Statutorily Protected Marks
Did you know that you used to be in danger of going to jail for using Smokey Bear? There are some trademarks that are protected by law, rather then by registration with the USPTO. This video discusses those.

Racist crayons now...
Sorry, I don't respect "trademarking" a color. Your wax formula? Sure. But you can't just see a color and say "that's mine now"
How do you trademark a vegetable?
Am I the only one who didn’t realize it was a smile?
how can anyone trademark a natural phenomenon like a color? there are 2 billion in the visible light spectrum all occuring natrually. our eyes have evolved to see them all, which means such colors have existed LONG before a crayon company existed... i refuse to recognize or abide such nonsense
Neofuedalism. Corpos becoming big retainers, just raking in cash off of hoarded property, physical and “intellectual.” Even Adam Smith opposed landlordism.
WHY NOT COPYRIGHT BURNING CRAYONS ON LIGHT BULBS TOO?
Trademarks are so dumb how did they not predict how it would end up lol
I love how people say we can't patent a plant so that's why cannabis is illegal meanwhile we literally just had somebody patent a scent. And not even the scent just the descriptor of the send.....
Asparagus is not a unique word...
With a Stupid Idea Like That One Has To Wonder If They Are Eating Their Own Crayons. A Pack Of Fools Is What They Are!
I wanna smell like crayons. That's hot.
What is a cran are you trying to say crayon
U got the legendary
THEY JUST COPYRIGHTED WAX CRAYON SMELL????
I have that same one,and I found it on the ground at school and I want more
I'm waiting for #3-8!
Ohh, you can register _smells_ now?? I hate it here.
Why would a kid want that?
To put on their bookbags!
You can't trademark a scent. The perfume and cologne industry already covered this. Scent is the individual opinion of each person that smells something.
Crayola is the Standard Oil of crayons.
Everybody talking about the scent, meanwhile I am wondering why “tickle me pink” was a color 😭
I don't get that one, either!
While i hate this word i found this video triggering. It makes me want to go there and buy every different color crayon to just have as part of some weird desire to have a complete collection of them. It triggers whenever i see anything like that. Markers. Pens. Yarn. Paint swatches. I have one of those Pantone color pallet stacks that would give me the biggest dopamine hit just looking at it. There has to be some word for that. (The color thing not the crazy thing)
I'm not sure the word for it, and this probably doesn't help... but they have a tin you can buy and fill up with crayons. I think I got all colors, and a few markers, too!
@@trademarksarefun and a cool tin to keep them in? Ooooooh
Crayons are also used to communicate with MAGA supporters! They not so good with words.
Okay so what I'm hearing is the patent office is allowing a corporation to trademark the scent on elementary school being as that's the flashback most adults in western society has when a kids pencil box is opened near by.
I used to work at a USN airfield. Jet fuel smells like crayons sauted in kerosene.
How do they distinguish a smell? Do they have like... a professional smeller? A Someller if you will?
That's a great question. There will probably be survey evidence from consumers.
crayola is so woke i went back to drawing in pencil
Shits stupid tradenarks are getting out of hand...
"Capitalism is weird."
Smells are too subjective to properly copyright. How can you prove something is the same smell in a court of law? Is there a machine that can objectively measure a "smell"?
Trademarking the genetic makeup of a crayon for the smell should be illegal it gives them a monopoly on crayons and any other company that try’s to make crayons will be infringing on copyright with that trademark
Marines would love this
I smelt a smell inside of an old muscle car and it smelled like Crayola crayons! Who knew decaying leather and glue of a classic muscle could smell so nostalgic.
Apparently there was a Yale study in 1982 that determined the smell comes from beef fat!
We're letting them trademark SMELLS now?!!? This is absurd. They didn't purposefully create the smell. What, other crayons are just not allowed to smell like crayons now? Give me a break... the level of control over basic functions of reality we allow corporations to have is ABSURD. Smell is too subjective to trademark anyway; you can use adjectives to describe it, but you can't actually define it so clearly you should able to trademark it. They didn't even invent wax crayons, for crying out loud! What's next, someone can own the smell of different foods? Fresh air? Rain? New born babies?
How is it a taste test if you break it in half I get people eat them thay way but it's not really a taste test without at least trying it all together
I did try it all together in the full video going up on Tuesday! I just ran out of space when trying to make it under 60 seconds!
Makes sense. @trademarksarefun
@@trademarksarefun fair enough
:o
Bro can’t believe my wax candle making station at the Renaissance Faire just got sued for smelling like crayons
The trademark registration applies to crayons!
The heck are you going to do with a GIANT crayon? Pretty sure if you ate that, you would die
LOL It's on the shelf in my office and I'll use it for seminars to describe different types of trademarks.
Cool
Mmmm yummy 😋
If Crayola now has a trademark on the scent of its crayons, we could possibly see a Crayola scented candle in the future.
Latestage capitalism. This clays smell is copyrighted by the crayola corporation. What a joke.
Nothing like that smell of capitalism in the morning
They trademarked the fuckin smell even? My lord, that is just goofy as hell.
They should be starting calling they brown crayons "flesh toned" 💅👏
...When you didn't know this existed, but now REALLY want to go and feel like a kid again.
It's amazing.
Its weird but Crayola is a monopoly that is often forgotten. The fact that something dealing with a monopoly is often forgotten is solid proof even if you are a monopoly doesn't mean you will last forever. In truth I haven seen Crayola merch sold for a long time in fact I actually haven't even seen Crayons being sold at all for a long time. To tell the truth my niece and nephew who are almost 8 and almost 13 or 14 have never owned crayons. They have colored with colored pencils or markers but no crayons. Hell I can't remember the last time I saw someone buy crayons at all. Hell when I worked at a grocery store over 12 years ago people didn't buy crayons then either. Hell I look at school supplies when I go to the store and I have not seen crayons in them for a long long time. I am 35 but I haven't used a crayon sense I was 8 years old. Dear god crayons are an item that never goes bad but I have completely forgot they existed. I am actually surprised the company is still in existence.
You shouldnt copyright colors or smells. Just saying
Copyright: curb stomping creativity now based on scent!
Bro arbor vitae essential oil about to belong to crayola
The trademark applies to crayons, and would likely not apply to essential oils
