    I have to admit the time I needed an ESA,, I was so depressed and considering suicide. But NO ONE cared or did anything for me! A guy moved into one of my apartments with an ESA "Piss cat!" No pet fees or damage deposit allowed. His cat destroyed all the carpets/pads, damaged sub floor. This cost me thousands of $ that I did not have! Guy took his cat, paid me NOTHING!

      You were without your rights to charge the tenant for the damages. Prior to them moving in you should taken photos and had a walk through with the tenant.

    This is what’s wrong with this entire country. I don’t know who makes these laws, but they are completely one-sided. Now, before anybody jumps down my throat, I understand that somebody may have an actual service animal. I don’t really understand how a pitbull can be an emotional support animal. That’s where the law starts to get out of hand. Also, only somebody who is as dumb as a rock would make a law that treats these animals as human beings. They are not human beings they are and will always be animals. So to say that a landlord cannot charge a pet fee or additional fees is absolutely ridiculous. I understand if they want to regulate fees so that they don’t get crazy but now you have animals living in your house that shit where they want to, shed hair, chew baseboards and other damage to hardwood floors, etc. they are not human beings. If somebody puts a cat into a house that is their emotional support animal, many people are highly allergic to cats and now the landlord must pay to have all the carpets cleaned or possibly replaced for the next tenant. These laws are absolutely ridiculous. I’m not posting this comment to offend anyone who has service animal although if you have a pet duck or a pet pig or some other kind of crazy pet like a pitbull and you are saying that that is your emotional support animal then I have a problem with that.

      These laws actually do not make the animals as humans. They do not fall under "pets", but they change to either "assistance animal" for ESA or "medical equipment" for a service animal! I work with animals, and have ESAs, and I disagree with that ESAs do not require any training. I do support basic training for simple manners and teaching owners proper outlets for their dogs energy or needs. Also, I'm glad the laws states that any pet-specific damage falls financially to the tenant. Just because I have been given the privilege to my dog because of my disabilities, should not mean that I let my dog eat a wall and get no consequences for my lack of control over said animal. Just like parents, a good owner will make sure their animal is well behaved!

      Also pitbulls are commonly used as both service animals and ESAs because they are extremely intelligent. It’s ok if you don’t like them or aren’t comfortable, but if that animal provides a service for a disability either physical or mental and is approved then it can be an awesome esa or service animal!

      An animal still has to be well behaved. Document these issues, send a written notice or 2 informing them of the problem and telling them to cease the issue. If it continues, tenant can be evicted.

      Um think again. An esa will be charged monthly ( animal fee). A legitimate service dog will be exempt. An esa dog cannot fly for free, a service dog will. I’ve seen lots of people charged the monthly pet fee from rental companies.

    This is vague and misleading. Breed absolutely can matter. Insurances have a breed ban list. If tou rent to someone with one of those breeds, insurances can and will either raise or cancel insurance. A landlord can deny because forcing them to pay more for insurance is not reasonable.

    Some of the Petscreening companies are landlord friendly and make it difficult to get an emotional support animal so the landlord can charge monthly pet fees. They even brag about that in their advertising, Renters should know the landlord can not force a renter to use a Petscreening company. The renter can apply directly to the landlord. That is usually the best way.

      Not all management groups will allow you to put in a reasonable accommodation for an ESA or service animal. They will continuously state " it is our right to use outside sources to conduct work for us." Unfortunately I know that's not true. Pet screening does not know the resident with the disability, hence, they can not approve or deny an ESA or service animal. Currently in the middle of a fair housing complaint pertaining to this issue as well as another issue. I am disgusted with the way real estate companies are treating their residents (30+ years renting from the same company)

      The way to address this issue is to remember your animal is not a pet. I haven’t had to use this type of service but if they ask if you have a pet, I alway say no and then make the reasonable accommodation after I am approved.

      An esa dog is just viewed as a normal pet and will be subject for a monthly fee. A real service dog will be exempt from those fees etc

    Actually you can get past it as a landlord. If the animal causes damage that is beyond accommodation then you can get rid of it. Also, if you are a landlord and you own less than 3 single family homes you do not have to let the tenant keep their ESA

      You're slightly off with that last point. You can own as many sfh as you want, but you can't use an age or broker to handle the business end of it. Also, if you're living on a multifamily property with 4 units or less, then you can exclude the ESA people.

    It seems everyone can get an ESA letter. 🤦‍♀️ The following living situations are exempt from rule of the FHA: -Owner-occupied buildings with four units or less. -Single-family homes sold or rented by the owner without an agent involved. (Myself) -Housing operated by a religious organization or private club.

    Such bullshit. Too many ppl just can't take no for an answer. Not a fan of ESA and "certificates" to give you the right to do something on property you don't own when you know ahead of time that you can't. If anyone attempts to rent a place that does not allow animals (which is the owners right) and then they show up later with a "certificate" that basically says, "Haha, I have a dog and you can't do a thing about it even though I know you don't want dogs on YOUR property." shows a sneaky, can't take no for an answer mentality. I can't put my feet on someone else's coffee table in their house just because I do it my own. If someone wants me not to curse in their house, even though it's my right to, guess what?!?! If I want to stay at their house, I will respect their rules. Millennials can't grasp that you can't always do what you want in life. Comes down to parenting IMO.

      Whats your opinion on the "type" of animal in apartment settings? Liability goes up with large dogs (barking, poop, bite, leash laws, interior damages) vs a small kitten?

    The only thing they needa know is to leave them tf alone. Pets are family and I'm SO SICK of seeing "no pets" you are a complete pos if you do that. No excuse.
