The sad fact is... A Will is not anywhere near as strong as people think they are. There are many, many ways that a Will can be "broken". If the Mother did have high class Financial Advisers, it would not have been left to a Will to provide protection. Remember, anyone can contest a Will. It is up to the Courts to decide if the contestant has valid grounds/reason. I have seen Lawn Mowing guys, next door neighbours, live in "companions", old friends of the family, all attempt to get things like an old Rolls Royce or other special cars that have sat in garages for years, or jewelery, or Stamp Collections, or old Guns, or Gold/Silver, or valuable paintings or even whole Estates, based on various promises made during their lifetimes (with witnesses). Wills are very weak methods of distributing Estate assets. Lawyers are NOT Financial Advisers and often mess up Estate Planning provisions. They think they know it all from a legal perspective but they are often wrong! She should have seen a Financial Planner who specialises in Estate Planning. They also need to be experts in Wills, and Trusts. So, her three sons would, of course, contest the Will. Remember, the mother changed her Will only a few days before she died. Meaning the son's already have grounds for contesting. They can argue that their mother was under the negative influence of her caregiver and the neighbour and the neighbour's son who, combined, received 100% of the Estate. That they all conspired to get a sick, dying woman to change the Will in favour of the three of them, perhaps by coercian. If the Mother really was reasonably rich then she should have either used a Lawyer who would be aware of the potential future Will contesting and take special legal steps to prove that the mother was still of sound mind, was not being adversely influenced by others, was not being blackmailed etc etc. The Lawyer would also have it videod and have specialist doctors complete attestations re her state of mind and health. Or, as I stated, a high quality Financial Planner. Having been involved in many of these situations the chances of the son's appeal is likely to be successful UNLESS extraordinary measures were taken to back up the "caregivers".
