the same over the course of the bond period that’s left. However, if the money isn’t managed properly to cover maintenance, roads etc. they could increase. It’s important for residents to attend the board meetings to make sure funds are being allocated properly. Yes, HOA could go up as well. Any increases would need to be voted on.

    A family with a secondary school-aged child is thinking about moving to St. Johns County. My priorities are school quality, outdoor activities, as well as concerns about flooding, hurricanes, and car insurance. Thanks for reviewing.

      Most communities here especially the ones you might be considering are not in a flood zone. I always share this link www.gis.sjcfl.us/floodviewer/ where you can put in the address to confirm if it's in a flood zone or not. Also, unless you're living on the beach, hurricanes aren't really an issue in this area of NE Florida. Most communities in SJC are far enough inland that the biggest concern is wind but newer homes are built with wind mitigation in mind. Hurricane insurance is not required in these communities. Yes, car and homeowners insurance is a concern as many carriers have pulled out of Florida. However I'm still hearing from people moving from the NE that the rates are still cheaper than what they were paying up there. Let me know if you have any other questions or how I can help.       @livinginstjohnscountyfl that is how it will be. Currently I have two spaces, one is formal. Too much. Building in silver leaf, it will have a space close to the kitchen for the dining table. Keep it simple.

    I misspoke - it actually has the primary bedroom downstairs along with bedroom 2. Bedroom 3 and 4 are upstairs.
