1:40 It can be confusing for authors & creatives to comprehend legal terms, including “common law” copyright. Instead, and when I visit with creatives new to IP, I keep it simple: “Your creative work is either *registered or not registered* with the US Copyright Office.” That’s so much easier for them to understand. And then I recount the legal benefits of timely copyright registration, and they also quickly get that. The most challenging part is to get both new and seasoned authors & creatives to include copyright registration in their business workflow: It’s a struggle!

*Girija provides lots of great tips to protect + reinforce your photo copyrights!* *The FOURTH Tip:* The best way to protect your photo copyright claims is to *“timely”* (quickly) register them with the US Copyright Office (USCO). Timely registration permits your attorney/litigator to pursue statutory damages from $750 to $30,000 and up to $150,000 for WILLFUL infringement and possible attorney fees against the copyright infringer. To save money on copyright registration filing fees, photographers can “group-register” from 2 to 750 photographs via one of two on-line (eCO) $55 registration applications: UN-published photo application (GRUPH); and published photo application (GRPPH). From my experience, photographs not timely registered with the USCO are, too often, not enforceable for money damages, as any money received from an out of court settlement or post-trial won’t typically cover the photographer’s attorney fees & legal costs, making it un-economical to pursue US infringers (notwithstanding those rare photo infringements where the actual damages and/or the infringer’s disgorged profits are SUBSTANTIAL and provable). The US copyright registration system is very much an examination process to help authenticate your copyright validity. It’s not necessarily about having a RAW or original jpeg file that proves your copyright creation - a US federal judge *MUST* see your ISSUED copyright *“Certificate of Registration”* (or the USCO’s refusal letter) to have standing to pursue US copyright infringers in federal court. So, when a non-Fair Use copyright infringer challenges my photo copyrights, I just show them my timely issued-copyright “Certificates of Registration” -- that’s my copyright presumptive proof!

If I have a Sole Proprietorship with a DBA for a predominantly online business do I need to file in several counties as well if I am not giving services in person? If I were to travel to a client occasionally would I have to file a DBA in that county/state/country each time?
