Lady Bird deeds are great, but Lawyers hate things that are simple! Lady Bird deeds are simple. Needs name of the person that owns the property, the address and legal disscription, date, county, state. Then signed by the Grantor in frontbof a Notary and two witnesses. Very self explanatory. No probate, even has some protection against creditors. Person can keep all interest in there home while alive, then passes straight to kids (or whoever is named) on death of owner. Also has tax advantages. No gift tax too.
Thank you for sharing your thoughts on Ladybird deeds. As an elder law and estate planning attorney with over 20 years of experience, I appreciate the opportunity to clarify some points about these deeds. Ladybird deeds, also known as enhanced life estate deeds, can be a useful tool in certain circumstances. We help our clients with Ladybird Deeds occasionally. The complications of a Ladybird deed are often hidden by what appears on its face to be a simple document. It is important to understand that every legal tool has its context and limitations. While a Lady Bird deed might seem straightforward, the nuances of estate planning often require a more comprehensive approach. For instance: 1. Asset Protection: Many believe the Ladybird deed protects the house from Medicaid spenddown. However, in Michigan, that will not help if the property is not their personal residence or if the house is sold before the death of the person who needs Medicaid. These types of deeds are often used by married couples, attempting to transfer upon the death of the second spouse to die. This creates a problem if the healthier / care-giver spouse dies first, and the surviving spouse can no longer live in the home. It does not create the protection the couple thought that they had. 2. Probate: Many people use Ladybird deeds to avoid Probate Court. However, Ladybird deeds can end up in Probate Court or worse, Circuit Court. If people die in the wrong order (example: child dies before parent) it could still end up in Probate Court. If the people receiving the property are fighting or cannot agree on what happens to the property next, then it will likely end up in Circuit Court with a Petition for Partition. 3. Lack of Precision: Is the property transferred by Joint Tenants or Tenants in Common? If it is Joint Tenants, you may be unintentionally cutting out the family of your deceased children. If it is Tenants in Common, it may end up in Probate if your child dies before you. 4. Complex Family Dynamics: Estate planning often involves complex family dynamics, blended families, or unique asset distributions that a simple deed might not adequately address. 5. Legal Nuances: The legal description, execution, and recording of deeds must be precise to avoid potential issues. Mistakes or omissions, even minor ones, can lead to significant legal problems down the road. Our goal is not to complicate simple solutions but to ensure that each client's unique needs are met with the most appropriate and effective planning strategies. Lady Bird deeds are a valuable tool in the right situation, but they are just one piece of the larger estate planning puzzle. Thank you for your engagement and for highlighting this important topic. Hello! Thank you for watching. This is a great question. Here is our take: In Michigan, a Lady Bird Deed allows the property owner to retain full control over the property during their lifetime, including the right to sell, lease, or mortgage it without needing permission from the beneficiaries named in the deed. Because the owner maintains full control and ownership of the property until their death, they continue to benefit from the tax exclusions available to homeowners. Specifically, the capital gain tax exclusion permits homeowners to exclude a significant portion of the capital gain from the sale of their primary residence, provided they meet the IRS requirements. These include owning and using the home as their primary residence for at least two of the five years preceding the sale. Therefore, if the owner decides to sell their home during their lifetime, the use of a Lady Bird Deed in Michigan does not alter their eligibility for the capital gain tax exclusion. They will still qualify for the exclusion, assuming they meet the other IRS conditions related to ownership and use. This ensures that the benefits of the Lady Bird Deed do not come at the cost of losing valuable tax advantages.

Hi! I'm from out of state. Can a power of attorney in Michigan legally sever ties between the patient and their out-of-state family members? For example, if I'm trying to check on the patient's health and I contact the power of attorney, but they don't answer calls or respond, is that allowed?
Hi there! Thanks for watching and reaching out with your concern. It's important to note that Power of Attorney (POA) laws can indeed vary from state to state. In Michigan, as in many other states, a Power of Attorney is a legal document that grants authority to an individual (the agent) to make decisions on behalf of another person in specific circumstances outlined in the document. However, a Power of Attorney is not the same as a guardianship. Regarding your question, while a Power of Attorney grants authority to the designated agent to act on behalf of their person. Each state has their own rules about who can limit access to family members. The person should always be able to decide for themselves if they have the capacity to do so. If the person is incapacitated, in Michigan we have MCL 700.5306. Subsection 6 addresses guardianship visitation when a person is denied visitation with an incapacitated individual. Under this provision, if the court makes specific findings based on clear and convincing evidence, the judge may appoint a limited guardian to supervise visits between the incapacitated person and the other person. Communication between family members and the designated agent is typically encouraged to ensure that best interests are upheld. If you're experiencing challenges in this regard, it may be beneficial to explore avenues for mediation or legal assistance to address concerns and facilitate effective communication. I'm in MI, in my 70's, and had an elder atty do my lady bird deed, will, POA, and medical directive, in 2020. Cost was $600. I have one home, and only one child. Many Attorney's want people to go with the more expensive irrevocable trust's, because they make more money off them. To hype the LBD as being "dated" is ridiculous, as it still does what it was intended to do, in the five state's that recognize it (MI, FL, TX, WV, and VT).

My mom is the later stages of Alzheimer's, my stepdad ( her husband) , isn't in very condition himself. He has severe medical issues but mentally he's good. They have a will that he wants to change removing his nephew & niece as beneficiaries of their estate & adding me as the sole beneficiary. I know this sounds quite fishy but it's all above board (so to speak). My stepdad has been hospitalized since February 22nd initially he had a aneurysm in his stomach but after that his kidneys have gone South (he's been in kidney failure for years and is at the last stages of it). Since his surgery it has been my girlfriend and I who have been providing 24/7 care for my mother who again is in the later stages of Alzheimer's taking her to see him in the hospital everyday to see him providing the care she needs. Not hide nor hair have been seen or heard from the above-mentioned niece and nephew. This is the reason they desire to have their current will change I just wanted to explain that because again I know it sounds weird. Can you please give me an idea of the difficult process that I am looking at having to try to get this accomplished. I am from the U.P. and I was drafted into the Marine Corp in January of 1966 . Went to Vietnam in Oct of 66. I unit , 1st plt,3rd Bridge , 7th Engineers , was sent to Dong Ha, which is on the DMZ on Nov 11 of 19 66 , where , when air force dropped A.O. , it rained on us at the same time. About a month later I was transferred to "A" Company, 7th Engineers , where I stayed until i went back stateside.. In 1980 my youngest son was born with a BIRTH DEFECT, but had to wait until he was old enough to be operated on. 1984, had surgery to correct the birth defect at Tecumseh, Mi., hospital. The doctor did tests on the tissue and it came back ( positive for the same chemicals that are in Agent Orange ) In 2010, when I turned 65, I applied for my VA benefits. Went to C&P in 2011 for HEARING, AGENT ORANGE, PTSD JUNGLE ROT. Numbness of hands and feet. etc: Got the hearing/ tinninus, but denied the rest. Appealed the PTSD and won.(Fast forward.) May 12, 2023, had Heart Attack, went to local hospital where they did a CT Scan and found out I also had AORTIC ANEURYSM of about (9 in., in dia.) which could burst at any time. Sent by amblance to Grand Rapids, where the Specialist in that field were. They put a STENT in my heart and I talked to Dr., that was going to do surgery on the Aortic and sent home. Had to go to the VA clinic in the Soo, to have blood work. While there, my VA dr. gave me slip the said ISCHEMIC HEART DISEASE> Agent Orange. Went back on June 26, 2023 where they put 10 STENTS in the Aortic Arterias because they had to reroute to major organs. went home. Went back on Feb. 1, 2024 and hasd new AORTIC VALVE put in my heart. I had that CT Scan done while at VA in 2011, how come they didn`t see it as it takes a lot of years to get that big. ANOTHER VA SCREW UP.

You folks are in Michigan! That's great! I fought in the DMZ, the Laotian border (Lam Son 719), Ashau Valley, and Danang. Danang was used for storage of Agent Orange. Anyhow we were in 4 of the most heavily sprayed areas and I firmly believe that it cost me my pancreas and made me a type 1 diabetic. I'm waiting to see what the VA says about it.

Does Essential Tremors count under Parkinsonism...I worked the Que Son Valley 68 into 69...When I got back home my Family noticed my hand tremors?
They turned me down for the essential tremors, too.I have the same problem along with skin rashes and blisters and hypertension. I am appealing the decision on the tremors and hypertension. The VA will do everything they can to deny you, especially the first time. I was in nam half of 70,half of 71, camp eagle. Worked off of fire bases for recon.
