      @@Healing4Justice It means there are not arbitrary or legal "expectations" on this. Tenants are legally obligated to pay rent, and if on move out there is anything more than normal wear and tear, then they could be charged for that.

    Hello All.. i hope everyone that is or has been in the position i am sitting in at this very moment is well and in good spirits! Now, question to @healingandjusticecenter or anyone who has experience w/in the issue; I am currently waiting on my court date of trial, and working and stressing on it. Most of the stress comes from representing myself and having such a strong and what should be "easy" defense(s), i will not articulate or not present information the correct way. Not to nention because of how i look (hispanic with a shaved head) i have the potential to get a biased judgement at the end of it. I am extremely hopeful because i am doing my due diligence. Sorry for the rant, but, the situation in short, in the detainer served, the Apt. Mgr. stated she physically handed me the 3 day pay/quit notice when thats a blatant lie! Fir ine, she has never stepped foot out of the chair she sits in in her disorganized messy office and for 2, i left my residence at 9:30am that morning, after i woke up at 9, to run errands and went atraight to my girlfriend's house to stay the night there. So for the most part i can prove that, my concern is i cant prove she didnt "hand deliver" me the doc. before than, which is really concerning. There are a few more unlawful acts that were had by her thereafter, such as, "accepting"/leading ne to believe, the acceptance of not only the months rent, but two more payments w in the month, to zero my back rent out, which was an accomplishment for me. Come to find out the next day (which was the end if the month, 18 days after expiration of the doc "served) i gave her the last of the 3 money orders for the month, i went to have a great convo w her, she handed me all three miney orders back and said were moving on w the eviction. So with all that said, widh me luck, i wish you all the same, any advice will be received with gratitude and thankfulness. Thank you.

    What if u just moved into a property that was out of code and inhibitable with feces in toilet no ability to turn heat on due to the landlord’s astronomical past debt to the gas company, from day one u expressed and requested repairs be made by code and law .. then 4 days later with nothing being done like the shattered windows that allow the elements inside, no heat for 13 days per gas companies guidelines this is for the gas comp to insure that we the new tenants aren’t the previous residents trying to skip out on the bill.. 4 days into move and obviously about 5000 in move in costs to the said owners and management.. we received a 30 day eviction notice on the grounds of not allowing access for repairs ? Just pure insanity.. I knew we had been conned so I discover that these landlords are actually apart of a crime ring that have essentially stolen the deeds/trusts of houses around the United States and have never used their true identities in any of their businesses transactions aka over 3000 LLCs were created under one agents name in just my state in 2 months period, this has been going on for decades apparently and these ppl have warrants and judgments in other states like New York and tx.. they have hacked the bar association web page for attorneys to gain unlawful access to their bar or attorney licenses.. they have never represented themselves as themselves in a court room as their attorney who is also one of them stands in for them .. NOT EVEN A REAL ATTORNEY how does this type of impersonation even happen and they have stiffed the attorney generals to believe that they are said attorneys.. when they are caught you can’t convict them because they are in layman terms, a ghost… I have evidence of everything we have been followed even by them .. I tried to call for help but they flooded the browsers with false sites that lead me to them.. HUD lady ended up being them and I sent her my evidence against them at the time..and was told not to attempt to contact any other source of legal help or that fair housing would not be able to take my case, that I identified as a landlord retaliation, well a week goes by and I get an email back and then a call from the attorney generals office I called the Friday before, and I had been misled as it was them.. now we have a court date and these ppl refused us our rights and wouldn’t allow us our money back for moving into the golf course property with the renters insurance we had to pay along with pet fees and the moving expenses period .. the address on paperwork lead to an empty lot with Suites that didn’t exist within them. They have served us after 4 days of move in for requesting emergency despairs be made that would have an impact on our families safety and health along with every other violated code of conduct .. plumbing still has never been fixed. However, they were able to obtain a court hearing for an eviction that never had probable cause so I’m not sure how they showed that.. but the paperwork doesn’t have that in it, they said it’s for none payment now ? But we have documents of otherwise .. ultimately these ppl are criminals and have impeded our rights to obtain any lawful help by HUB FHA or AOG by falsifying websites and impersonation of public officials.. failed to identify themselves or their previous crimes the list goes on.. then the fact that they somehow infected our WiFi to tap in on our searches and calls.. once we moved in like they had done to others before us. I don’t know how to get protection against ghosts

    Hey Jorge, 🙏 You get well. Do you know? I have been a superintendent from 1990 to the present. I do pay a rent. The I thing I want to know is if my apartment Rent stabilized! So if I am relief of my job as super. Will I have the protection of having a rent stabilized apartment. So my rent won’t be raised to the roof. I sent away for the history of apt. but all the print out says is “reg not found for subject premises “ from 1984 tru 2023. Lease states that receive every 2 years. Under section 2523.5 (a). of The NYC rent stabilization code. What do you think. Thanks Jim

      Hello @jimfrometh! Thank you for watching our video and Thank you for the well wishes. Hoping you are well too. I can certainly understand your concerns about the rent being raised because we all need to feel safe and secure, and getting your rent raised certainly affects that sense of security. First, we are based in California, LA County to be more exact. So, we are not as familiar with the laws and policies of the other states. It seems like you are in New York City. That being said, here in California, managers or superintendents of apartment buildings are not protected by the laws that normally protect a tenant because if they are being paid or receiving compensation of any kind, whether decreased rent or actual payment, they are considered "employees" and not "tenants/renters". So, here an owner/manager does not have to allow the same type of notice to vacate to an employee as they would to a tenant. Also, employees are not subject to the same type of tenant protections such as rent increase limits. So, if I were you, I would want to first inquire with a legal service as to whether or not I am covered by the tenant protections such as Rent Stabilization if I am a manager/superintendent that is receiving compensation for my role. And if you are covered, those same agencies may be able to tell you if your unit is under Rent Stabilization. If not, I would consider calling the City or County to investigate where you can find that out. Here in LA County, we have a Department of Business and Consumer Affairs where I can call to check if a unit is under Rent Stabilization or not. Los Angeles City also has a website that anyone can use to check if a unit is Rent Stabilized or not. Hopefully, there are similar resources or systems in NYC. Research "Free Legal Services" and I am sure you will find an agency that can help guide you to find the answers you need in order to make an informed decision. I hope this helps you some. I am sorry I couldn't answer you directly as I am not familiar with NYC laws and policies. And remember to breathe and ground yourself as you navigate these systems and find your answers. It's stressful to have these questions go unanswered and not know what will happen. So, be sure to take care of yourself along the way. Best of luck! 🙏🏼✊🏽

      @@Healing4Justice gotcha ! Ny and la 2 different worlds. My situation is different I paid rent. and if a super pays rent he is considered a tenant. So hence if my apartment is rent stabilized then i get that benefit even if I am manager/super. So I will as they probably lawyer up.     Question, i receive social security and it goes directly to a debit card. I have extreme anxiety which causes me to avoid leaving my home. This makes it very difficult to get to walmart purchase a money order and turn it into on time therefore causing late fee etc. Sometimes i have the money order on time and the anxiety is so bad or am embarrassed due to be late in the past i end up turning my rent in late. I have asked them if I can pay my rent online. I saw that they allow other properties they manage to do so. So i can pay on time and not occur the late fees i have stacked up. They told me no. I can only pay with money order or check. Shouldn't I be allowed a second method of payment to accommodate my disability, after all my sole income is social security disability?       Hello there! Thank you so much for reaching out and your question! Sounds like you wish you had some understanding and cooperation so you wouldn't have to feel such anxiety and stress about making your rent payments on time. How worrisome it must be for you. Well, in my experience as a tenant advocate, I haven't known of any rules obligating owners/mangers to allow online payments. That being said, we ask for "Reasonable Accommodations" all the time for tenants that may have a disability that prevents them from performing their tenant responsibilities. There are no guarantees that the owners/managers will comply with the request, and if they don't, you may have to seek legal support to advocate for your request. Given the circumstances, it seems like it would be worth a shot and at least you document for yourself the request you made, just in case it does turn into a legal situation. Personally, and I am not an attorney, seems to me that if they don't honor your request, it sounds like it might be a little discriminatory. And if they don't honor your request, then I would submit a complaint with the Department of Fair Employment and Housing (state level) and also with Housing and Urban Development & HUD.       Thank you for your quick response. I have done as you mentioned and they have provided me a 15 day grace period however it wasn't in writing . Upon certification yesterday they were trying to get me to sign an ammedum "eviction for good cause lease rider" I didn't feel comfortable signing it because the Term good cause was to open ended. The manager told me they will make you sign it. I replied, they can't make me sign anything

      Our knowledge is currently limited to the state of California. All we are able to offer is what CA law says and encourage you to verify if the same is true for the state of Virginia. That being said, in CA an owner cannot obligate a tenant to pay any certain way, such as by Venmo. The reasoning is based in discriminatory practice, which would make a good argument in any state we believe. Their assumption is that everyone has access and knows how to navigate the technology, which can discriminate against low income, seniors and other physically impaired persons. So, although we don't know Virginia law, it would seem reasonable that requiring anyone to pay rent using Venmo would be discriminatory. In CA, a tenant can pay in check, money order, cashier's check on top of whether they elect to use technology to do so. Hope that helps, at least in constructing an argument against having to pay by Venmo.

    If you live in a property for 30 years, can the property assistant tell you verbally that you have two months to move because thier getting ready to break the building down. I didnt get a notice from the property manager and never seen him/her, just a verbal from the assistant. What is my option because two months is not enough time and Ive been in the property all my life. I don't even have a lease agreement with them.

      Thank you for your question. Assuming this is in California, a verbal notice is not a valid notice. There is nothing you have to do until you get a written notice. Also, depending on where you reside, you may have additional protections for relocation assistance and against NO FAULT evictions. For now, there is no need to do anything or to say anything to them. However, this might be them 'showing their cards' and they might in fact try to evict everyone. So, if you're able to find other suitable accommodations, then looking for another place to live might be good to get started sooner than later.       If they're going to take the building down, they sent legal notices to everyone, likely on the door and through certified mail. That's a very easy Just Cause eviction case, and everyone will have to leave. If there are egregious issues with the property, and it gets red tagged, you'll be tossed in 24hrs and lose all your things. The county won't let you back in for your stuff. This guy is giving you really bad advice. If it was only verbal, he's right, it means nothing. You can go to the building permit dept, and see if they pulled permits to tear it down. Either way, sounds like you should just look for different housing, and document everything, and try to get relocation assistance, if you're unable to move. It would probably be easier, if you had a set place to go, & set amount, and then asked. If they're tearing the building down, you're not entitled to that AB 1485 money. (Owner move in, major repairs etc, you have to leave, there's no fighting it, even with the new AB 1482 law.)

What information are we sharing you believe to be incorrect or misleading? This video is about eviction process and proceeding. It sounds like you have some thoughts around when a building is being either demolished or a government agency has "red tagged" the building and deemed it uninhabitable. If a government agency has deemed it uninhabitable, there are some things you can do about that to advocate for yourself. There are no supportive laws in CA that we know of that will prevent the relocation, but there might be relocation benefits one can either negotiate for or find. We believe in advocating for yourself and striving to get the most support. Not everything we help tenants achieve is backed by a policy, law or right. If you'd like to clarify where you believe we've been misleading, please do so and we hope to clarify anything or correct it. Thank you for your comment. 🙏

      Sylvia, thank you for your comment/question. There are a lot of clarity we would need in order to best counsel you. I am making a lot of assumptions, such as those months they claim you didn't pay, you actually paid. If you have received a 3 day notice to pay or quit, then there is a chance the owner will file an unlawful detainer and try to evict claiming you have not paid rent. Your defense will be to show that you did pay rent, and you will need to gather the evidence or proof that is the case. If you haven't received a 3 day notice, I would suggest writing a letter to the owner and submitting proof/evidence that those months were already paid. That way you document the conversation. When you are being accused of something, we will always recommend you respond in writing, and not have verbal conversations about it, or if you do talk about it, you follow the conversation up with an email or letter about what the conversation was about. There are some protections for Section 8 tenants and there is always risk when you are challenging the owner's power over you as a tenant. That being said, there are certain ways of approaching habitability issues even though you're Section 8 so that you are protected. If you are having issues with your electricity and with mold, depending on where you live, you may need to call the City Code Enforcement and/or Health Department. First, you should write a letter to the owner asking them to repair these items so that you have that in writing and documented. Hot Water heaters should be off the floor and braced properly for safety.       Hi. I have a question please. So say I been going through an eviction due to a non payment of rent due to COVID funding stopping payments and landlord not communicating and we just ended up with them serving an eviction. It took 14 mo to finally file in court. We have been trying to work it out because we do have the money. It's just their managers that run the mobile home park are rude, power tripping and never respond. So I answered the UD and it's been another 2 months with no court date. I think they know I have a lot of evidence on them. There iss more to this but what I really want to know is. They offered a settlement and in the settlement for the total amount they are claiming I owe, what i believe is not right. They have increased the rent twice within the 14 months and in the lease it's $500. It's $540 and $580 in some of the months they are asking from us. They never renewed the lease before I defaulted. It was due to renew 2 months before I didn't pay rent on time. The same with the utilities. They just have hired everything without notice. I don't agree with their deal. Am I correct in denying their offer? I don't want to make a mistake but I believe that from what i know. They can't raise rent without a written notice. I really appreciate your time. Even if you can't answer me. I'm hoping someone knows because I need an answer by tomorrow and I've been searching the Internet with no luck. It's no straight answer I can feel 100% confident about. You seem to have lots of very deep question surrounding the concept of housing, tenancy and enforcement. Many of which resonate with me and our work and as such, we still have to work within the system which has been created to support renters/tenants, all the while we organize them to dismantle the capitalist systems with an imbalance of power between owners and renters. I’m not a attorney but that doesn’t mean I cannot find out what the words exactly mean. Especially if I’m supposed to sign a contract. I mean a contract should be 100% understood by both parties legally if I’m not mistaken. Not sure what a attorney has to do with definitions. That’s something we learned in grade school. Its very easy to push blame on to others or deflect questions when answering them might not be in the best interest of oneself although it is in the best interest of everyone unknowingly signing documents quite frankly most people don’t even qualify to sign. Just to keep a system working? Well if the system needs to work of deception and misinformation I fail to see how this system is benefiting? Nothing that begins in lies and deception last forever.       Hello Victor. We apologize for not seeing your comment sooner. We know a lot of places are moving to payments online. At the moment, owners and managers cannot require you to pay online and you still have the choice to pay by check or money order. That being said, to answer your question more directly, between the two ways of paying the best way will be based on your needs. If it is convenient to pay online, then that might be best for you. And for someone that doesn't know how to navigate the internet, paying in check or money order might be best for them. The MOST important piece is to get a receipt or proof that the payment was made, especially if you're paying online. Save the receipts, email confirmations, and take screen shots if you have to, in order to have proof the payment was made. That's what we really want to get across. And for those that don't have internet access or able to pay online, we want them to know they can't be "MADE" to pay online, only because it is more convenient for the owner or property manager.

      Hello Victor. Thank you for the question! I'm not sure if one is "better" than the other. As long as you are able to document the payment was made and have some proof, then you should be fine. I know with either a Money Order or Cashier's Check, you will have a payment stub that will show how much and for who it was for. We always recommend that you put in the "memo" or "note" section, what month and year the payment is for. That way, if you have past due rent or other fees, they don't try to apply your payment to something else instead of your rent. For example, you can write "Rent payment April 2023" and do this for every month you make a payment. Hope this helps!

    New sub here! At the FIRST trial, if the tenant has requested a jury trial when filing an answer to the UD,.will the trial be held that very same day? If not, generally how long after is the next trial date?

      Thank you for your comment and subscription! To answer your question, it will depend on the courthouse quite honestly. We always advise our tenants to be ready for trial on the day that is assigned for the UD court date. The judge or commissioner can schedule to have the trial that same day if they want, and in certain instances (here in Los Angeles area) they will assign to another courthouse for trial, which means having to travel that same day. However, we've seen that when a tenant has legal representation...an attorney...then, the trial can be rescheduled for another day. So, to sum up, we suggest the tenant be ready for trial the same day. That way you're ready no matter what happens. Hope this helps! Good Luck!

      Thank you for the comment and question! In our experience, in the Los Angeles area, we have trials happen the very same day and others get pushed back from one day to one week. The attorneys we work with always suggest that the tenants go to the court appearance date prepared for trial. In certain cases, we've seen court trials get moved from one court house (such as in Long Beach) to another court house, that same day, in Los Angeles. Best to go to the court date prepared for trial. Good luck!

      Well, the best way to find out is to call the local rent stabilization board or administering agency to ask them what can be done. I know in certain areas like Los Angeles, there may still be a "Rent Freeze" in place which will not allow any rent increases in RSO units. As far as the timeline (2030), that would have to be investigated with each respective city and their protections.

I understand that when tenants don't pay rent, that may create a hardship for some owners and that too is not good, must be stressful and worrisome. I would invite you to think about building a relationship with your tenants of understanding and compassion. What are the reasons for not paying rent? Are there solutions to both of your situations that would create stability and consistency? We hope for a better relationship between owners and tenants...for more housing stability for ourselves and our communities. We hope owners, since we have most of the power, would also hope and strive for the same.

Why encourage people to keep doing harm to good homeowners? Why not light a fire under their buttons to get off the couch and go get jobs and pay their rent. Squatters, loafers and people like you are why there are so few rental homes for local families, especially where I live in tourist central. The bad renters you are supporting , and this kind of advice , is what makes good homeowners put their homes in the vacation rental market.. The only advice you should be giving to help the degenerates is PAY YOUR BILLS. Regardless of what has happened in their life, what troubles they have , or whatever getting to know them you think may accomplish, that house still had a mortgage that needs to pay paid. What about telling the tenants to get to know the landlord and their troubles and why they need that mortgage money and they got to pay on time. You are giving advice to prolong the inevitable and encourage further stealing. It's gross.

    EDUCATE THE TENANTS TO BE RESPONSIBLE FOR THEIR RENT. NO LANDLORD WANTS TO EVICT A TENANT AS LONG AS THIS TENANT PAYS HIS RENT AND TAKES CARE OF THE PROPERTY. THE PROBLEM IS THAT YOU AND THE TENANTS WOULD LIKE TO HAVE FREE RENT. I WANT FREE RENT. FREE TAXES, FREE INSURANCE, FREE UTILITIES, FREE REPAIRS. FREE MORTGAGE. THAT WILL BE NICE.

      Actually, I'm a small rental owner too...and I have aspirations to get more properties...AND I still believe tenants should know their rights as owners should too. We're not anti-owners as I am one too. We hold a lot of power in determining the livelihoods of others because we own and we want to help create collaborative working and stable communities, and we do this by helping tenants (those with not as much power as us owners).       Sorry you see educating tenants on their rights that way. It sounds like you think we're anti-owners...we're not. We also help tenants become owners. I'm a small rental owner too and still believe tenants deserve to know their rights because when i was a tenant I didn't know and got screwed over lots of times. We should also learn to be responsible owners, looking out for people and their livelihood, not just the rent and our own livelihood. Its how we create a better community and world.

    For example if a landlord violates Ab1482 on rent cap only, the only government agency that has jurisdiction is the department pf consumer & business affairs dependent of county. Ex: Los Angeles dept. of consumer & business affairs. BUT if a landlord issues an invalid termination of tenancy notice WITHOUT just cause, OR no fault just cause and FALSELY claims TPA exemption there is NO department at the federal, state, county, or city level that has jurisdiction to file a complaint. Since AB1482 does not list ANY penalties to landlords who issue an invalid notice/makes false claims like, a false claim to exemption of TPAjust cause/rent cap, and since there isn’t a government dept argument/agency on the federal, state, county, or city level to file a complaint: AB1482 laws will ONLY protect tenants who are able and willing to pay for that protection since the only way AB1482 can be enforced is in California state/civil court. I am Gen Z. Generations ahead of mine priced me out of homeownership, potential parenthood, a 4 year college education, and now my California tenant rights. This is a intentional loophole for landlords and a cute idea in theory but in my case, AB1482 isn’t real unless I as a tenant can pay for it to be real by hiring an attorney to bring it to civil court because the penalties the landlord would owe for such an act is beyond small claims court.

      Thank you Ariana for your comment! You are completely correct! All of the laws, policies and tenant rights we are afforded don't amount to anything unless a tenant enforces their rights which sometimes entails going to court to fight it. I usually use the example of the speed limit...only because it says not to go over 65 mph doesn't people won't do it and if they get caught. That's kind of like our rights, owners will do what they want to do and we have to decide to fight it or not. We hope more tenants fight it, because they more that do, the owners will start receiving the message that it will cost them $$ to do it. I say, if I'm going out, I'm going out swinging! Hence why we need to organize and fight for a Right to Counsel, so all tenants are afforded an attorney just like the owners! Thanks for your contribution! In solidarity,

    What about when you pay on time and they say you payed late and charge you a fee?

      Thanks for the question! First, when you pay your rent, depending on how you pay it (mail, online, etc.) please make sure you are documenting the date in which you paid it. If you can show you paid on time and they are still charging a late fee, I would suggest contesting it by sending a certified letter documenting the days/times the rent was paid and requesting they remove the charges. You can also state in the letter that late fees (at least here in CA) cannot be punitive and must be justified, so they would have to show you the justification and/or prove they are not punitive. Lastly, you can choose to not pay the late fee and see how they respond. However, if you choose to not pay the late fee, please be sure that all future rent payments specifically state they payment should be applied to the rent. For example, if you send a check (which we recommend) put in the "note" section, "For Rent Only" so they don't try to apply your rent payment to past due balance of late fees. Hope this helps some.       @@JorgeRivera1972 Hey thanks. I contacted the owner after two days of getting nowhere with the property management. Then after talking with the owner i called again and got treated well by the prop manager and they removed the charge. They said it was a billing error from the assistant. Luckily I take pictures of the statement and check every time I pay it. However I had been getting a 3% park inflation credit on my statement since June 2022 that stopped this month Feb 2023. What is that credit and can I get it back? I forgot to ask the manager about it and we have no onsite manager at the moment. Thanks .

      Sorry for the delayed reply. You can TRY to get that back but in my experience getting money back that they have a hold of is really hard. What I would recommend is writing a firm letter speaking to the discrepancies and requesting a refund for those overcharges. At the very least you have it documented that there are errors. Lastly, you can always take them to Small Claims court for the discrepancies and usually can sue for more than what is owed because of damages incurred.     What do I do if the landlord charges me two different rents every other month, one month the landlord charges me the rent on the lease then the next month he charges higher rent, I live in a rooming house I don't pay weekly I pay monthly because I receive social security, one month he'll charge me 660 then the next month he'll charge me 825 I don't understand that, I always thought it was 4 weeks in a month 28 days so why the extra rent, I know I need to speak to someone I live in Connecticut, any help would be grateful

      Thank you for reaching out and I am sorry to hear about the issues you are having. It. sounds frustrating and stressful because you might be needing clarity and consistency. Unfortunately, our experience is mainly in Southern CA and not certain about the rights and protections in Connecticut. For here in So Cal, that is not something that sounds legitimate or legal. I would recommend reaching out to Legal Aid in your area. You may also be able to call your City's clerk and ask for references to other legal services or tenant advocates.
