How would this play out in a scenario, where a default judgement has already been entered and the defendant has only responded to the claim after this has been issued against them. But then, complain the statement of case, doesn't allow for an effective defence and or they were not served correctly. But, a defence was provided, once ordered to do so by the court. - but, they later make an application to strike out?
Or in gross medical negligence a causation. One of you ppl should know. Awaiting your reply GW
The hip was smashed to smithereens in 2010 I was eventually operated on to save my life and my left leg in 2013 June. I survived due to a skilled surgeon. So 5 days, or almost 3 and a half years. Gross medical negligence. No causation clause for that. I still haven't been able to get my medical record off the GP. I am in England.
Do I am still being abused. Because of causation. I was not the cause. You are saying that through gross medical conduct people are dead. It's unlawful death, tantamount to murder. See you in court. I still have been denied my full medical notes. This causation law as said, is not accurate enough. Just like Harold Shipman. I hope you can sleep at night. Nobody is above the law you know this.
I was left, untreated, not examined when calling my GPS surgery for a doctor to do a home emergency visit from this practice after a severe fall ( none disclosure ) in my home. He refused to even physically examine me, i was suitably dressed btw. He was rude obnoxious, dismissed my injury to my left hip and told me, after me explaining how the injury happened, and my needs to go to hospital straight away as I knew my hip was severely damaged, hiscresponse, listen Dear, you wouldn't be able to walk if your hip was broken. At that point I again, pleaded with him without getting upset, calmly I did question his belief that taking pain killers, paracetamol and after 2cweeks, if no better makes an appointment at my GPs. 3 and a half years later, I had lost my hip my femur bone hip was dust I suffered avascular necrosis then septicemia. Beforehand I was sent for cortisone injections instead of even an x Ray. Nice one. Then I am just a eoman. 😂❤❤❤I survived that. See your Judges in court as I have even more bad news. I was overdosed in hospital last year and as a result had a catastrophic fall in my bedroom due to being given any psychotic medication illegal dosage and was left on the hard floor for 6 hours. My back is broken in 2 places and I was refused treatment. 😂😂😂😂😂😂❤❤❤
Unlawful death. Is when a life which could have been saved was caused by a positive action by the Authorities in this case of allowing suffocation when on duty of care. Gross medical negligence can cut out clinical malpractice where causation is due to medical neglect of the patient knowing that the outcome would cause eventual death, or prior to taking away life by not responding, as a medical specialist to allow brain death.
A cumulative effect is able to provide the full scope of causation. Lack of having a qualified anesthetist and pre medical knowledge of the patient and with specialised knowledge to put into practise is breach of practise, which added to the lack of correct means that there was enadequet care of the patient, where there was a high risk situation left a patient untreated is surely causation breech of gross medical negligence
The Garda sold one item of my property, one item given to family member im told, no answers forthcoming regarding ,what member of family, where did the money go from the sale of one item, i have now climbed the ladder so to speak looking for accountability, im now at the top commissioner's office.told to day to get a solicitor, im quite capable of asking simple questions, like where is my valuable property.each with a different story, the first sergeant refused to talk to me and put down the phone, I live in Ireland.i know laws are different in countrys, but misconduct and negligence is the same the world over, great to listen to you, Thank you.
I need help😢
What about civil cases not subject to CPR like council tax heard in Magistrates court not under criminal rules
how can i become across border mediator, what is the requirements, i m a certified and accredited mediator from kenya
do you stand in front a master in the high court when making an application to strike out?
I would assume, in front of a District Judge. But, it would be dependent on the type of case, as to who would hear it.
If the domestic connection portion of your international flight is cancelled, and you miss the last leg of your trip, does the Montreal Convention apply? JAX to MIA to CUN Never made it to MIA due to mechanical issues with the plane in JAX.

Thank you very much for the upload.
Thank you for an informative webinar.
If theres two cases with different limiitation periods and an application is made to have them disposed of in the same claim at the same time, and yet one of the claims has ran out of time and the other one is still within the time limit allocated for that claim, what happens to the claim that ran out, does the claim with a longer time period cover the shorter period given for the other claim which has ran out, or would there just then be one claim ?
Hi, if you email your query to clerks@dekachambers.com we can pass it on to the appropriate person for you. thank you.
Are you making 2 Claims? Limitation for CPR Money Claims is 6 years the absolute maximum for Probate is 12: 11 years beyond the the traditional Executor's Year.
Try googling the Limitation Act 1980.
My issue I have is that, there is good and valid reason for bringing the claim forward even though the limitation period has ended with respect to that claim, however I'm not particularly sure on what to do first, whetheer to submit both claims with an N1 form to be disposes of in the same proceedings and included the request for order under the relevant CPR in a document attached to that form, or not submit the N1 form and instead request the that claims are stayed subject to the consideration of the validity of the limitation period. What I'm asking I believe is how do I present or ask the court to consider the reasons for excluding the limitation period, and getting that agreed so I can then proceed with the claims

This sounds like they are using the problems with the current system as a means of justifying a new system but with nothing actually showing that they can provide the solutions. The new system would be a walled garden, a captive market, like the NHS itself. At least with the current system a claimant can hire a lawyer which would allow market forces to provide all the lawyers that are needed. With the proposed system there would be a handful of overworked staff and the claimant would just have to accept the situation. We've seen this with the passport office and DVLA, who only have a very simple job to do.
Can i ask about a local authority who has caused serious data protection breaches for family to keep a family safe who are protected by High court. 8 continues Data protection breaches of medical reports and addresses. Schools have also called out the data protection breaches and leaking the address 8 times to different places ( identified in a DSAR ) different schools have nothing to do with family? Would this be something you would be interested in

If a claimant withdraws from an injury claim without issuing proceedings, could the defendant still argue for a finding for fundamental dishonesty where the claim would have on balance been struck out in its entirety anyway on the vehicular heads of losses (credit hire and vehicle damages)?

Update You have been kicked out from the Lugano Convention...Brexit means brexit...
Excellent presentation, it has given me good take away information. Thank you very much!
Hi, glad you found it useful!
The codswallop on the Lugano Convention is called Brexshit. Enjoy! And please, don't go on childish emotional rants. If the EU let's the UK accede what is it going to say to the US, if it wanted to accede? Also, obviously this is about the City too, as in the national interests of EU member states. Well come to Brexit!
It is not an offence by law to be offensive , hate crime is wrong and could be deemed as racist.
This video was very useful ! I was wondering if you guys could cover some company law. Perhaps insolvency ?
