      @@lloydhenrick7864 I'm not licensed there, but I do know that they are widely regarded as providing top of the line protection and options (along with a couple of other states.) So my personal thoughts are that getting the LLC is the most important thing, but that if your business is high risk it does make sense to specifically choose a jurisdiction that offers extra protection.

      The Designation of Standby Guardian is a separate document in Georgia and anticipates a short term guardianship during the parent's lifetime. You are absolutely correct that there could be situations in which the Standby Guardian might become permanent if the permanent guardian was unable to act.

    Great video. I heard that the biggest benefit of putting you home in a trust, specifically a land trust, was the privacy and protection from any creditors or lawsuits. With having your name listed as Trustee wouldn’t this expose you and your property? I also live in Georgia and looking at doing this with my home and just wanted to know

      There are many different types of trusts with different goals. Asset protection for the grantor is particularly difficult in Georgia, so you would definitely want to discuss your particular situation with an attorney.

    If i put my home into a living trust and I am a disabled veteran receiving the homestead benefit will I still receive that benefit with the house being in the living trust or will it revert to not receiving the Homestead discount benefit?

      This may be state specific, so check with an attorney in your state, but in Georgia you can still get your homestead exemption. You update the records with a trust affidavit, but you continue to receive it.

    I’m trying to find an answer and keep coming up blank. Maybe you can help me. My husband and I bought a home back in 2015. The home was only in his name. During the closing, a gift deed to me was filed. He always said if something happened between us that he wanted me to have the home for the kids. Well here we are in 2024 and we have filed a separate maintenance, and after that my children and I were given an order of protection due to family violence, and currently he is incarcerated for violating that order (yes lots of drama). His latest thing is saying that he wants me and the kids out of the house and tried to say we have to be out by June 1st. That goes against our separation agreement where he agreed to the kids and I staying in the home. It also goes against the order of protection (we have a 12 month one now) saying we have possession of the home. Everyone keeps saying “half the home is yours” as I look in to moving forward with a divorce. But what about that gift deed? Can he just up and sell the home because the mortgage is in his name? Will it have to be split equally? Or since he gave the gift deed is the home mine? Thanks for your help.

      I'm sorry you are going through this. The answer to your question requires an attorney to look at the actual language on that gift deed. I would suggest having your divorce attorney take a look or contacting a real estate attorney in your state.

    my dads had a trust and he died. my brother and I are the co successor trustees. I went to the bank with the trust and in order to transfer the CD funds they asked for an EIN. i was like WTF is this. first page to fill out under the EIN application on the irs website is responsible party. there isnt a place to enter both me and my brother, there is only one. WTF????!!!! will my brother need to fill out an ein application too?

      It is confusingly laid out, but you don't need separate numbers. One of the trustees can be listed as the responsible party.

    Wish you would go into more detail on the estate issue. And how GST have their own separate exemptions rule , it’s 12 million for estate tax exemption and additional 12 million for GST exemptions allowing you to pass on 24 m tax free. Also, mention that income produced can be given to anybody. Even the children of the trustor .

      Charging orders as a remedy provide some attractive protections for LLCs and their owners. Not complete protection by any means, but choosing the correct state for entity formation based on your goals and the state law is a well settled legal strategy.

      I'm licensed in TN and GA, so I can say that yes, it is true in TN too. Medical decision making the spouse is a presumed decisionmaker unless otherwise specified, but does not have legal and financial power of attorney rights without the document.

    Question, what if we are just waiting on the crypto bull run. Could we just eventually just send our crypto to a trust in a different country with no income tax, were that trust makes yields, and you just collect the yields tax free in that country???

      You could put crypto in a foreign trust, assuming their laws allowed it, but that would likely not impact the domestic tax that you owed.

    Thank you for posting. I wanted to put my house in a trust for my daughter to avoid capital gain tax in cause she decides to sell it when she comes of age. I still owe on the mortgage however, what would be the best option to pursue?

      Hannah, as long as you are the lifetime beneficiary of your trust (and certain other restrictions, but that is the big one), placing your home in a trust will not cause a problem with your mortgage.     One thing you can do is store your crypto assets on a hardware cold storage device “cold wallet” but require multi signature authentication to access it. You can have triple signature authentication on the hardware device between your trustee, your lawyer, and another trusted third party, for example. Maybe an eldest responsible son or daughter. You can also store your seed phrase secret words to access your crypto on steel plates using a hammer 🔨 and letter stamps. Also remember if your crypto is stored on the exchanges then they hold your private keys and that means they custody your crypto. If you don’t self custody your crypto then you don’t own or control it. Crypto is a bearer instrument only when you self custody. This is where the saying, “Not your keys, not your crypto.” comes from. If the amount is significant then you can also work with an exchange or over the counter company (OTC) like Swan Bitcoin to provide custody services. Then add those documents to your Trust. Another option is to invest in the underlying ETF exchange traded fund and add the ETF agreement documentation to your trust, etc. FYI, in USA, your bank can loan US dollars against your ETF or bitcoin they custody starting in 2025.     What if you own your home ? Can you just add it to the trust without listing yourself as the trustee and initial beneficiary?

      Yes, you can for sure. As a practical matter you will in most circumstances want to be the lifetime beneficiary of the trust and the trustee, but there aren't any restrictions if you don't have a mortgage.

      @@siedentopflaw Here is what I am trying to do If I want to be Beneficiary of my Land Trust myself to control 100% everything by myself only and my wife and kids name listed in the land trust if something happens to me. I like to set it up so the kids and my wife become beneficiaries upon the death and they don't get slammed with a tax bill. What position I can give them?

      @@johnb9710 I would have to recommend that you consult an attorney in your jurisdiction for setting up something like that. But from a nomenclature standpoint, you can call it either one. The actual important part is the trust terms describing who gets what when and under what circumstances, rather than what you call them.

    What if you bought the home in the name of the trust you created directly. The exemptions from the previous owner do or do not carry over?

      It would still be a change in ownership, so the previous owner's exemption would not carry over.

      As trustee I purchased a home for the trust titled in its name. I’m living in the home and I am also a beneficiary of the trust. It’s a manufactured home and the land is not included so in CA it is not considered real estate or real property title is with the department of housing not dmv. It is permanently affixed and not mounted on axels with wheels or have a towing hitch/tongue. So is there tax exemption Or 1047 Public Voucher for refunds for out of pocket $ for household goods & services aka a US debt or obligation 18 USC ss 8 Obligations or other security of the United States
